Kankarbagh, Distt- Patna, Bihar\n\nRespondent 1                         :       Public Information Officer,\n                                             Indira Gandhi National Open University\n                                             Maidan Garhi, New Delhi\n\nRespondent 2                         :       Dr. Ram Chandra\n                                             Regional Director\n                                             IGNOU Regional Centre\n                                             2nd Floor, BISCOMAUN Tower\n                                             West Gandhi Maidan,Patna- 800 001\n\nFacts<\/pre>\n<p id=\"p_1\"> arising from the Complaint:\n<\/p>\n<p id=\"p_1\">       Mr. Ramesh Kumar had filed a RTI application with the PIO at the Indira Gandhi<br \/>\nNational Open Univeristy, Maidan Garhi, New Delhi on 24\/01\/2009 asking for certain<br \/>\ninformation. Since no reply was received within the mandated time of 30 days, she had filed a<br \/>\ncomplaint under Section 18 to the Commission.\n<\/p>\n<p id=\"p_2\">        The Commission issued a notice to the PIO on 16\/04\/2009 asking him to supply the<br \/>\ninformation by 11\/05\/2009 and sought an explanation for not furnishing the information within<br \/>\nthe mandated time. The Respondent 1 has informed the Commission vide letter dated 14\/05\/2009<br \/>\nthat, &#8220;Sir, I would like to clarify that Student Evaluation Division had advised the IGNOU<br \/>\nRegional Director at Patna (who is also a PIO and dealing with the subject) on 18th March, 2009<br \/>\nto forward the requisite information to the complainant. A copy of this communication was sent<br \/>\nto the complainant also. It appears that, the Regional Director, Patna has not been able to do the<br \/>\nneedful within the mandated time.&#8221;\n<\/p>\n<p id=\"p_3\">Decision:\n<\/p>\n<p id=\"p_4\">The Complaint is allowed.\n<\/p>\n<p id=\"p_5\">        The issue before the Commission is of not supplying the complete, required<br \/>\ninformation by the PIO within 30 days as required by the law.<br \/>\nFrom the facts before the Commission it is apparent that the respondent2 is guilty of not<br \/>\nfurnishing information within the time specified under sub-section (1) of Section 7 by not<br \/>\nreplying within 30 days, as per the requirement of the <a href=\"\/doc\/671631\/\" id=\"a_1\">RTI Act<\/a>. It raises a reasonable doubt that<br \/>\n the denial of information may also be malafide.
