CHAMAN RAI\n                                  Versus\n                             STATE OF BIHAR\n                                 -----------\n<\/pre>\n<p id=\"p_1\">05\/   17.01.2011           I.A. No. 22 of 2011<\/p>\n<p>                           Earlier Appellant No. 1 Pundeo Rai and Appellant<\/p>\n<p>                   No. 3 Chotan Rai were granted bail vide order dated<\/p>\n<p>                   10.5.2010 considering the contradictory evidence of the<\/p>\n<p>                   prosecution witnesses.\n<\/p>\n<p id=\"p_1\">                           Counsel for the appellants submits that in case of<\/p>\n<p>                   Appellant No. 2 Rajendra Rai and Appellant No. 4 Chaman<\/p>\n<p>                   Rai also similar contradiction is there so far evidence of<\/p>\n<p>                   prosecution witnesses are concerned. According to P.W. 1,<\/p>\n<p>                   Appellant No. 4 Chaman Rai was armed with lathi and<\/p>\n<p>                   Appellant No. 2 Rajendra Rai was armed with Chhura.<\/p>\n<p>                   According to other witnesses all were armed with Chhura.<\/p>\n<p>                   The opinion of doctor (P.W. 5) is also not fully corroborated<\/p>\n<p>                   to the evidence of prosecution witnesses.<\/p>\n<p id=\"p_2\">                           Considering these facts, prayer for bail on behalf of<\/p>\n<p>                   appellant no. 2 Rajendra Rai and appellant no. 4 Chaman<\/p>\n<p>                   Rai is also allowed.
