Kapadia for petitioners and learned<br \/>\n\tAGP Ms. Jirga Jhaveri for respondent State Authority.\n<\/p>\n<p id=\"p_1\">In<br \/>\n\tthis case, initially, District Collector, Surat passed order on 27th<br \/>\n\tJuly, 2009 with a direction to respondent authority to work out<br \/>\n\tcompensation while allowing partly appeal preferred by petitioner<br \/>\n\tand on that basis, whatever compensation is required to be paid by<br \/>\n\trespondent, same is to be paid by respondent to petitioner.<br \/>\n\tPetitioner has not received any compensation from respondent<br \/>\n\tauthority so far and order passed by District Collector, Surat dated<br \/>\n\t27th July, 2009 is not implemented in favour of<br \/>\n\tpetitioner by respondent authority and, therefore, this court was<br \/>\n\tmoved by petitioner by filing Special Civil Application NO. 12984 of<br \/>\n\t2009 wherein following order is passed by this Court on 17th<br \/>\n\tDecember, 2009:\n<\/p>\n<p id=\"p_2\"> 1.\tBy<br \/>\n\tway of this petition, the petitioner, prayed as under:\n<\/p>\n<p id=\"p_3\">  [a]\tto<br \/>\n\ttake action on the representation dated 1.8.2009 and 7.9.2009<br \/>\n\t(Annexure  D  and  E  ) made by the petitioner to the<br \/>\n\trespondent no.2 and to release compensation awarded by the District<br \/>\n\tCollector, Surat vide his judgment and order dated 27.7.2009 in<br \/>\n\tAppeal No. 8\/2007.\n<\/p>\n<p id=\"p_4\">2.<br \/>\n\t\tRespondent no.1 -the Government of Gujarat, Energy &amp;<br \/>\n\tPetrochemicals Department, Gandhinagar  vide notification dated<br \/>\n\t16.3.2006 issued u\/s. 6(1) of the Act declared that right of the<br \/>\n\tuser in the land specified in the Schedule  is acquired for laying<br \/>\n\tthe  pipelines and further in exercise of power u\/s. 6(4) of the<br \/>\n\tAct, the State Government directs that the rights of the user in the<br \/>\n\tland shall vests on the date of the publication in the\tGSPL,<br \/>\n\tGadhinagar free from all encumbrances. The petitioner&#8217;s land was<br \/>\n\talso included in the said notification. The petitioner was awarded<br \/>\n\tRs. 8,80,720\/- as total amount of compensation by the competent<br \/>\n\tauthority GSPL, Gandhinagar. Being aggrieved by the said order the<br \/>\n\tpetitioner preferred an application before the respondent no.5-<br \/>\n\tDistrict Collector, Surat vide LAQ Appeal No. 8 of 2007 for<br \/>\n\tadditional compensation for the damages to the land and standing<br \/>\n\tcrops\/ trees.  By order dated 27.7.2009, the District Collector,<br \/>\n\tSurat directed the  respondent no.2 to 4 to pay the  expenses<br \/>\n\tclaimed by the petitioner after proper verification. However, though<br \/>\n\tthere were several representation made by the petitioner, no action<br \/>\n\ton the part of the respondent authorities. Hence, this petition.\n<\/p>\n<p id=\"p_5\">3.<br \/>\n\tFrom the record it appears that no action what so ever was taken by<br \/>\n\tthe respondent authorities in spite of several representation.<br \/>\n\tLooking to the peculiar facts of th case I am of the  view that ends<br \/>\n\tof justice will be passed by passing the following order :\n<\/p>\n<p id=\"p_6\">(I)<br \/>\n\t\tThe Respondent no.2 competent authority shall decide the<br \/>\n\trepresentation made by the petitioner(Annexure D &amp; E to the<br \/>\n\tpetition) within a period of four weeks from today and thereafter<br \/>\n\tRespondent no.3 shall make the payment of compensation on furnishing<br \/>\n\tthe security by the petitioner within a period of two weeks.\n<\/p>\n<p id=\"p_7\">(II)\tThe<br \/>\n\taforesaid directions are subject to the right of Respondent no.3- to<br \/>\n\tchallenge the order of the Collector before this Court and subject<br \/>\n\tto final outcome of such petition.\n<\/p>\n<p id=\"p_8\">4.\tWith<br \/>\n\tabove directions, petition stands disposed of. Direct service is<br \/>\n\tpermitted.\n<\/p>\n<p id=\"p_9\">Subsequently,<br \/>\n\trespondent has challenged very same order dated 27th<br \/>\n\tJuly, 2009 passed by District Collector by filing Special Civil<br \/>\n\tApplication No. 2044 of 2010 with Special Civil Application No. 2045<br \/>\n\tof 2010 to 2047 of 2010 wherein following order is passed by this<br \/>\n\tCourt on 26.2.2010:\n<\/p>\n<p id=\"p_10\"> 1.<br \/>\n\t\tBy way of this petition the petitioner has prayed to quash and set<br \/>\n\taside the impugned order dated 27.7.2009 passed by the District<br \/>\n\tCollector, Surat in purported exercise under Section 10(2) of the<br \/>\n\tGujarat Water and Gas Pipelines (Acquisition of Right of Users in<br \/>\n\t<a href=\"\/doc\/7832\/\" id=\"a_1\">Land) Act<\/a>, 2000 and further to stay the operation and implementation<br \/>\n\tof the impugned order dated 27.7.2009 till the final disposal of<br \/>\n\tthis petition.