Learned advocate, Mr.L.M.Zala, who is<br \/>\n\tappearing on behalf of the respondent No.2-original complainant  has<br \/>\n\tsubmitted that  settlement took place between the complainant and<br \/>\n\tthe accused. The respondent No.2, who is personally present in<br \/>\n\tCourt, has been identified by the learned advocate, Mr.L.M.Zala. He<br \/>\n\thas submitted that the matter is settled between the parties and no<br \/>\n\the has no grievance against the present petitioner and hence,<br \/>\n\trequested the Court to quash the complaint.\n<\/p>\n<p id=\"p_4\">It<br \/>\n\tappears that the complaint was lodged by  one Hitendrasinh Zala<br \/>\n\tagainst the petitioner and another for the offences punishable under<br \/>\n\tSecs.406, 420, 467, 468, 471 and 120B of <a href=\"\/doc\/1569253\/\" id=\"a_1\">IPC<\/a> registered as<br \/>\n\tC.R.No.I-17 of 2011 before Sanand Police Station alleging inter alia<br \/>\n\tthat although he purchased the agricultural land from the petitioner<br \/>\n\tNo.2 before three years, certificate of he being a farmer could not<br \/>\n\tbe produced by him and therefore, entry could not be mutated in his<br \/>\n\tfavour. Taking advantage of this, said land was again sold to<br \/>\n\tanother person. For taking possession of the land in question,<br \/>\n\tscuffle took place between the petitioner&#8217;s security and respondent<br \/>\n\tNo.2. Hence, the complaint in question was filed by the respondent<br \/>\n\tNo.2 for the offences punishable under Secs.143,147, 148, 149,<br \/>\n\t506(2) of <a href=\"\/doc\/1569253\/\" id=\"a_1\">IPC<\/a> and Sec.25(1)(B)(a) of <a href=\"\/doc\/1934415\/\" id=\"a_2\">Arms Act<\/a>. It is to be noted<br \/>\n\tthat there was no allegation that by forging the signature,<br \/>\n\tdocuments were created. It is alleged that even though the suit land<br \/>\n\twas previously sold by a registered sale deed, second sale deed was<br \/>\n\texecuted by the petitioner in favour of another person. When first<br \/>\n\tsale deed was executed, purchaser of the suit was not a farmer and<br \/>\n\ttherefore, his name could not be mutated in the revenue record and<br \/>\n\tthereupon the accused  executed second sale deed in favour of the<br \/>\n\tfarmer.\n<\/p>\n<p id=\"p_5\">Settlement<br \/>\n\tpursis is also placed on record. As per the settlement terms, both<br \/>\n\tthe parties have acted upon. They have informed the Investigating<br \/>\n\tOfficer also.\n<\/p>\n<p id=\"p_6\">Reliance<br \/>\n\tis placed on a decision of the Hon&#8217;ble Apex Court in the case of<br \/>\n\t&#8220;<a href=\"\/doc\/393489\/\" id=\"a_3\">Nikhil Merchant v. C.B.I. and Anr<\/a>.&#8221; reported in AIR<br \/>\n\t2009 SUPREME COURT 428 wherein it has been held in para 24 as under:\n<\/p>\n<p id=\"p_7\">&#8220;24.\n<\/p>\n<p id=\"p_8\">\tOn an overall view of the facts as indicated hereinabove and keeping<br \/>\n\tin mind the decision of this Court in B. S. Joshi&#8217;s case (supra) and<br \/>\n\tthe compromise arrived at between the Company and the Bank as also<br \/>\n\tclause 11 of the consent terms filed in the suit filed by the Bank,<br \/>\n\twe are satisfied that this is a fit case where technicality should<br \/>\n\tnot be allowed to stand in the way in the quashing of the criminal<br \/>\n\tproceedings, since, in our view, the continuance of the same after<br \/>\n\tthe compromise arrived at between the parties would be a futile<br \/>\n\texercise.&#8221;\n<\/p>\n<p id=\"p_9\">Applying<br \/>\n\tthe above ratio to the facts of the present case, as compromise has<br \/>\n\tbeen arrived at between the parties and as the complainant does not<br \/>\n\thave any objection in quashing the complaint,  I am of the opinion<br \/>\n\tthat no useful purpose would be served by permitting the criminal<br \/>\n\tproceedings pending against the petitioners to continue. Hence, the<br \/>\n\tcomplaint in question is required to be quashed.\n<\/p>\n<p id=\"p_10\">It<br \/>\n\tis pertinent to note that  another criminal complaint being<br \/>\n\tC.R.No.I-17 of 2011 registered before Sanand Police Station<br \/>\n\tqua the petitioner and other person are quashed<br \/>\n\tby this Court vide order passed today in Cri.Misc.Appln.No.3896 of<br \/>\n\t2011. Hence also, present complaint is required to be quashed.\n<\/p>\n<p id=\"p_11\">In<br \/>\n\tview of the above, criminal complaint being C.R.No.I-40 of<br \/>\n\t2011 before Sanand Police Station and<br \/>\n\tthe proceedings thereunder are quashed. This Cri. Misc. Application<br \/>\n\tis accordingly allowed. Rule is made absolute.
