SATHASIVAM\n\nJUDGMENT:\n<\/pre>\n<p id=\"p_1\">J U D G M E N T<\/p>\n<p>CRIMINAL APPEAL NO 1463       OF 2007<br \/>\n(Arising out of SLP (Crl.) No.1287 of 2007)<\/p>\n<p>Dr. ARIJIT PASAYAT, J.\n<\/p>\n<p id=\"p_1\">1.\tLeave granted.\n<\/p>\n<p id=\"p_2\">2.\tThe challenge in this appeal is to the judgment of the<br \/>\nlearned Single Judge of Kerala High Court dismissing the<br \/>\nappeal filed by the appellant, while directing the acquittal of<br \/>\nthe co-accused. Both the accused were convicted by the<br \/>\nlearned IInd Additional Assistant Sessions Judge, Thrissur for<br \/>\noffences punishable under Sections 366A and 376 read with<br \/>\n<a href=\"\/doc\/37788\/\" id=\"a_1\">Section 34<\/a> of the Indian Penal Code, 1860 (in short &#8216;<a href=\"\/doc\/1569253\/\" id=\"a_1\">IPC<\/a>&#8216;).\n<\/p>\n<p id=\"p_3\">3.\tCustodial sentence of two years and fine of Rs.10,000\/-<br \/>\nwith default stipulation, sentences of three years and fine of<br \/>\nRs.3,000\/-were with default stipulation for the offences<br \/>\npunishable under <a href=\"\/doc\/1279834\/\" id=\"a_2\">Sections 376<\/a> and <a href=\"\/doc\/1559723\/\" id=\"a_3\">366A<\/a> read with <a href=\"\/doc\/37788\/\" id=\"a_4\">Section 34<\/a><br \/>\nIPC respectively.\n<\/p>\n<p id=\"p_4\">4.\tThe background facts, as projected by prosecution in<br \/>\nnutshell are as follows:\n<\/p>\n<p id=\"p_5\">On 18.10.1993 at 7.00 a.m. both the accused, in<br \/>\nfurtherance of their common intention of kidnapping, induced<br \/>\nand procured a minor teenage girl (P.W.2), who had not<br \/>\nattained the age of 14 and seduced her to have illicit<br \/>\nintercourse with the first accused and first accused took her to<br \/>\nMahadevapuram in Coimbatore District and committed rape<br \/>\nin the house of CW8 at Mahadevapuram. Since PW2 did not<br \/>\ncome back to her house, after making necessary enquiries,<br \/>\nPW1, father of PW2, went to Cheruthuruthy Police Station and<br \/>\nlodged first information statement and originally man-missing<br \/>\ncase was registered as Crime No.96 of 1993. The girl was not<br \/>\nfound out. Finally, a criminal M.C. was filed before the High<br \/>\nCourt and on the basis of the direction of the High Court, the<br \/>\nCircle Inspector of Police found out PW2 and subsequently<br \/>\narrested the accused, continued the investigation and charge<br \/>\nwas laid. The girl was produced before the Judicial First Class<br \/>\nMagistrate&#8217;s Court, Wadakkancherry on 30.11.1993 and it was<br \/>\nrecorded that she had stated to the Magistrate that she was<br \/>\nstudying in ninth standard and she was staying with her<br \/>\nfather. She was taken from the tuition center while she was<br \/>\ngoing to Akshaya Tuition Centre, Ceruthuruthy. She stated<br \/>\nthat she went with Iqbal, appellant and first accused, on her<br \/>\nown will to Coimbatore on 18.10.1993 from Akshaya Tuition<br \/>\nCentre.   They were friends. Friend of first accused, namely,<br \/>\nSasi was also with them. They changed the vehicles and finally<br \/>\nsecond accused, Sasi did not accompany them till Coimbatore.<br \/>\nShe also stated that she had intercourse with Iqbal, first<br \/>\naccused, at Coimbatore and not with any other persons, that<br \/>\nshe was aged thirteen years and six months at that time and<br \/>\nshe was with Iqbal till she was produced before the Court.<br \/>\nStatement under <a href=\"\/doc\/447673\/\" id=\"a_5\">Section 161<\/a> of the Code of Criminal<br \/>\nProcedure, 1973 (in short &#8216;<a href=\"\/doc\/445276\/\" id=\"a_6\">Cr.P.C<\/a>.