The respondent workmen raised an industrial<br \/>\ndispute for regularization of their services, which was ultimately<br \/>\nreferred to the Industrial Tribunal for adjudication being  Reference<br \/>\nNo. 134 of 1985.  The Industrial Tribunal allowed the reference and<br \/>\ndirected the petitioner to regularize the services of the respondent<br \/>\nworkmen. Hence this petition.\n<\/p>\n<p id=\"p_2\">3.\t\tHeard<br \/>\nthe learned counsel for the respective parties. Having considered the<br \/>\nsubmissions and perused the documents on record, it transpires that<br \/>\nthe issue involved in the present case is squarely covered by a Full<br \/>\nBench decision of this Court in the case of Amreli Municipality<br \/>\nV. G.P.M.E. Union, reported<br \/>\nin 2004(3) 1841. The ratio laid down in the<br \/>\nsaid decision reads as under:\n<\/p>\n<p id=\"p_3\">&#8220;12.1\tAfter<br \/>\nconsidering the decisions cited before us, the following principles<br \/>\nemerge:\n<\/p>\n<p id=\"p_4\">[A]\tNo<br \/>\nregularization or permanency can be effected de hors the statutory<br \/>\nprovisions or the guidelines.\n<\/p>\n<p id=\"p_5\">[B]\tLong<br \/>\nservice put in by the workmen itself may not be a ground to<br \/>\nregularize services of ad hoc\/temporary workmen against the<br \/>\nsanctioned set-up without following statutory procedure of<br \/>\nrecruitment. At the most, Labour Court\/Industrial Tribunal can issue<br \/>\ndirection fro consideration of absorption subject to availability of<br \/>\nposts on the establishment.\n<\/p>\n<p id=\"p_6\">[C]\tTo<br \/>\navoid nepotism and corruption, no back-door entry in service;\n<\/p>\n<p id=\"p_7\">[D]\tFinancial<br \/>\ncapacity of the local body to have additional burden is a relevant<br \/>\nconsideration to be kept in mind while ordering regularization or<br \/>\nabsorption.&#8221;\n<\/p>\n<p id=\"p_8\">4.\t\tThe<br \/>\naforesaid decision has not been considered by the Industrial Tribunal<br \/>\nwhile considering the aforesaid case. Therefore it would be in the<br \/>\ninterest of justice to remand the matter to consider the same afresh<br \/>\nin view of the aforesaid decision.\n<\/p>\n<p id=\"p_9\">5.\t\tIn<br \/>\nthe view of the principle laid down in the aforesaid decision, the<br \/>\nimpugned award of the Industrial<br \/>\nTribunal is quashed and set aside. The matter is<br \/>\nremanded to the  Industrial Tribunal for consideration of the same<br \/>\nafresh. The Industrial Tribunal shall decide the reference within a<br \/>\nperiod of six months from the date of receipt of writ of this order.<br \/>\nIt is clarified that in view of quashing of the award the recovery<br \/>\nproceedings will not survive.
