Nanavaty, learned Additional Public Prosecutor, waives<br \/>\nservice of notice on behalf of respondent-State. With the consent of<br \/>\nthe parties rule is fixed forthwith.\n<\/p>\n<p id=\"p_2\">2.\tThe<br \/>\napplicants have approached this Court under <a href=\"\/doc\/1783708\/\" id=\"a_1\">Section 438<\/a> of Criminal<br \/>\nProcedure Code for seeking anticipatory bail in view of the fact that<br \/>\nthey have been named as accused in CR-I-No.27\/2010 registered with<br \/>\nSantrampur Police Station for offence punishable under <a href=\"\/doc\/92983\/\" id=\"a_1\">Sections 306<\/a><br \/>\nand <a href=\"\/doc\/112749\/\" id=\"a_2\">114<\/a> of the Indian Penal Code, wherein the complainant has made a<br \/>\nstatement that step-son of accused No.2 is said to have committed<br \/>\nsuicide on account of cruelty and torture meted out to him by the<br \/>\naccused Nos.1 and 2.\n<\/p>\n<p id=\"p_3\">3.\tThis<br \/>\nCourt is of the view that the complainant&#8217;s version deserves to be<br \/>\nviewed in a proper perspective as it would not be appropriate for<br \/>\nthis Court to elaborately dwell upon the fine aspects touching the<br \/>\nmatter of investigation and trial but suffice it, at this stage, to<br \/>\nsay that deceased boy was to appear in the repeat SSC examination<br \/>\nindicating that the boy was in fact studying. The factum of torture,<br \/>\nso as to invoke <a href=\"\/doc\/92983\/\" id=\"a_3\">Section 306<\/a> in such circumstances, will have to be<br \/>\nviewed in its proper perspective. The Court is, therefore, inclined<br \/>\nto exercise discretion in favour of his parents of whom one is a<br \/>\nstep-parent. In case they are arrested, they will be enlarged on bail<br \/>\non the appropriate terms and conditions.\n<\/p>\n<p id=\"p_4\">4.\tThe<br \/>\napplicants-accused moved the application being Criminal Misc.<br \/>\nApplication No. 369 of 2010 before the concerned Sessions Court,<br \/>\nwhich came to be rejected on 9.6.2010.\n<\/p>\n<p id=\"p_5\">5.\tThis<br \/>\nCourt has perused the FIR and role attributed to the present<br \/>\napplicants. Looking to the averments in the complaint and after<br \/>\nhearing learned counsel for the parties, this Court is of the<br \/>\nconsidered view that anticipatory bail deserves to be granted to the<br \/>\napplicants for the following reasons :\n<\/p>\n<p id=\"p_6\">(i)\tThe<br \/>\nrole attributed to the present applicants in the FIR itself deserves<br \/>\nto be taken into consideration for granting this application.\n<\/p>\n<p id=\"p_7\">(ii)\tThe<br \/>\ncounsel for the applicants has assured this Court that the applicants<br \/>\nwould cooperate in the investigation in case this application is<br \/>\ngranted.\n<\/p>\n<p id=\"p_8\">6.\tThis<br \/>\napplication therefore deserves to be allowed and is accordingly<br \/>\nallowed on the following conditions as under:\n<\/p>\n<p id=\"p_9\">\tThat<br \/>\nin the event of arrest of the applicants in connection with<br \/>\nCR-I-No.27\/2010 registered with Santrampur Police Station,<br \/>\nthey shall be released on anticipatory bail in respect of the<br \/>\noffences alleged against them in this application, on they executing<br \/>\na bond of Rs.5,000=00 (Rs. Five thousand only) each with one surety<br \/>\neach of the like amount, by the concerned Police Officer and on<br \/>\nconditions that they shall;\n<\/p>\n<p id=\"p_10\">(a)<br \/>\n remain present before the Trial Court regularly as and \twhen<br \/>\ndirected on the dates fixed;\n<\/p>\n<p id=\"p_11\">(b)<br \/>\n  appear before the concerned Police Station, on 24.6.2010 \tbetween<br \/>\n9.00 am and 2.00 p.m.<\/p>\n<p id=\"p_12\">(c)<br \/>\n make themselves available for interrogation by the police \tofficer<br \/>\nwhenever and wherever required;\n<\/p>\n<p id=\"p_13\">(d)<br \/>\n  not directly or indirectly make any inducement, threat or<br \/>\npromise to any person acquainted with the fact of the case so as to<br \/>\ndissuade him or her from disclosing such facts to the Court or to any<br \/>\npolice officer;\n<\/p>\n<p id=\"p_14\">(e)<br \/>\n\tnot to obstruct or hamper the police investigation and not to play<br \/>\n\tmischief with the evidence collected or yet to be collected by the<br \/>\n\tpolice;\n<\/p>\n<p id=\"p_15\">(f)<br \/>\n\tat the time of execution of bond, furnish the address to the<br \/>\n\tInvestigating Officer and the Court concerned and shall not change<br \/>\n\ttheir residence till the final disposal of the case or till further<br \/>\n\torders;\n<\/p>\n<p id=\"p_16\">(g)<br \/>\n\tnot leave Gujarat State without the prior permission of the Court<br \/>\n\tand, if having passport, shall deposit the same before the Trial<br \/>\n\tCourt within a week.\n<\/p>\n<p id=\"p_17\">7.\tIt<br \/>\nwould be open to the Investigating Officer to file an application for<br \/>\nremand, if he considers it proper and just, and the concerned<br \/>\nMagistrate would decide it on merits.\n<\/p>\n<p id=\"p_18\">8.\tThis<br \/>\norder will hold good if the applicants are arrested at anytime within<br \/>\n90 days from today. The order for release on bail will remain<br \/>\noperative only for a period of ten days from the date of their<br \/>\narrest. Thereafter, it will be open to the applicants to make a fresh<br \/>\napplication for being enlarged on bail in usual course which when it<br \/>\ncomes before the competent Court, will be disposed of in accordance<br \/>\nwith law, having regard to all the attending circumstances and the<br \/>\nmaterials available at the relevant time, un-influenced by the fact<br \/>\nthat anticipatory bail was granted.\n<\/p>\n<p id=\"p_19\">9.\tRule<br \/>\nmade absolute.
