Side)\n\n* * * * *\n:ORDER\n<\/pre>\n<p id=\"p_1\">\tThis Criminal Revision Case is filed against the order passed by the<br \/>\nlearned Judicial Magistrate, Tenkasi dated 03.06.2008 in Crl.M.P.No.3771 of 2008<br \/>\nin C.C.No.433 of 2007, dismissing the discharge application filed by the<br \/>\npetitioner.\n<\/p>\n<p id=\"p_1\">\t2. The revision petitioner is the first accused in C.C.No.433 of 2007 on<br \/>\nthe file of the learned Judicial Magistrate, Tenkasi.\n<\/p>\n<p id=\"p_2\">\t3. The learned counsel appearing for the petitioner submits that<br \/>\noriginally in the First Information Report, this petitioner and 20 identifiable<br \/>\npersons were mentioned as accused, but now the final report is filed only<br \/>\nagainst this petitioner along with three other persons, as accused.  Though the<br \/>\nnames of this petitioner and three other persons were found in the First<br \/>\nInformation Report, no Test Identification Parade was conducted in respect of<br \/>\nother three accused persons and there was a delay of two days in preferring the<br \/>\nFirst Information Report.\n<\/p>\n<p id=\"p_3\">\t4. The learned counsel appearing for the petitioner further submits that<br \/>\nthere was some civil dispute and a suit was also filed by the second accused in<br \/>\nthis case against the first accused and one Ramalingam, who was the owner of the<br \/>\nland, but the said Ramalingam has not been examined by the Investigating<br \/>\nOfficer.\n<\/p>\n<p id=\"p_4\">\t5. This Court considers the submissions made by the learned counsel<br \/>\nappearing for the petitioner.  The points raised by the petitioner are not<br \/>\nsufficient for discharging him from the case in C.C.No.433 of 2007 on the file<br \/>\nof the learned Judicial Magistrate, Tenkasi.  These points may be considered<br \/>\nonly at the stage of trial.  The petitioner has not made out a case to discharge<br \/>\nhim from the said case.  On the other hand, on perusal of statements of<br \/>\nwitnesses, this Court concludes that a prima facie case is made out against the<br \/>\naccused.  Hence, this Criminal Revision Case is dismissed.
