No.31104 of 2011\n                 Dayanand Choudhary @ Dayanand Prasad Choudhary, Son of Late Darshu\n                 Choudhary, resident of village-Bhagatpur, P.S.-Balia, District-Begusarai.\n                                          Versus\n                                   The State of Bihar\n                                         -----------\n<\/pre>\n<p id=\"p_1\">2.   14.9.2011                     Heard learned counsel for the petitioner and learned<\/p>\n<p>                       counsel appearing for the State.\n<\/p>\n<p id=\"p_1\">                                   The petitioner apprehends his arrest in connection with<\/p>\n<p>                       Balia P.S. Case No. 108 of 2011 registered for the offence under<\/p>\n<p>                       <a href=\"\/doc\/361626\/\" id=\"a_1\">Section 7<\/a> of the Essential Commodities Act.\n<\/p>\n<p id=\"p_2\">                                   It is alleged that on information the premises of petrol<\/p>\n<p>                       pump in question was raided. It was found that diesel was being<\/p>\n<p>                       filled through pipe in gallon from the tanker filled with diesel,<\/p>\n<p>                       bearing Tanker No. BR9B-3253. The driver of the tanker, namely,<\/p>\n<p>                       Md. Alitaf Khan @ Kala Khan and Khalasi namely Md. Naushad<\/p>\n<p>                       Khan on inquiry disclosed that about 100 liters of diesel was sold to<\/p>\n<p>                       Mr. Ashish Poddar and Chamru Mahto from the tanker. Some<\/p>\n<p>                       kerosene oil was also found in a cemented container adjacent to the<\/p>\n<p>                       office. On inquiry, Ashish Poddar and Chamru Mahto disclosed that<\/p>\n<p>                       the said closed petrol pump had been taken on rent, in which apart<\/p>\n<p>                       from them Ranjeet Singh and Shahabuddin Mian were also involved<\/p>\n<p>                       in illegal dealing. Thereafter, with the help of local P.D.S. Dealer<\/p>\n<p>                       said diesel and kerosene oil was seized and seizure list was<\/p>\n<p>                       prepared.\n<\/p>\n<p id=\"p_3\">                                   On perusal of chalan (invoice), it transpire that the same<\/p>\n<p>                       was issued from Hindustan Petroleum Company on 11.7.2011 in<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                       2<\/span><\/p>\n<p>favour of Jyoti Petroleum, Madahatpur, P.O.- Jamuniya, P.S.-<\/p>\n<p>Naugachhia, district-Bhagalpur. From the certificate of registration<\/p>\n<p>of tanker lorry, it transpires that the same belonged to Smt. Pawan<\/p>\n<p>Devi.\n<\/p>\n<p id=\"p_4\">           In the F.I.R. it is alleged that on inquiry it was learnt that<\/p>\n<p>the owner of the closed petrol pump was Dayanand Choudhary @<\/p>\n<p>Dayanand Prasad Choudhary.\n<\/p>\n<p id=\"p_5\">           It is stated that the petitioner has got no concern with the<\/p>\n<p>petrol pump in question i.e. Auto Fuels, Lakhminia and the said<\/p>\n<p>petrol pump belongs to Manoj Kumar Agrawal of Begusarai. The<\/p>\n<p>pump is closed since long. Subsequently, one Rahul Vibhushan tried<\/p>\n<p>to operate the said petrol pump and he filed writ application before<\/p>\n<p>this Court being C.W.J.C. No. 17159 of 2007 which was allowed on<\/p>\n<p>10.3.2010. Against the said order passed in the writ petition, the oil<\/p>\n<p>company preferred LPA No. 1369 of 2010. The said L.P.A. was<\/p>\n<p>allowed by a Division Bench of this Court by order dated 4.11.2010<\/p>\n<p>and against that order, Rahul Vibhushan and another preferred<\/p>\n<p>S.L.P. before the Hon&#8217;ble Supreme Court, being S.L.P. (Civil) No.<\/p>\n<p>6561 of 2011 and the same was dismissed on 14.3.2011. Thus, it is<\/p>\n<p>argued that the oil company refused to transfer the license of said<\/p>\n<p>petrol pump in the name of Rahul Vibhushan and another and till<\/p>\n<p>date, the license of said petrol pump is in the name of Manoj Kumar<\/p>\n<p>Agrawal.\n<\/p>\n<p id=\"p_6\">           It is also submitted that even if assuming for the sake of<\/p>\n<p>argument (without admitting) the petitioner to be owner of said<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                               3<\/span><\/p>\n<p>          closed petrol pump, no offence would be attracted against him<\/p>\n<p>          because, even as per F.I.R. the aforesaid land and closed petrol<\/p>\n<p>          pump, etc., were taken on rent by Ashish Poddar, Chamru Mahto,<\/p>\n<p>          Ranjeet Singh and Shahabuddin Mian and as per F.I.R. the diesel in<\/p>\n<p>          question was sold to Ashish Poddar and Chamru Mahto.<\/p>\n<p id=\"p_7\">                   It is also submitted that the petitioner has got no criminal<\/p>\n<p>          antecedent.\n<\/p>\n<p id=\"p_8\">                   Taking into consideration the aforesaid submissions, let<\/p>\n<p>          the petitioner, namely Dayanand Choudhary @ Dayanand Prasad<\/p>\n<p>          Choudhary in the event of his arrest or surrender before the Court<\/p>\n<p>          below within a period of four weeks from the date of<\/p>\n<p>          receipt\/communication of this order, be released on bail on<\/p>\n<p>          furnishing bail bonds of Rs. 5,000\/- (Five thousand only) with two<\/p>\n<p>          sureties of the like amount each to the satisfaction of the learned<\/p>\n<p>          Sub-Divisional Judicial Magistrate, Begusarai in connection with<\/p>\n<p>          Balia P.S.