&#8217;) given by her to the police<br \/>\nwas also more or less on the same lines. But, before the Court,<br \/>\nshe deposed in examination-in-Chief that she and her friend<br \/>\nPW4 went to the tuition center and an autorikshaw came<br \/>\nthere. From the autorikshaw, A2 Sasi and A1 Iqbal, got down<br \/>\nand A1 told her to get into the autorikshaw to tell something<br \/>\nand on his persuasion she got into the autorikshaw and both<br \/>\nof them took her to a place called Kolappully. Thereafter, A2<br \/>\nbrought a car and they went upto Palakkad and A2 Sasi left.<br \/>\nFrom there, they went to Coimbatore by bus. They took food<br \/>\nand A1 took her to a hotel and forced her for intercourse and<br \/>\nthereafter they went to cinema etc. Thereafter, they came to<br \/>\nthe house of CW8 and they were staying in that house. During<br \/>\ncross-examination main endeavour of the accused was to<br \/>\nshow that she came with him on her own will. Letters written<br \/>\nby PW2, Exts. D1 to D3, were also produced and marked to<br \/>\nshow that PW2 and A1 were in love and that was not allowed<br \/>\nby the parents. Further, in cross examination, he asked<br \/>\nspecifically whether she agreed for intercourse willingly to<br \/>\nshow that intercourse was committed with consent. Evidence<br \/>\nof PW4 also supports the evidence of PW2. Evidence of PWs 8<br \/>\nand 9 doctors show that she had intercourse. Evidence shows<br \/>\nthat she went with her own will and intercourse also was done<br \/>\nvoluntarily and not by force. It is clear from the evidence that<br \/>\nthey were in love and wanted to marry, but parents of PW2<br \/>\nobjected. Hence, they together eloped and there is no<br \/>\nkidnapping. School certificate as well as the deposition of<br \/>\nfather of PW2 shows that she was aged only 13 years and nine<br \/>\nmonths at the time of incident. Hence, consent cannot be<br \/>\ntaken as valid.\n<\/p>\n<p id=\"p_6\">5.\tPlacing reliance on evidence of PW2, who is the victim,<br \/>\nthe learned Trial Court found both the accused persons guilty<br \/>\nand sentenced them as aforesaid. In appeal, the High Court by<br \/>\nthe impugned judgment, noted that the charges have been<br \/>\nestablished so far as the appellant is concerned, while<br \/>\ndirecting the co-acquittal of the co-accused.\n<\/p>\n<p id=\"p_7\">6.\tIn support of the appeal, learned counsel for the<br \/>\nappellant submitted that the evidence of the victim PW2<br \/>\nclearly shows that she was in love with the appellant and had<br \/>\ngone with him on her own will. Letters (Ex. D1 to D3) clearly<br \/>\nestablished this fact. It was further submitted that the<br \/>\nevidence of PW2 indicated that though victim and appellant<br \/>\nwere in love, the parents objected to it. It is also pointed out<br \/>\nthat in the cross-examination she had admitted that she had<br \/>\nsexual intercourse with the appellant on her own free will and<br \/>\nconsent and there was no force used. The High Court,<br \/>\nhowever, found that girl victim was aged about 13 years and 9<br \/>\nmonths and, therefore, the consent was of no consequence so<br \/>\nfar as allegation of rape is concerned. The conviction as<br \/>\nrecorded by the Trial Court was affirmed. However, on special<br \/>\ncircumstances which had weighed, the High Court imposed<br \/>\nthe sentence below the prescribed minimum, reduced the<br \/>\nsentence to three years rigorous imprisonment and fine of<br \/>\nRs.10,000\/- in respect of the offence punishable under<br \/>\n<a href=\"\/doc\/1279834\/\" id=\"a_7\">Section 376<\/a> IPC. However, his conviction and sentence relating<br \/>\nto <a href=\"\/doc\/1559723\/\" id=\"a_8\">Section 366A<\/a> was affirmed. The sentences imposed were<br \/>\ndirected to run concurrently. As noted above, the stand of the<br \/>\nappellant was that there was no rape involved and in any view,<br \/>\n<a href=\"\/doc\/1559723\/\" id=\"a_9\">Section 366A<\/a> has no application.\n<\/p>\n<p id=\"p_8\">7.