Justice K.M.JOSEPH\n\n Dated :18\/12\/2008\n\n O R D E R\n                                   K.M.JOSEPH, J.\n                        - - - - - - - - - - - - - - - - - - - - - - - - -\n                            WP.(C) No.37099 of 2008\n                        - - - - - - - - - - - - - - - - - - - - - - - - -\n                     Dated this the 18th day of December, 2008\n\n                                      JUDGMENT\n<\/pre>\n<p id=\"p_1\">             Petitioner challenges Ext.P7, which is an order passed by the<\/p>\n<p>appellate authority imposing condition of payment of 50%.<\/p>\n<p id=\"p_1\">             2. After having gone through the order, I cannot say that it is<\/p>\n<p>an unreasoned order and therefore falls foul of the decision of the Division<\/p>\n<p>Bench reported in Supreme <a href=\"\/doc\/1435812\/\" id=\"a_1\">Electrical Engineering (P) Ltd v.<\/p>\n<p>Commercial Tax Officer<\/a> (2008(3) K.L.T. 805). But learned counsel for the<\/p>\n<p>petitioner Sri. Mayankuttuy Mather points out that financial condition of the<\/p>\n<p>Company is very poor and he offers Bank Guarantee. But I cannot also<\/p>\n<p>overlook the fact that the Government cannot run on Bank Guarantees and it<\/p>\n<p>is an interim order, which is otherwise unexceptional.<\/p>\n<p id=\"p_2\">             2. But still, taking note of the condition projected by the<\/p>\n<p>learned counsel for the petitioner, it is ordered that if the petitioner pays<\/p>\n<p>25% of the amount and furnishes Bank Guarantee for the balance amount,<\/p>\n<p>there will be a stay till the disposal of the appeal. Petitioner is given ten<\/p>\n<p>days time to comply with the condition. After complying with the condition<\/p>\n<p>as aforesaid, the appeal will be taken up and disposed of within two months<\/p>\n<p>from the date of      compliance with the condition, after affording an<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">WPC.37099\/2008.                       2<\/span><\/p>\n<p>opportunity of hearing to the petitioner.\n<\/p>\n<p id=\"p_3\">            The writ petition is disposed of as above.\n<\/p>\n<p id=\"p_4\">\n<p id=\"p_5\">                                                  (K.M.
