Kaushik<\/p>\n<p>Respondents : Life Insurance Corporation of India<\/p>\n<p>    This matter came up for hearing on 21.05.2009 pursuant to<br \/>\nCommission&#8217;s notice dated 08.04.2009. Both parties were present.\n<\/p>\n<p id=\"p_2\">2.    It is seen from the RTI-application dated 29.05.2008 of the<br \/>\nappellant and the position vis-\u00e0-vis the requested information taken by<br \/>\nCPIO through his communication dated 14.07.2008 and the Appellate<br \/>\nAuthority&#8217;s decision dated 25.08.2008, that except information relating<br \/>\nto appellant&#8217;s queries at Sl.Nos.1 and 2 \u23af which was also earlier<br \/>\nprovided to his wife, Smt.Mithlesh Sharma in the context of her<br \/>\nsecond-appeal No.CIC\/AT\/A\/2008\/00618 \u23af respondents had not<br \/>\nprovided to the appellant any other information largely on the ground<br \/>\nof information being third-party information, personal to that party,<br \/>\nand citing the exemption under <a href=\"\/doc\/1838023\/\" id=\"a_1\">Section 8(1)(d)<\/a> of the RTI Act.\n<\/p>\n<p id=\"p_3\">3.    After hearing the submissions of both sides, the following<br \/>\ndecisions are given:-\n<\/p>\n<p id=\"p_4\">4.     As regards items A.1 and A.2, it is directed that the information<br \/>\nshall be provided to the appellant as requested. Time \u23af two weeks.\n<\/p>\n<p id=\"p_5\">5.    As regards items A.3, A.5 and A.7, it is noted that these relate to<br \/>\ninformation pertaining to investigative and disciplinary action taken<br \/>\nagainst certain other employees by the public authority. It is directed<br \/>\nthat these employees may be asked to express their consent for<br \/>\ndisclosure of the requested information to appellant (<a href=\"\/doc\/839514\/\" id=\"a_1\">Section 11(1)<\/a>).<br \/>\nA decision regarding whether or not to allow the appellant to inspect<br \/>\nthese files can be taken on consideration of the objection, if any,<br \/>\nreceived from the third-parties. Time \u23af four weeks.\n<\/p>\n<p id=\"p_6\">6.    As regards item A.6, the respondents informed that the<br \/>\nthird-party, Shri R.K.Saxena has since died.\n<\/p>\n<p id=\"p_7\">AT-27052009-03.doc<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                                              Page 1 of 2<\/span>\n<\/p>\n<p id=\"p_8\"> 7.    It is directed that the file relating to Shri Saxena and as<br \/>\nmentioned in appellant&#8217;s RTI-application may be allowed to be<br \/>\ninspected by the appellant within four weeks of the receipt of this<br \/>\norder on a day and time to be intimated to him in advance. Appellant<br \/>\nshall be allowed to take such copies including certified copies on<br \/>\npayment of such fees that may be determined by the CPIO.\n<\/p>\n<p id=\"p_9\">8.    As regards Part-B of appellant&#8217;s RTI-request, the respondents&#8217;<br \/>\nplea that the queries in this part of the appellant&#8217;s RTI-application<br \/>\nrelated to the public authority&#8217;s commercial information disclosing<br \/>\nwhich would impair its competitive position and thereby would attract<br \/>\nthe prohibition under <a href=\"\/doc\/1838023\/\" id=\"a_2\">Section 8(1)(d)<\/a> of the RTI Act is debatable. Most<br \/>\nof these queries only relate to Rules \/ Instructions and directions.\n<\/p>\n<p id=\"p_10\">9.    On the face of it, all information relating to instructions,<br \/>\ndirections, etc. should be disclosed and if a plea of commercial<br \/>\nconfidence under <a href=\"\/doc\/1838023\/\" id=\"a_3\">Section 8(1)(d)<\/a> is taken then a clear-cut and speaking<br \/>\norder should be passed as to how a requested information attracted<br \/>\nexemption. It is not open to the public authority or the CPIO or the<br \/>\nAppellate Authority to take omnibus plea of commercial confidence and<br \/>\nthereby dismiss an RTI-query.\n<\/p>\n<p id=\"p_11\">10. In view of the above, it is directed that the matter be remitted<br \/>\nback to the Appellate Authority &amp; Sr. Divisional Manager for him to<br \/>\ndecide the matter de-novo within four weeks of the receipt of this<br \/>\norder in respect of both Parts A and B of the appellant&#8217;s<br \/>\nRTI-application. In respect of Part-A, the directions given in paragraphs<br \/>\n4, 5 and 7 above should be followed by the Appellate Authority. The<br \/>\nmatters regarding Part-B should be decided by the Appellate Authority<br \/>\nafter duly considering each item of the query and examining the Rules<br \/>\nand Instructions thereof for the purpose of disclosure.\n<\/p>\n<p id=\"p_12\">11.   Appeal disposed of with these directions.\n<\/p>\n<p id=\"p_13\">12.