\tSo far as the legality of conviction for offence punishable<br \/>\nunder <a href=\"\/doc\/1279834\/\" id=\"a_10\">Section 376<\/a> IPC is concerned, <a href=\"\/doc\/623254\/\" id=\"a_11\">Section 375<\/a> IPC needs to<br \/>\nbe noted. The same reads as follows:\n<\/p>\n<p id=\"p_9\">375. Rape.- A man is said to commit &#8220;rape&#8221;\n<\/p>\n<p id=\"p_10\">who, except in the cases hereinafter excepted,<br \/>\nhas sexual intercourse with a woman under<br \/>\ncircumstances falling under any of the six<br \/>\nexceptions:-\n<\/p>\n<p id=\"p_11\">First  Against her will.\n<\/p>\n<p id=\"p_12\">Secondly- Without her consent.\n<\/p>\n<p id=\"p_13\">Thirdly- With her consent, when her consent<br \/>\nhas been obtained by putting her on any<br \/>\nperson in whom she is interested in fear of<br \/>\ndeath or of hurt.\n<\/p>\n<p id=\"p_14\">Fourthly &#8211; With her consent, when the man<br \/>\nknows he is not her husband, and that her<br \/>\nconsent is given because she believed that he<br \/>\nis another man to whom she is or believed<br \/>\nherself to be lawfully married.\n<\/p>\n<p id=\"p_15\">Fifthly  With her consent, when, at the time of<br \/>\ngiving such consent, by reason of<br \/>\nunsoundness of mind or intoxication or the<br \/>\nadministration by him personally or through<br \/>\nanother of any stupefying or unwholesome the<br \/>\nnature and consequences of that to which she<br \/>\ngives consent.\n<\/p>\n<p id=\"p_16\">Sixthly  with or without her consent, when<br \/>\nshe is under sixteen years of age. &#8221;\n<\/p>\n<p id=\"p_17\">8.\tClause &#8216;sixthly&#8217; clearly stipulates that sexual intercourse<br \/>\nwith a woman with her or without her consent when she is<br \/>\nunder 16 years of age, amounts to rape.  The evidence on<br \/>\nrecord clearly establishes that the victim was less than 16<br \/>\nyears of age and, therefore, the conviction for offences<br \/>\npunishable under <a href=\"\/doc\/1279834\/\" id=\"a_12\">Section 376<\/a> IPC cannot be faulted.\n<\/p>\n<p id=\"p_18\">9.\tThe residual question is of applicability of <a href=\"\/doc\/1559723\/\" id=\"a_13\">Section 366A<\/a><br \/>\nIPC. In order to attract <a href=\"\/doc\/1559723\/\" id=\"a_14\">Section 366A<\/a> IPC, essential ingredients<br \/>\nare (1) that the accused induced a girl; (2) that the person<br \/>\ninduced was a girl under the age of eighteen years; (3) that the<br \/>\naccused has induced her with intent that she may be or<br \/>\nknowing that it is likely that she will be forced or seduced to<br \/>\nillicit intercourse; (4) such intercourse must be with a person<br \/>\nother than the accused; (5) that the inducement caused the<br \/>\ngirl to go from any place or to do any act.\n<\/p>\n<p id=\"p_19\">10.\tIn the instant case, the admitted case of the prosecution<br \/>\nis that girl had left in the company of the accused of her own<br \/>\nwill and that she was not forced to sexual intercourse with any<br \/>\nperson other than the accused.  The admitted case is that she<br \/>\nhad sexual intercourse with the accused for which,<br \/>\nconsidering her age, conviction under <a href=\"\/doc\/1279834\/\" id=\"a_15\">Section 376<\/a> IPC has<br \/>\nbeen maintained. Since the essential ingredient that the<br \/>\nintercourse must be with a person other than the accused has<br \/>\nnot been established, <a href=\"\/doc\/1559723\/\" id=\"a_16\">Section 366A<\/a> has no application.\n<\/p>\n<p id=\"p_20\">11.\tIn the result, the conviction for offence punishable under<br \/>\n<a href=\"\/doc\/1559723\/\" id=\"a_17\">Section 366A<\/a> IPC is set aside while the conviction and<br \/>\nsentence imposed in respect of offence punishable under<br \/>\n<a href=\"\/doc\/1279834\/\" id=\"a_18\">Section 376<\/a> IPC is maintained.\n<\/p>\n<p id=\"p_21\">12.\tThe appeal is allowed to the aforesaid extent.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India Iqbal vs State Of Kerala on 24 October, 2007 Author: .
