ShiIra:U;dFa~?W2 is the son of the deceased.\n\n\" '~ ..,.,A1:$pe11a'nt \"1'~.lo.l(A  Appellant No.2 [A2] are friends.\n\n relationship with the deceased and he had\n\nb1\"o~ugh_t '11e.I' a cow and also lent some amount by Way of\n\nloan. \"The deceased was also attending to the\n\n\"\"ag1'icultural work of Al. A1 insisted the deceased to\n\n  '*\"1*eturn the loan amount. The deceased refused to repay\n\nthe amount. A1 bearing grouse against deceased with\n\n\n\nthe assistance of A2, on 25.01.2004 at about 11 pm.\ncaused murder of the deceased by strangulation\"-,and\n\ndropped the dead body in a dry weil.\n\n\" 2. The dead body was noticed  on\n\n27.01.2004<\/pre>\n

\n25.01.0’004-  she was found to be dead.<\/p>\n
The {dead  subjected to post mortem. The post<\/p>\n
  that the death is due to asphyxia<\/p>\n
 to”sti’ar1g’u.l:ation. The death is homicidal.<\/p>\n
  A1 is arrested on 05.02.2004. The<\/p>\n
 .rVui.11brelia belonging to deceased was recovered. A2 was<\/p>\n
0  “produced before the CPI on the same day. On the basis<\/p>\n
  his voluntary statement, M09; 12 and 13 used for<\/p>\n
dropping the dead body in the Well were recovered. The<\/p>\n

accused are charged for committing offences under
\nSections 302<\/a>, 201<\/a> r\/w 34 ofIPC<\/a>.\n<\/p>\n

— ‘  circumstance, recovery, homicidal death and<\/p>\n
aloscondence of accused. PW~3 who is supposed to<\/p>\n
 testify the last seen circumstance has turned hostile.<\/p>\n
The recovery evidence adduced by the prosecution is<\/p>\n
fragile and frivolous. The evidence of PW~2 does not<\/p>\n
corroborate the fact that the deceased on 25.01.2004,
\nwent out from house around 9.45 pm. taking umbrella<\/p>\n
with her. The rope MO’s l2 and 13 recovered fat\u00bbsthe<\/p>\n
incidence of A2 does not have any incriminatinlg;rriai\ufb01\ufb01s.<\/p>\n
or material to show that it was  -..\n<\/p>\n
dropping the dead body in the  <\/p>\n
strangulation was Well intact around  oi? <\/p>\n
deceased at the time when  vvasilnciticed. The
\nprosecution on record_xhas’l–_onjly” esltahlished the motive<\/p>\n
and the circumstanceof -IE1’0rVr1ic’i,dalV’_dea.th. There is no<\/p>\n
clinching l’evidenc.el .tlo~,1’prove” the complicity of the
\naccused uwith ‘thefjevidence. The recovery evidence is<\/p>\n
incredible. ‘V<\/p>\n
V   In that ‘v’i’e’vv of the matter there is no credible<\/p>\n
 tdipirove the guilt of the accused. The<\/p>\n
convictions-f the accused is bad in law.<\/p>\n
it   The appeals are allowed. Accused are set free<\/p>\n
 uforthwith, if not required to be detained in any other<\/p>\n
wk<\/p>\n
case. The \ufb01ne amount deposited by A2 shall be<\/p>\n
refunded to A2.\n<\/p>\n
The fee of Sri. Somashekar  1<\/p>\n
