GOVERNMENT PLEADER\nfor\nRespondents. \n=========================================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\n HONOURABLE\n\t\t\tMR.JUSTICE H.B.ANTANI\n\t\t\n\t\n\n \n\nDate\n: 07\/05\/2010 \n\n \n\n \n ORAL\nJUDGMENT<\/pre>\n<p id=\"p_1\">\tBy<br \/>\nfiling this writ petition under <a href=\"\/doc\/1331149\/\" id=\"a_1\">Article 227<\/a> of the Constitution of<br \/>\nIndia, the detenu has challenged the order of detention No.<br \/>\nPCB\/DTN\/PASA\/644\/2009 dated 13.10.2009 passed by the Commissioner of<br \/>\nPolice, Ahmedabad,  respondent No. 2, in exercise of powers under<br \/>\nsub-section (2) of section 3 of the Gujarat Prevention of Anti Social<br \/>\nActivities Act, 1985 [hereinafter referred to as the PASA Act]<br \/>\ndetaining the detenu as a bootlegger, as being illegal, invalid,<br \/>\narbitrary, void ab-initio and suffers from total non-application of<br \/>\nmind and also in violation of the provisions of Articles 14, 21 and<br \/>\n22 of the Constitution of India.\n<\/p>\n<p id=\"p_1\">\tLearned<br \/>\nadvocate for the petitioner, Mr. A.R. Shaikh submitted that the<br \/>\ngrounds of detention do not indicate any satisfaction recorded by the<br \/>\ndetaining authority that the activities of the detenu are detrimental<br \/>\nto  public order , and, therefore, the detention order is bad and<br \/>\nillegal. He further submitted that on behalf of the detenu, a<br \/>\nrepresentation dated 21.12.2009 was made, but the same has not been<br \/>\nconsidered either by the detaining authority or by the State<br \/>\nGovernment and therefore the continued detention of the detenu is bad<br \/>\nin law.\n<\/p>\n<p id=\"p_2\">\tMs.\n<\/p>\n<p id=\"p_3\">Mini Nair, learned AGP submitted that the detention order is just and<br \/>\nproper and detaining authority has passed the order after considering<br \/>\nall relevant aspects of the matter, and the same needs no<br \/>\ninterference.\n<\/p>\n<p id=\"p_4\">\tHeard<br \/>\nlearned counsel appearing for both the sides. I have also perused the<br \/>\nrecords available in the compilation.\n<\/p>\n<p id=\"p_5\">\tIt<br \/>\nappears that on the basis of a solitary case, viz. D.C.B. Police<br \/>\nStation Prohibition C.R. No. 5023 of 2009 dated 08.10.2009 for 85<br \/>\nbottles of foreign liquor against the detenu, the detaining authority<br \/>\nheld that the said activities of selling  liquor of the present<br \/>\ndetenu were harmful to the health of the public, and to restrain from<br \/>\ncarrying further illegal activities, the detenu has been detained.\n<\/p>\n<p id=\"p_6\">\tOn<br \/>\nbehalf of the detenu, a representation dated 21.12.2009 was made to<br \/>\nthe detaining authority. Copy of the same is produced at Annexure<br \/>\n&#8216;D&#8217;, pages 19-21 of the present compilation. In paragraph 12 of the<br \/>\naffidavit in reply filed by the detaining authority, it is stated<br \/>\nthat through the representation was received on 23.12.2009, as the<br \/>\norder of detention was already approved by the State Government on<br \/>\n16.10.2009, the representation was forwarded to the State Government<br \/>\nand to the Advisory Board. The State has not filed any reply<br \/>\nclarifying whether the representation was considered by it or not. It<br \/>\nthus appears that the representation made by the detenu is not<br \/>\nconsidered by either the detaining authority or the State.\n<\/p>\n<p id=\"p_7\">\tThat<br \/>\napart, except the statements of some anonymous witnesses, there is no<br \/>\nmaterial on record which shows that the detenu is carrying on<br \/>\nactivities of selling liquor which is harmful to the health of the<br \/>\npublic.  In the case of Collector and  DIST. MAGISTRATE V\/S. SULTAN<br \/>\n reported in AIR 2008 SC 2096 the Apex Court has distinguished<br \/>\nbetween  public order  and  law and order  and held that the<br \/>\ndistinction between the areas of &#8216;law and order&#8217; and &#8216;public order&#8217;<br \/>\nis one of the degree and extent of the reach of the act in question<br \/>\non society which would disturb the even tempo of life of the<br \/>\ncommunity and if the effect is confined only to a few individuals<br \/>\ndirectly involved as distinct from a wide spectrum of public, it<br \/>\ncould raise problem of law and order only.\n<\/p>\n<p id=\"p_8\">\tApplying<br \/>\nthe ratio of the above decision, it is clear that before passing an<br \/>\norder of detention of a detenu, the detaining authority must come to<br \/>\na definite finding that there is threat to the  public order  and<br \/>\nit is very clear that the present case would not fall within the<br \/>\ncategory of threat to  public order . Even the quantity involved<br \/>\nis small. In that view of the matter, when the order of detention has<br \/>\nbeen passed by the detaining authority without having adequate<br \/>\ngrounds for passing the said order, it cannot be sustained and,<br \/>\ntherefore, it deserves to be quashed and set aside.\n<\/p>\n<p id=\"p_9\">\tThe<br \/>\npetition is allowed. The impugned order of detention dated 13.10.2009<br \/>\npassed by the Commissioner of Police, Ahmedabad,  respondent No. 2<br \/>\nagainst  the detenu is hereby quashed and set  aside.   The detenu is<br \/>\nordered to be set at liberty forthwith,  if  not  required  in  any<br \/>\nother case.    Rule is made absolute accordingly.
