Therefore, same is quoted as under:\n<\/p>\n<p id=\"p_3\"> Ld.\n<\/p>\n<p id=\"p_4\">\t Advocate  Mr.   Anand   Yagnik   has appeared for  Shalin Mehta for<br \/>\n\t appellant. Mr. G.D. Bhatt  appeared for respondent Nos. 2 to 5.\n<\/p>\n<p id=\"p_5\">It<br \/>\n\thas been further stated that Mr.  Y.F. Mehta was earlier appearing<br \/>\n\tfor appellant.\n<\/p>\n<p id=\"p_6\">Mr.\n<\/p>\n<p id=\"p_7\">\t Anand  Yagnik  seeks  permission  to withdraw the F.A. No. 438\/95.<br \/>\n\tPermission  granted.  F.A. No.  438\/95 stands disposed of as<br \/>\n\twithdrawn with no order as to costs.\n<\/p>\n<p id=\"p_8\">Thus,<br \/>\n\tas per aforesaid order, learned advocate Mr. Anand Yagnik had<br \/>\n\tappeared for learned advocate Mr. Shalin N. Mehta for appellant and<br \/>\n\tlearned advocate Mr.Bhatt was appearing for respondent NO. 2 to 5.<br \/>\n\tAs per said order, earlier, learned Advocate Mr.<br \/>\n\t Y.F. Mehta was appearing for appellant. Learned Advocate Mr.Yagnik<br \/>\n\tsought permission to withdraw said appeal which was granted and<br \/>\n\taccordingly, said first appeal no. 438 of 1995 stood disposed of by<br \/>\n\tthis Court as withdrawn on 18.12.2000. Thereafter, one miscellaneous<br \/>\n\tcivil application no. 887 of 2001 was filed in first appeal no. 438<br \/>\n\tof 1995 by applicants wherein this court passed following order on<br \/>\n\t24.2.2005 :\n<\/p>\n<p id=\"p_9\"> Learned<br \/>\n\tadvocate  Shri M.B.  Gandhi appearing for the<br \/>\n\tapplicants has reiterated that he  has  not  got  any instructions<br \/>\n\tfrom his  client  or his briefing advocate  and, therefore, he is<br \/>\n\tunable to proceed further with  the  matter.\n<\/p>\n<p id=\"p_10\">In<br \/>\n\t the  circumstances,  the  application  stands  disposed of  for<br \/>\n\twant  of  non-prosecution.    Notice is discharged.\n<\/p>\n<p id=\"p_11\">Thus,<br \/>\n\tas per said order passed by this court on 24.2.2005 in Miscellaneous<br \/>\n\tCivil Application, it was reiterated by learned Advocate Mr. MB<br \/>\n\tGandhi for applicants that he has not got any instructions from his<br \/>\n\tclient or his briefing advocate and, therefore, he is unable to<br \/>\n\tproceed further with the matter and pursuant to said statement, said<br \/>\n\tapplication came to be disposed for want of<br \/>\n\tprosecution. Notice was discharged.  These two orders have remained<br \/>\n\tas it is. More than nine years have passed in respect of order dated<br \/>\n\t18th<br \/>\n\tDecember, 2000 and in respect to second order, more than four years<br \/>\n\thave gone and now present application is filed with delay of 1749<br \/>\n\tdays  with a prayer to condone such delay and to restore<br \/>\n\tMiscellaneous Civil Application No. 887 of 2001 in First Appeal No.<br \/>\n\t438 of 1995.\n<\/p>\n<p id=\"p_12\">In<br \/>\n\tview of this back ground, considering delay in preferring<br \/>\n\tapplication to set aside order of withdrawal passed by this court on<br \/>\n\t18th<br \/>\n\tDecember, 2000, even miscellaneous civil application no. 887 of 2001<br \/>\n\tremained pending before this court for about four years and then<br \/>\n\tapplicant is filing this application for restoration of said misc.<br \/>\n\tcivil application after a delay of four years. Ultimately, advocate<br \/>\n\tMr. Gandhi for present applicant pleaded no instructions from his<br \/>\n\tclients and therefore, said application came to be disposed of.<br \/>\n\tThereafter, four years passed. No steps taken by applicant and,<br \/>\n\ttherefore, in view of this back ground, it is very difficult for<br \/>\n\tapplicant to file such restoration after such a long delay.<br \/>\n\tTherefore, because of lethargic approach of applicant, if advocate<br \/>\n\thas committed mistake or not acted in interest of applicants, as per<br \/>\n\tstatement made by learned Advocate Mr.MA Parekh, then, remedy for<br \/>\n\tapplicant is to approach Bar Council of Gujarat by filing<br \/>\n\tappropriate application against such advocate, if so advised.<br \/>\n\tTherefore, according to my opinion, delay of 1749 days, in such<br \/>\n\tcircumstances, cannot be condoned. There is no sufficient cause<br \/>\n\tshown by applicant to satisfaction of this court and it has also not<br \/>\n\tbeen properly explained by applicant. No affidavit of either of<br \/>\n\tadvocate, Mr.Yagnik or Mr.Gandhi is filed along with this<br \/>\n\tapplication. So, in absence of such material, this application<br \/>\n\tcannot be granted by this court.