\n<\/p>\n<p id=\"p_11\">2.\tThe<br \/>\n\tbrief facts of the case are as under :-\n<\/p>\n<p id=\"p_12\">2.1\tBy<br \/>\n\tnotification dated 16.3.2006, Government had issued a notification<br \/>\n\tunder Section 6 of the  Gujarat Water and Gas Pipeline (Acquisition<br \/>\n\tof Right of User in <a href=\"\/doc\/7832\/\" id=\"a_1\">Land) Act<\/a>, 2000 for laying the gas pipelines.\n<\/p>\n<p id=\"p_13\">2.2\tOn<br \/>\n\t18.1.2007 the competent authority has passed an award for the crop<br \/>\n\tand tree for the lands of the land owners. The land owners preferred<br \/>\n\tan application\/ appeal under Section 10(2) of the Gujarat Water and<br \/>\n\tGas Pipelines (Acquisition of Right of User in <a href=\"\/doc\/7832\/\" id=\"a_2\">Land) Act<\/a>, 2000.  By<br \/>\n\torder dated 27.7.2009 the  Collector, Surat, rejected the said<br \/>\n\tapplication. Hence this petition.\n<\/p>\n<p id=\"p_14\">3.\tHeard<br \/>\n\tlearned advocates for the respective parties and perused the<br \/>\n\tdocuments on record.\n<\/p>\n<p id=\"p_15\">4.\tThe<br \/>\n\t Collector, Surat  had disposed of all the  appeals mainly on the<br \/>\n\tground that  the compensation be paid to the land owners by<br \/>\n\tconsidering the production of   crops and fruits<br \/>\n\tupto their maximum age. The amount of compensation is calculated by<br \/>\n\tapplying a multiplier of 15 for  mangoes. For trees other than the<br \/>\n\tmango trees, the multiplier applied is 10. Thus the compensation<br \/>\n\tamount for the trees of Mangoes, Jambudo, Jamfali, Gunda, Setur,<br \/>\n\tGorakambli and Ker is calculated and paid to the landowners.\n<\/p>\n<p id=\"p_16\">5.\tHowever,<br \/>\n\t what is required to be noted is that the issue involved in the<br \/>\n\tmatter is not a policy matter, but a commercial transaction,<br \/>\n\tTherefore, the  Tribunal is required to record finding on the actual<br \/>\n\tfacts and the disputes between the parties.\n<\/p>\n<p id=\"p_17\">6.\tIn<br \/>\n\tthe premises aforesaid the impugned judgment and awards are quashed<br \/>\n\tand set aside. The matters are remanded to the Tribunal for<br \/>\n\tconsideration afresh as stated hereinabove. The Tribunal shall hear<br \/>\n\tand dispose of the matters within four months from the date of<br \/>\n\treceipt of writ of this order.\n<\/p>\n<p id=\"p_18\">Thus,<br \/>\n\tmatter was remanded to District Collector, Surat and District<br \/>\n\tCollector, Surat has passed order on 21st July 2010 and<br \/>\n\tdirected respondents to work out compensation as per earlier order<br \/>\n\tdated 27th July, 2009 and pay compensation to present<br \/>\n\tpetitioner or person those who are affected because of utilization<br \/>\n\tof their land by respondents for installing pipelines.\n<\/p>\n<p id=\"p_19\">Now,<br \/>\n\tpetitioner is challenging order dated 21st July, 2010<br \/>\n\tafter remanding matter back to District Collector but earlier order<br \/>\n\twhich has been confirmed by District Collector, Surat dated 27th<br \/>\n\tJuly, 2009, at that relevant time, this order was not challenged by<br \/>\n\tpetitioner before this court. On the contrary, petition was<br \/>\n\tpreferred by petitioner for compliance of order passed by District<br \/>\n\tCollector, Surat dated 27th July, 2009, therefore, it is<br \/>\n\tsubmitted by learned Advocate Mr. Kapadia for petitioner that even<br \/>\n\tin order dated 21st July, 2010, compensation has not been<br \/>\n\tworked out by respondent District Collector, Surat and merely<br \/>\n\tearlier order dated 27th July 2009 has been confirmed<br \/>\n\tand, therefore, some suitable directions are required to be issued<br \/>\n\tto respondent authority.\n<\/p>\n<p id=\"p_20\">In<br \/>\n\tlight of this back ground, it is directed to District Collector,<br \/>\n\tSurat to work out compensation which is available to petitioner in<br \/>\n\tview of order dated 27th July, 2009 and whatever amount<br \/>\n\tof compensation is worked out, then, to direct respondent authority<br \/>\n\tto pay such amount of compensation immediately to petitioner. For<br \/>\n\tthat, necessary exercise is required to be carried out by District<br \/>\n\tCollector, Surat to work out compensation as per original order<br \/>\n\tdated 27th July, 2009 and thereafter, to issue necessary<br \/>\n\tdirection to respondent authority, so, whatever compensation is<br \/>\n\trequired to be paid by authority, same can be paid to petitioner<br \/>\n\timmediately.
