JUDGMENT<\/p>\n

Milap Chand Jain, J.\n<\/p>\n

1. Heard learned Counsel for the petitioner.\n<\/p>\n

2. The petitioner has been convicted of the offence under Section 19 read with Section 54(a) of the Rajasthan Excise Act and sentenced to three months rigorous imprisonment and to pay a fine of Rs. 300\/- in default of payment of fine to further undergo one month’s simple imprisonment.\n<\/p>\n

3. The petitioner has undergone sentence of 19 days. More than 7 years have already passed. In view thereof it would be proper to reduce the sentence to the sentence already undergone.\n<\/p>\n

4. Accordingly this revision is partly allowed. The conviction of the petitioner is maintained and his sentence is reduced to the sentence already undergone by him. His sentence of fine is remitted.<\/p>\n","protected":false},"excerpt":{"rendered":"
