P (C) No. 30026 of 2009\n              =-=-=-=-=-=-=-=-=--=-=-=-=-=-=-=-=-=\n                Dated this, the 23rd October, 2009.\n\n                          J U D G M E N T\n<\/pre>\n<p id=\"p_1\">      The petitioner is aggrieved by Ext. P3 assessment order<\/p>\n<p>assessing amounts due from the petitioner towards cess under the<\/p>\n<p>Building and <a href=\"\/doc\/611977\/\" id=\"a_1\">Other Construction Workers Welfare Cess Act<\/a>, 1996.<\/p>\n<p>However, the petitioner now confines his relief for a direction to the<\/p>\n<p>1st respondent to permit the petitioner to pay the amounts in<\/p>\n<p>instalments. This is opposed by the learned Government Pleader who<\/p>\n<p>appears for the respondents.\n<\/p>\n<p id=\"p_1\">      2. Having heard both sides, I dispose of this writ petition with a<\/p>\n<p>direction to the 1st respondent to permit the petitioner to pay the<\/p>\n<p>amounts demanded by Ext. P3 in 5 equal monthly instalmens starting<\/p>\n<p>from 2-11-2009. Subsequent instalments shall be paid on the first<\/p>\n<p>working day of every succeeding months. If the petitioner pays the<\/p>\n<p>instalments on the due dates without default, further coercive<\/p>\n<p>proceedings for recovery shall be kept in abeyance. However, if the<\/p>\n<p>petitioner commits default in payment of any one instalment, it would<\/p>\n<p>be open to the respondent to recover the entire amounts in lump sum<\/p>\n<p>in accordance with law.\n<\/p>\n<p id=\"p_2\">\n<p id=\"p_3\">                                       Sd\/-  S.
