Along with<br \/>\nthe affidavit, there are annexures from R-1 to R-4 containing as many<br \/>\nas 14 pages.\n<\/p>\n<p id=\"p_2\">3.\tWhen it is<br \/>\nput to learned Advocate for the respondent as to what the respondent<br \/>\nis doing in life, he submitted that he is doing business.  When it is<br \/>\nfurther inquired as to what is the business, he submitted that I do<br \/>\nnot know as to what is the actual business of the respondent as he is<br \/>\ndoing 2 to 3 businesses, of which, which one is handled by the<br \/>\nrespondent he does not know.\n<\/p>\n<p id=\"p_3\">3.1\tWhen it is<br \/>\nfurther inquired as to what Mr.Shrenikbhai   brother of his wife<br \/>\napplicant is doing, he submitted that, I do now know.\n<\/p>\n<p id=\"p_4\">4.\tWithout<br \/>\nmentioning anything about aforesaid factual position, an affidavit is<br \/>\nfiled wherein it is stated that, &#8216;he has danger to his life in<br \/>\nNavsari&#8217;.  The learned Advocate for the applicant invited attention<br \/>\nof the Court to Annexure-R-2.  It is a communication from the<br \/>\nrespondent to the Mamlatdar, Navsari dated 30.01.2010.  On the face<br \/>\nof it, this communication is made with a view to see that in case any<br \/>\ntransfer application is filed in future, can be objected.\n<\/p>\n<p id=\"p_5\">4.1\tThe<br \/>\nrespondent coming from Ahmedabad with a &#8216;direct service&#8217; of the<br \/>\nprocess issued by the Family Court handed over the same to the<br \/>\nlearned Principal Civil Judge (S.D.), Navsari, who is turn asked the<br \/>\nBailiff of the Court to serve the said process to the wife<br \/>\napplicant herein at her residence.  It is stated in the said letter<br \/>\nthat, &#8216;after the process was served, Smt.Ritaben Ashvinbhai Gandhi<br \/>\nmother of the wife   applicant and Shri Shrenikbhai Ashvinbhai<br \/>\nGandhi   brother of the wife   applicant got excited and taking<br \/>\nthe process of the Court served by the Court officer in their hand,<br \/>\nthey threatened the respondent in a high tone&#8217;.  It is further stated<br \/>\nthat, my mother-in-law stated that,  I will see to it that you and<br \/>\nyour mother and all other family members are sent behind the bars or<br \/>\nelse my name is not Ritaben .  It is further stated that Shri<br \/>\nShrenikbhai   brother of my wife told me that,  I will see how<br \/>\nyou go out of Navsari alive .  This is nothing but a got up story.\n<\/p>\n<p id=\"p_6\">5.\tTaking into<br \/>\nconsideration the averments made in the application, affidavit filed<br \/>\nby the respondent and taking into consideration the falsehood<br \/>\ncontained in the affidavit, the application is allowed.  HMP No.77 of<br \/>\n2010 pending before the Family Court, Ahmedabad under <a href=\"\/doc\/1284729\/\" id=\"a_1\">Section 13(a)<\/a><br \/>\nof the Hindu Marriage Act, 1955 is transferred to the District Court,<br \/>\nNavsari.  Rule is made absolute.
