JAIN\n\nJUDGMENT:\n<\/pre>\n<p>J U D G M E N T<\/p>\n<p>CIVIL APPEAL  NO.     3203         OF 2007<br \/>\n(Arising out of SLP (C) No. 20247 of 2003) <\/p>\n<p>Dr. ARIJIT PASAYAT, J.\n<\/p>\n<p>1.\tLeave granted.\n<\/p>\n<p>2.\tChallenge in this appeal is to the judgment of a Division<br \/>\nBench of Orissa High Court upholding the view taken by the<br \/>\nOrissa Administrative Tribunal (in short the &#8216;Tribunal&#8217;).\n<\/p>\n<p>3.\tThe respondent No.1 had questioned the order of the<br \/>\nappellants reverting him to the former post of Senior Assistant<br \/>\nbecause of joining of one Antaryami Acharya, Section Officer<br \/>\nLevel-I after the expiry of his leave, before the Tribunal.\n<\/p>\n<p>4.\tThe Original Application was allowed by the Tribunal.<br \/>\nThe order of the Tribunal was questioned before the High<br \/>\nCourt which as noted above dismissed the same.\n<\/p>\n<p>5.\tLearned counsel for the appellants submitted that both<br \/>\nthe Tribunal and the High Court did not consider the basic<br \/>\nissues and erroneously proceeded to deal with a question of<br \/>\nreservation and the applicability of  Orissa Reservation of<br \/>\nVacancies Act, 1975  (in short the &#8216;ORV Act&#8217;) and Orissa<br \/>\nReservation of Vacancies Rules, 1975 (in short the &#8216;ORV<br \/>\nRules&#8217;). According to the appellants those questions were not<br \/>\nrelevant.\n<\/p>\n<p>6.\tLearned counsel for respondent No.1 submitted that<br \/>\nthough the Tribunal and the High Court referred to the ORV<br \/>\nAct and the ORV Rules, in reality they had no relevance, but<br \/>\nthe basic issues have not been addressed by the Tribunal and<br \/>\nthe High Court.\n<\/p>\n<p>7.\tThe Tribunal in para 9 of its order noted as follows:\n<\/p>\n<p>&#8220;The main issue to be decided is whether the<br \/>\napplicant was to be reverted to his former post<br \/>\nof Senior Assistant consequent on return of<br \/>\nAntaryami Acharya, Section Officer Level-I<br \/>\nafter expiry of his leave The learned Counsel<br \/>\nfor the applicant has contended that the<br \/>\npromotion of the applicant by annexure-4<br \/>\norder dated 16.4.1990 was not made against<br \/>\nany leave vacancy nor was there any<br \/>\nstipulation in the said order that the applicant<br \/>\nwould be reverted  to his former post<br \/>\nconsequent on the post\/vacancy ceasing to<br \/>\nexist&#8221;\n<\/p>\n<p>8.\tBut while deciding the application it held as follows:\n<\/p>\n<p>&#8220;12. Following the above dictum of the<br \/>\nSupreme Court, the reversion of the applicant<br \/>\nby annexure-5 order consequent on return<br \/>\nfrom leave of Antaryami Acharya is not<br \/>\nsustainable as it will cause depletion in the<br \/>\npercentage of S.C. candidates in the rank of<br \/>\nSection Officer Level-II.  Since Antaryami<br \/>\nAcharya is a general category candidate, the<br \/>\njunior most candidate belonging to that<br \/>\ncategory is to be reverted to make room for the<br \/>\ncandidate who faces reversion consequent on<br \/>\nexpiry of leave of Antaryami Acharya, Section<br \/>\nOfficer Level-I and not the applicant who is a<br \/>\nreserved category candidate. We, therefore, set<br \/>\naside annexure-5 order of reversion of the<br \/>\napplicant and direct that he be deemed to be<br \/>\ncontinuing in the post of Section Officer Level-<br \/>\nII and his differential salary from 1.6.1990 till<br \/>\ndate or till the date of his subsequent<br \/>\npromotion to the rank of Section Officer Level-<br \/>\nII  made in the meantime whichever is earlier,<br \/>\nbe drawn and paid to him within three months<br \/>\nfrom the date of receipt of a copy of this order.<br \/>\nAs regards annexure-6 order, since the<br \/>\npromotion was made on adhoc basis for 44<br \/>\ndays and the provisions of reservation are not<br \/>\napplicable to the same according to Section<br \/>\n3(g) of said Act, we make no comments on the<br \/>\nsame.&#8221;\n<\/p>\n<p>9.\tThe High Court also lost sight of the basic challenge and<br \/>\ndismissed the writ petition with the following observations:\n<\/p>\n<p>&#8220;4.\tThe question for determination is whether<br \/>\nin such a situation when a general category<br \/>\ncandidate returns from leave, reserved<br \/>\ncategory candidate whose promotion was not<br \/>\nmade against a leave vacancy should be<br \/>\nreverted. It is the case of opposite party No.1<br \/>\nthat there were several representations of<br \/>\nreserved category candidates in the rank of<br \/>\nSection Officer Level-II in the &#8211; Directorates of<br \/>\nAgriculture, Horticulture and Soil<br \/>\nConservation alleging violation of the<br \/>\nprovisions of Orissa Reservation of Vacancies<br \/>\nAct and non-maintenance of reservation roster.<br \/>\nAs the opposite party No.1 was promoted<br \/>\nagainst a reserved category post as per the<br \/>\nroster, his reversion to accommodate a general<br \/>\ncandidate cannot be sustained.  Therefore, the<br \/>\nTribunal rightly set aside the reversion and<br \/>\nrestored him to his previous post.&#8221;\n<\/p>\n<p>10.\tThough the Tribunal formulated the right issues, it gave<br \/>\na wrong answer without considering the basic issues involved.<br \/>\nThe High Court has also lost sight of the basic dispute and<br \/>\nhas made observations as quoted above. Above being the<br \/>\nposition, we set aside the order of the Tribunal and the High<br \/>\nCourt and remit the matter to the Tribunal to decide the<br \/>\nmatter afresh after considering the basic issues and the<br \/>\nrespective stand of the parties.\n<\/p>\n<p>11.\tThe appeal is allowed with no order as to costs.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India State Of Orissa And Anr vs Surendranath Mallick And Ors on 23 July, 2007 Author: .
