GOVERNMENT\nPLEADER for Respondents \n=========================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMS.JUSTICE HARSHA DEVANI\n\t\t\n\t\n\t \n\t\t \n\t\t \n\t\t\t \n\nand\n\t\t\n\t\n\t \n\t\t \n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE H.B.ANTANI\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 26\/11\/2010 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p id=\"p_1\">(Per<br \/>\n: HONOURABLE MS.JUSTICE HARSHA DEVANI)<\/p>\n<p>Despite<br \/>\n\tthe fact that vide order dated 27th October, 2010, the<br \/>\n\trespondents were directed that on the next date of hearing, i.e.,<br \/>\n\t16th November, 2010, the decision of the State Level<br \/>\n\tCommittee shall be placed on record and that it was open for the<br \/>\n\trespondent authorities to file further affidavit on merits, if they<br \/>\n\tso desire, till date neither has the decision of the State Level<br \/>\n\tCommittee been placed on record, nor has any affidavit in reply been<br \/>\n\tfiled dealing with the petition on merits.\n<\/p>\n<p id=\"p_1\">The<br \/>\n\tlearned Assistant Government Pleader has, however, submitted that<br \/>\n\tthe decision of the State Level Committee was taken subsequently,<br \/>\n\thence, the same could not be placed on record at the relevant time<br \/>\n\tand that the respondents had thought it fit to file a reply on<br \/>\n\tmerits after the State Level Committee had taken its decision.  She,<br \/>\n\ttherefore, prays for further time to place the decision of the State<br \/>\n\tLevel Committee on record and to file affidavit in reply on merits.\n<\/p>\n<p id=\"p_2\">In<br \/>\n\tthe light of the request made by the learned Assistant Government<br \/>\n\tPleader, the respondents shall place on record the decision of the<br \/>\n\tState Level Committee at the earliest.  Affidavit in reply, if any,<br \/>\n\tshall be filed on or before 3rd December, 2010, failing<br \/>\n\twhich the Court may draw an inference that the respondents do not<br \/>\n\tcontrovert the averments made in the petition.
