Justice M.SASIDHARAN NAMBIAR\n\n Dated :16\/12\/2008\n\n O R D E R\n                  M.SASIDHARAN NAMBIAR, J.\n                     ...........................................\n                  CRL.R.P.NO. 3340 OF 2008\n                    ............................................\n     DATED THIS THE             16th DAY OF DECEMBER, 2008\n\n                                    ORDER\n<\/pre>\n<p id=\"p_1\">      Revision petitioner is the accused and first respondent, the<\/p>\n<p>complainant in C.C.178 of 2003 on the file of Additional chief Judicial<\/p>\n<p>Magistrate, Thalassery.          Revision petitioner was convicted and<\/p>\n<p>sentenced to simple imprisonment for three months and a fine of<\/p>\n<p>Rs.60,000\/- and in default, simple imprisonment for three months,<\/p>\n<p>with a direction to pay Rs.55,000\/- out of the fine realised to first<\/p>\n<p>respondent as compensation. Petitioner challenged the conviction<\/p>\n<p>before Sessions Court, Thalassery in Crl.A.486 of 2003. Learned<\/p>\n<p>Sessions Judge, on reappreciation of evidence, confirmed the<\/p>\n<p>conviction, but modified the substantive sentence to imprisonment till<\/p>\n<p>rising of court, maintaining the fine and direction to pay<\/p>\n<p>compensation. Revision petition is filed challenging the conviction<\/p>\n<p>and sentence.\n<\/p>\n<p id=\"p_1\">      2. Learned counsel appearing for revision petitioner was heard.<\/p>\n<p>Learned counsel argued that courts below did not properly appreciate<\/p>\n<p>the evidence and there is no evidence to prove that Ext.P1 cheque was<\/p>\n<p>issued by revision petitioner towards discharge of a legally<\/p>\n<p>recoverable debt or liability and therefore the conviction is not<\/p>\n<p>sustainable.\n<\/p>\n<p id=\"p_2\"><span class=\"hidden_text\" id=\"span_1\">CRRP 3340\/2008                      2<\/span><\/p>\n<p id=\"p_3\">      3. On hearing the learned counsel and going through the<\/p>\n<p>judgments of the courts below, I find no reason to interfere with the<\/p>\n<p>conviction or sentence. Courts below appreciated the evidence in the<\/p>\n<p>proper perspective and found that Ext. P1 cheque was issued towards<\/p>\n<p>discharge of Rs.50,000\/- which was received from first respondent<\/p>\n<p>earlier. Evidence also establish that cheque was dishonoured for want<\/p>\n<p>of sufficient funds and first respondent had complied with all the<\/p>\n<p>statutory formalities provided under <a href=\"\/doc\/1823824\/\" id=\"a_1\">Section 138<\/a> and <a href=\"\/doc\/595945\/\" id=\"a_1\">142<\/a> of N.I.Act.<\/p>\n<p>Conviction of revision petitioner for the offence under <a href=\"\/doc\/1823824\/\" id=\"a_2\">Section 138<\/a> of<\/p>\n<p>N.I.Act is perfectly legal.\n<\/p>\n<p id=\"p_4\">      4.   Then the only question is with regard to the sentence.<\/p>\n<p>Though learned Magistrate awarded a substantive sentence of simple<\/p>\n<p>imprisonment for three months, learned Sessions Judge reduced the<\/p>\n<p>same to imprisonment till       rising of court. Learned Magistrate<\/p>\n<p>awarded a fine of Rs.60,000\/- which was maintained by learned<\/p>\n<p>Sessions Judge. Ext.P1 cheque is for Rs.50,000\/- and was issued in<\/p>\n<p>2002. In such circumstances, I find no reason to interfere with the<\/p>\n<p>sentence also.\n<\/p>\n<p id=\"p_5\">      5. Revision petition is dismissed. Revision petitioner is granted<\/p>\n<p>two months time to pay the fine.
