It was on 22.8.2001 that son of petitioner No. 1<br \/>\nand petitioner No. 2 were riding a motorcycle on Faiz<br \/>\nRoad, Karol Bagh, New Delhi. One Traffic Zonal Officer<br \/>\nASI Dharam Pal allegedly caught hold of the handle of<br \/>\nmotorcycle and also the hands of petitioner No. 2 and as<br \/>\na result, both riders fell down and sustained grievous<br \/>\ninjuries. They were admitted to Ram Manohar Lohia<br \/>\nHospital. While son of petitioner No. 1 succumbed to<br \/>\ninjuries, petitioner No. 2 survived. The brother of the<br \/>\ndeceased lodged complaints with Police Commissioner and<br \/>\nother authorities but no action was allegedly taken in<br \/>\nthe matter. On the contrary, FIR No. 199\/2001 was<br \/>\nregistered under <a href=\"\/doc\/1270101\/\" id=\"a_1\">Section 279<\/a>\/<a href=\"\/doc\/1569253\/\" id=\"a_1\">333<\/a> IPC at PS D.B.G. Road against two<br \/>\nriders.\n<\/p>\n<p id=\"p_2\"> 2. Petitioners&#8217; grievance is that even as their<br \/>\ncomplaint for registration of FIR against Traffic<br \/>\nOfficer had gone abegging, SHO PS D.B.G. Road had<br \/>\nthreatened them to compromise the matter or face dire<br \/>\nconsequences. They were now being harassed and mentally<br \/>\ntortured by the police for pursuing their case. It is<br \/>\naccordingly prayed that SHO PS D.B.G. Road be directed to<br \/>\nregister a case of culpable homicide amounting to murder<br \/>\nagainst ASI Dharam Pal and counter FIR No. 199\/01 lodged<br \/>\non his complaint be quashed.\n<\/p>\n<p id=\"p_3\"> 3. Status report filed on behalf of respondent<br \/>\nsays that FIR No. 199\/01 was registered on the statement<br \/>\nof ASI Dharam Pal. Petitioners&#8217; complaints are admitted<br \/>\nto have been received and examined by the Public<br \/>\nGrievance Cell of Central District Police but found<br \/>\nwithout any substance. It is denied that the concerned<br \/>\nSHO had extended any threats to petitioners for any<br \/>\ncompromise.\n<\/p>\n<p id=\"p_4\"> 4. Petitioners have filed a rejoinder repelling<br \/>\nthe stand of respondent. They have also pleaded their<br \/>\nignorance about the inquiry by Public Grievance Cell and<br \/>\nhave reiterated their charge against the SHO concerned<br \/>\nof putting pressure on them for a compromise and<br \/>\nharassing them.\n<\/p>\n<p id=\"p_5\"> 5. It is a beaten track that if an information is<br \/>\nlaid before an officer or a police station, he is<br \/>\nsaddled with duty to enter it in the prescribed form and<br \/>\nregister a case and then to conduct an investigation<br \/>\ninto the allegations made. Though he can make some<br \/>\ninquiry as to the commission of a cognizable offence but<br \/>\nhe can&#8217;t examine the credibility, correctness or<br \/>\nreliability of the accusations made in the complaint.<br \/>\nso long as the complaint is not uncertain and it is not<br \/>\nentertaining any doubt on the commission of any<br \/>\ncognizable offence he has no option but to register the<br \/>\nFIR on the complaint where the facts narrated laid a<br \/>\nfoundation for making out a cognizable offence.\n<\/p>\n<p id=\"p_6\"> 6. In this conspectus it remained to be seen how<br \/>\npetitioners&#8217; complaint was handled and treated. There<br \/>\nis no dispute that it had charged ASI Dharam Pal of<br \/>\nbeing instrumental for the fall of two motor cycle<br \/>\nriders resulting i n death of one of them and grievous<br \/>\nhurt to the other. It could not, therefore, be said<br \/>\nthat the information put up before the concerned SHO<br \/>\nmade the commission of a cognizable offence doubtful or<br \/>\nthat it was vague or uncertain as to warrant no action<br \/>\nin the matter. Respondents&#8217; stand that petitioners&#8217;<br \/>\ncomplaint was examined by Public Grievance Cell and was<br \/>\nfound devoid of any substance is wholly misconceived and<br \/>\nirrelevant.\n<\/p>\n<p id=\"p_7\"> 7. It is not understandable how the inquiry by<br \/>\nthat Cell would justify the non-registration of a case<br \/>\non the petitioners&#8217; complaint which otherwise indicated<br \/>\ncommission of a cognizable offence irrespective of the<br \/>\ncorrectness of the accusations. Such an inquiry by any<br \/>\nforum of police, it must be under-scored, had no such<br \/>\nsanctity in the eyes of law. It indeed fell outside the<br \/>\nscope and scheme of Chapters XII and XIV of <a href=\"\/doc\/445276\/\" id=\"a_2\">Cr.P.C<\/a>.\n<\/p>\n<p id=\"p_8\"> 8. It requires to be made clear at this stage that<br \/>\na police officer was not competent to conduct any<br \/>\ninvestigation of sorts on the complaint or to refer it<br \/>\nto any forum for testing its veracity or correctness or<br \/>\nsubstance before entering it in prescribed form and<br \/>\nregistering a case. Or else, it would tantamount to<br \/>\nputting the cart before the horse, because the<br \/>\nregistration of FIR had to precede the investigation and<br \/>\nnot the vice versa.\n<\/p>\n<p id=\"p_9\"> 9. We feel convinced that concerned SHO had failed<br \/>\nin the discharge of his duties to register the FIR<br \/>\nagainst ASI Dharam Pal on petitioners&#8217; complaint. This,<br \/>\ntherefore, appears to us to be a fit case in which he<br \/>\nshould be directed to register a case under appropriate<br \/>\nsections of <a href=\"\/doc\/1569253\/\" id=\"a_3\">IPC<\/a>. The petitioners may file a fresh copy<br \/>\nof complaint before him if it was not borne by police<br \/>\nstation records. The concerned SHO is further directed<br \/>\nto hand over the record of this and also of rival FIR<br \/>\nNo. 199\/2001 to Joint Commissioner, in charge Crime Branch<br \/>\nof Delhi Police for further investigation which shall be<br \/>\nconcluded expeditiously in both FIRs under his personal<br \/>\nsupervision.\n<\/p>\n<p id=\"p_10\"> 10.
