In the facts and circumstances of the case, the<br \/>\napplication is taken up for hearing today.\n<\/p>\n<p id=\"p_2\">2.\t\tThis<br \/>\nis an application preferred under <a href=\"\/doc\/1290514\/\" id=\"a_1\">Section 439<\/a> of Criminal Procedure<br \/>\nCode in connection with the CR No.I45\/2008 registered with Palitana<br \/>\nPolice Station for the offences punishable under <a href=\"\/doc\/1868826\/\" id=\"a_1\">Sections 498(A)<\/a>, <a href=\"\/doc\/92983\/\" id=\"a_2\">306<\/a><br \/>\nand <a href=\"\/doc\/112749\/\" id=\"a_3\">114<\/a> of Indian Penal Code. The learned advocate for the petitioner<br \/>\nsubmitted that considering the fact that the petitioner is aged and<br \/>\nhas not played any role in the offence alleged against her, it is a<br \/>\nfit case to release her on regular bail. The learned advocate also<br \/>\nsubmitted that the petitioner would abide by the terms and conditions<br \/>\nimposed by this Court.\n<\/p>\n<p id=\"p_3\">3.\t\tLearned<br \/>\nAPP representing the State vehemently submitted that considering the<br \/>\nrole attributed to the petitioner and the nature of offence and<br \/>\ninvolvement of other co-accused, the bail application deserves to be<br \/>\nrejected.\n<\/p>\n<p id=\"p_4\">4.\t\tI<br \/>\nhave considered the rival submissions and on perusal of the averments<br \/>\nmade in the petition as well as FIR produced at Annexure-A to the<br \/>\npetition and considering the role attributed to the present<br \/>\npetitioner and the fact that she is aged about 65 years, it is a fit<br \/>\ncase to grant bail to the petitioner.\n<\/p>\n<p id=\"p_5\">5.\t\tIn<br \/>\nview of the aforesaid facts and circumstances of the case and without<br \/>\nentering into the merits of the matter, I am inclined to exercise my<br \/>\ndiscretion in granting bail to the petitioner. Hence, the following<br \/>\norder.\n<\/p>\n<p id=\"p_6\">6.\t\tThe<br \/>\nparties do not press for further reasoned order.\n<\/p>\n<p id=\"p_7\">7.\t\tIn<br \/>\nthe facts and circumstances of the case, the application is allowed<br \/>\nand the applicant is ordered to be enlarged on bail in connection<br \/>\nwith C.R. No.I-45\/2008 of 2008 registered at Palitana Police Station<br \/>\non executing a bond of Rs.10,000\/- [Rupees ten thousand only] with<br \/>\none surety of the like amount to the satisfaction of the trial court<br \/>\nand subject to the conditions that she shall:\n<\/p>\n<p id=\"p_8\">[a]\tnot<br \/>\ntake undue advantage of her liberty or abuse her liberty;\n<\/p>\n<p id=\"p_9\">[b].\tnot<br \/>\nact in a manner injurious to the interest of the prosecution;\n<\/p>\n<p id=\"p_10\">[c].\tsurrender<br \/>\nher passport, if any, to the lower court within a week;\n<\/p>\n<p id=\"p_11\">[d].\tnot<br \/>\nleave the State of Gujarat without the prior permission of the<br \/>\nSessions court concerned;\n<\/p>\n<p id=\"p_12\">[e].\tfurnish<br \/>\nthe present address of her residence to the I.O. and also to the<br \/>\nCourt at the time of execution of the bond and shall not change her<br \/>\nresidence without prior permission of this Court;\n<\/p>\n<p id=\"p_13\">[f].\tmaintain<br \/>\nlaw and order.\n<\/p>\n<p id=\"p_14\">8.\t\tIf<br \/>\nbreach of any of the above conditions is committed, the Sessions<br \/>\nJudge concerned will be free to issue warrant or to take appropriate<br \/>\naction in the matter.\n<\/p>\n<p id=\"p_15\">9.\t\tBail<br \/>\nbond to be executed before the lower Court having jurisdiction to try<br \/>\nthe case.\n<\/p>\n<p id=\"p_16\">10.\t\tAt<br \/>\nthe trial, the trial Court shall not be influenced by the<br \/>\nobservations of preliminary nature, qua the evidence at this stage,<br \/>\nmade by this Court while enlarging the applicant on bail.\n<\/p>\n<p id=\"p_17\">11.\t\tRule<br \/>\nis made absolute to the aforesaid extent.\n<\/p>\n<p id=\"p_18\">12.\t\tDirect<br \/>\nService is permitted.\n<\/p>\n<p id=\"p_19\">\t\t\t\t\t\t[H.B.ANTANI,<br \/>\nJ.]<\/p>\n<p>ashish\/\/<\/p>\n<p>\t\t   \u00a0\u00a0\u00a0<\/p>\n<p>\t\t   Top<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Gujarat High Court Banuben vs State on 21 July, 2008 Author: H.B.Antani,&amp;Nbsp;
