RAMKUMAR, J.\n                   = = = = = = = = = = = = =\n                   Crl.M.C..No.1174 of 2010\n                  = = = = = = = = = = = = = =\n              Dated this the 11th day of June, 2010\n\n                             ORDER\n<\/pre>\n<p id=\"p_1\">      In this petition filed under <a href=\"\/doc\/1679850\/\" id=\"a_1\">Section 482<\/a> Cr.P.C, the<\/p>\n<p>petitioner   who   is   a   prosecution    witness   (CW12)    in<\/p>\n<p>C.C.No.941\/2009 on the file of the J.F.C.M, Ottappalam for<\/p>\n<p>offences punishable under <a href=\"\/doc\/1270101\/\" id=\"a_1\">Sections 279<\/a> and <a href=\"\/doc\/1371604\/\" id=\"a_2\">304A<\/a> IPC, seeks a<\/p>\n<p>direction to the Magistrate to exempt the petitioner from the list<\/p>\n<p>of witnesses on the ground that he is suffering from a grave<\/p>\n<p>illness &#8220;Adeno Carcinoma&#8221; and after undergoing a major surgery<\/p>\n<p>at Leelavathy Hospital, Mumbai he is unable to travel a long<\/p>\n<p>distance and undergo the stress and strain.        The petitioner<\/p>\n<p>retired from service on 28.2.2002 as a Joint R.T.O.<\/p>\n<p id=\"p_1\">      2.   This Court called for a report from the J.F.C.M,<\/p>\n<p>Ottapalam. The learned Magistrate as per letter dated 9.6.2010<\/p>\n<p>has stated that on 22.3.2010 the witnesses including the<\/p>\n<p>petitioner herein cited for the day were present and since the<\/p>\n<p>court was engaged in other matters all the witnesses were bound<\/p>\n<p>over to 3.6.2010.   The evidence for the prosecution is still not<\/p>\n<p>Crl. M.C. No.1174 of 2010<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                       2<\/span><\/p>\n<p>over and that no warrant has been issued to the petitioner.<\/p>\n<p id=\"p_2\">       3. It appears that the learned Magistrate is indulging in<\/p>\n<p>staggered recording of evidence and the consequence is that the<\/p>\n<p>petitioner is put to untold harship. The fact that no warrant has<\/p>\n<p>been issued against the petitioner is not a solace. Accordingly<\/p>\n<p>having regard to the morbid condition of the petitioner, his<\/p>\n<p>examination in the case is dispensed with and the M.V.I.<\/p>\n<p>certificate issued by the petitioner shall be proved through any<\/p>\n<p>other witness, who is able to identify the petitioner&#8217;s signature or<\/p>\n<p>handwriting.         The Asst.Public Prosecutor in charge of the case<\/p>\n<p>could have used his discretion and exempted the petitioner from<\/p>\n<p>examination.\n<\/p>\n<p id=\"p_3\">       This Crl.M.C is disposed of as above.\n<\/p>\n<p id=\"p_4\">Dated this the 11th day of June, 2010.\n<\/p>\n<p id=\"p_5\">\n<p id=\"p_6\">                                             V.
