Heard learned counsel for the petitioner<\/p>\n<p>                   and the State.\n<\/p>\n<p id=\"p_1\">                            The    petitioner        being     the    husband          is<\/p>\n<p>                   languishing     in    custody      since    23.04.2010         in    a<\/p>\n<p>                   case under <a href=\"\/doc\/409589\/\" id=\"a_1\">Sections 304(B)<\/a>\/<a href=\"\/doc\/37788\/\" id=\"a_1\">34<\/a> of the I.P.C.<\/p>\n<p id=\"p_2\">                             After        investigation,             the         police<\/p>\n<p>                   submitted charge sheet under <a href=\"\/doc\/92983\/\" id=\"a_2\">Section 306<\/a> of the<\/p>\n<p>                   I.P.C.    but     subsequently       the     learned          C.J.M.<\/p>\n<p>                   differing with the police report took cognizance<\/p>\n<p>                   under <a href=\"\/doc\/409589\/\" id=\"a_3\">Sections 304<\/a>\/<a href=\"\/doc\/37788\/\" id=\"a_4\">34<\/a> of the I.P.C.<\/p>\n<p id=\"p_3\">                              Since the accusation under <a href=\"\/doc\/653797\/\" id=\"a_5\">Section 304B<\/a><\/p>\n<p>                   of the I.P.C. has been found false against the<\/p>\n<p>                   petitioner        during      investigation,            let      the<\/p>\n<p>                   petitioner above named be released on bail on<\/p>\n<p>                   furnishing      bail       bond    of      Rs.     10,000\/-(Ten<\/p>\n<p>                   Thousand) with two sureties of the like amount<\/p>\n<p>                   each to the satisfaction of the learned J.M. Ist<\/p>\n<p>                   Class, Motihari, East Champaran, in connection<\/p>\n<p>                   with    Trial   No.    3955   of    2010     arising      out       of<\/p>\n<p>                   Paharpur P.S.
