No.4835 of 2008\n                     -------------------------------------\n            Dated this the 12th day of December, 2008\n\n                                  ORDER\n<\/pre>\n<p id=\"p_1\">      Petitioners along with co-accused face indictment in a<\/p>\n<p>prosecution for offences punishable, inter alia, under Section<\/p>\n<p>308 r\/w 149 <a href=\"\/doc\/1569253\/\" id=\"a_1\">I.P.C<\/a>. Investigation is complete. Final report has<\/p>\n<p>already been filed. Committal Proceedings has been registered.<\/p>\n<p>The petitioners were not arrested at the crime stage or<\/p>\n<p>thereafter.  Reckoning the petitioners as absconding accused,<\/p>\n<p>coercive processes have been issued against them.             They<\/p>\n<p>apprehend imminent arrest in execution of such processes.<\/p>\n<p id=\"p_1\">      2.    According to the petitioners, they are absolutely<\/p>\n<p>innocent. Their absence earlier was not wilful or deliberate. They<\/p>\n<p>are willing to surrender before the learned Magistrate and apply<\/p>\n<p>for bail. But they apprehend that their application for regular bail<\/p>\n<p>may not be considered by the learned Magistrate on merits, in<\/p>\n<p>accordance with law and expeditiously. It is therefore prayed that<\/p>\n<p>directions under <a href=\"\/doc\/1679850\/\" id=\"a_1\">Section 482<\/a> Cr.P.C may be issued in favour of the<\/p>\n<p>petitioners.\n<\/p>\n<p id=\"p_2\"><span class=\"hidden_text\" id=\"span_1\">Crl.M.C. No.4835 of 2008         2<\/span><\/p>\n<p id=\"p_3\">      3.   It is for the petitioners to appear before the learned<\/p>\n<p>Magistrate    and   explain    to  the   learned   Magistrate   the<\/p>\n<p>circumstances under which they could not earlier appear before<\/p>\n<p>the learned Magistrate.    I have no reason to assume that the<\/p>\n<p>learned Magistrate would not consider such application on merits,<\/p>\n<p>in accordance with law and expeditiously. Every court must do<\/p>\n<p>the same.      No special or specific direction appears to be<\/p>\n<p>necessary. Sufficient general directions have already been issued<\/p>\n<p>in Alice George v. The Deputy Superintendent of Police<\/p>\n<p>[2003(1) KLT 339].\n<\/p>\n<p id=\"p_4\">      4.   This Crl.M.C is, in these circumstances, dismissed, but<\/p>\n<p>with the specific observation that if the petitioners appear before<\/p>\n<p>the learned Magistrate and apply for bail after giving sufficient<\/p>\n<p>prior notice to the Prosecutor in charge of the case, the learned<\/p>\n<p>Magistrate must proceed to pass appropriate orders on merits, in<\/p>\n<p>accordance with law, expeditiously &#8211; on the date of surrender<\/p>\n<p>itself and in the light of the decision in <a href=\"\/doc\/906272\/\" id=\"a_2\">Sukumari v. State of<\/p>\n<p>Kerala<\/a> [2001(1) K.L.T 22].\n<\/p>\n<p id=\"p_5\">      5.
