BASANT, J.\n                           - - - - - - - - - - - - - - - - - - - -\n                          Crl.R.P.No.  1117  of   2006\n                           -  - - - -  - - - - - - - - - - - - - - -\n                    Dated this the 17th  day of   October, 2006\n\n\n                                       O R D E R\n<\/pre>\n<p id=\"p_1\">       This revision petition is directed against an appellate judgment<\/p>\n<p>in  an  appeal  preferred  by  an  accused   person   against   the  verdict  of<\/p>\n<p>guilty, conviction  and sentence in a prosecution under <a href=\"\/doc\/1823824\/\" id=\"a_1\">Section 138<\/a> of<\/p>\n<p>the N.I. Act.\n<\/p>\n<p id=\"p_1\">       2.  The petitioner is the complainant.  Concurrently the verdict<\/p>\n<p>of guilty and conviction have been upheld.  The trial court imposed a<\/p>\n<p>sentence of S.I. for a period  of three months and to pay the actual<\/p>\n<p>cheque   amount   of   Rs.   30,000\/-   as   compensation   and   in   default   to<\/p>\n<p>undergo S.I. for a period of one month.   The appellate court, taking<\/p>\n<p>into   account   the   fact   that   the   accused   is   a   woman,   modified   the<\/p>\n<p>sentence   imposed.     The  substantive  sentence   of   imprisonment     for<\/p>\n<p>three   months   was   reduced   to   S.I.   for   a   period   of   one   week.     The<\/p>\n<p>direction for payment of compensation and the default sentence were<\/p>\n<p>both upheld.\n<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">Crl.R.P.No.  1117  of   2006                 2<\/span><\/p>\n<p id=\"p_2\">       3.   The petitioner claims to be aggrieved by the appellate judgment<\/p>\n<p>modifying the sentence.  What is the grievance?  The contention is that the<\/p>\n<p>reduction   of   substantive   sentence   of   imprisonment   is   not   justified.     The<\/p>\n<p>mere fact that the accused is a woman should not have weighed with the<\/p>\n<p>court   to   so drastically reduce the substantive sentence of imprisonment.\n<\/p>\n<p id=\"p_3\">This is the short contention raised.\n<\/p>\n<p id=\"p_4\">       4.   I have already adverted to the principles governing imposition of<\/p>\n<p>sentence in a prosecution under <a href=\"\/doc\/1823824\/\" id=\"a_1\">Section 138<\/a> of the N.I. Act in the decision<\/p>\n<p>in  <a href=\"\/doc\/163658\/\" id=\"a_2\">Anilkumar    v.    Shammy<\/a>      (2002   (3)   KLT   852).       In   the   facts   and<\/p>\n<p>circumstances of the case, I   am not   persuaded to agree that indulgence<\/p>\n<p>shown by the court below is not warranted or justified in any view of the<\/p>\n<p>matter.\n<\/p>\n<p id=\"p_5\">       5.     The   learned   counsel   for     the   petitioner   submits   that   to   his<\/p>\n<p>knowledge    there  is no  revision  petition  filed by  the  accused  against  the<\/p>\n<p>impugned appellate judgment.  Certainly if the accused   comes before me<\/p>\n<p>and prays for further modification of the sentence, the court could certainly<\/p>\n<p>consider  whether any higher amount of compensation need be directed to<\/p>\n<p>be paid in favour of the petitioner.  Otherwise, the sentence imposed by the<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">Crl.R.P.No.  1117  of   2006            3<\/span><\/p>\n<p>appellate  court  does not  at all deserve  interference at the  instance  of the<\/p>\n<p>petitioner herein.\n<\/p>\n<p id=\"p_6\">      6.   This revision petition is, in these circumstances, dismissed  with<\/p>\n<p>the above observations.\n<\/p>\n<p id=\"p_7\">                                                   (R.
