No.34948 of 2010\n                       RASID ANSARI, SON OF AMIRUDDIN ANSARI\n                                           Versus\n                                    STATE OF BIHAR\n                                         -----------\n<\/pre>\n<p id=\"p_1\">2.   28.10.2010              Heard learned counsel for the petitioner, learned<\/p>\n<p>                  counsel for the Informant and the State.\n<\/p>\n<p id=\"p_1\">                             The petitioner seeks bail in a case instituted for the<\/p>\n<p>                  offence under <a href=\"\/doc\/1258372\/\" id=\"a_1\">Sections 147<\/a>, <a href=\"\/doc\/763672\/\" id=\"a_1\">148<\/a>, <a href=\"\/doc\/999134\/\" id=\"a_2\">149<\/a>, <a href=\"\/doc\/1599401\/\" id=\"a_3\">341<\/a>, <a href=\"\/doc\/1011035\/\" id=\"a_4\">323<\/a>, <a href=\"\/doc\/1133601\/\" id=\"a_5\">325<\/a>, <a href=\"\/doc\/1947545\/\" id=\"a_6\">448<\/a>, <a href=\"\/doc\/455468\/\" id=\"a_7\">307<\/a><\/p>\n<p>                  and <a href=\"\/doc\/1560742\/\" id=\"a_8\">302<\/a> of the Indian Penal Code.\n<\/p>\n<p id=\"p_2\">                             Considering that the parties are agnates and there is<\/p>\n<p>                  no specific overt act alleged against the petitioner, let the<\/p>\n<p>                  petitioner above named, be released on bail on furnishing bail<\/p>\n<p>                  bond of Rs. 5,000\/- (Five thousand) with two sureties of the like<\/p>\n<p>                  amount each or any other surety to be fixed by the court<\/p>\n<p>                  concerned to the satisfaction of Chief Judicial Magistrate,<\/p>\n<p>                  Kaimur at Bhabhua, in Ramgarh P.S. Case No. 61 of 2010<\/p>\n<p>                  subject to the following conditions: (i)That one of the bailors will<\/p>\n<p>                  be a close relative of the petitioner who will give an affidavit<\/p>\n<p>                  giving genealogy as to how he is related with the petitioner. The<\/p>\n<p>                  bailor will undertake to furnish information to the court about<\/p>\n<p>                  any change in address of the petitioner. (ii)That the affidavit<\/p>\n<p>                  shall clearly state that the petitioner is not an accused in any<\/p>\n<p>                  other case and if he is, he shall not be released on bail. (iii)That<\/p>\n<p>                  the bailor shall also state on affidavit that he will inform the court<\/p>\n<p>                  concerned if the petitioner is implicated in any other case of<\/p>\n<p>                  similar nature after his release in the present case and<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                             2<\/span><\/p>\n<p>        thereafter the court below will be at liberty to initiate the<\/p>\n<p>        proceeding for cancellation of bail on the ground of misuse.<\/p>\n<p id=\"p_3\">        (iv)That the petitioner will give an undertaking that he will<\/p>\n<p>        receive the police papers on the given date and be present on<\/p>\n<p>        date fixed for charge and if he fails to do so on two given dates<\/p>\n<p>        and delays the trial in any manner, his bail will be liable to be<\/p>\n<p>        cancelled for reasons of misuse.
