RAGHU MAHTO\n                               ALL S\/O HEERA MAHTO\n                                       Versus\n                              THE STATE OF BIHAR\n                                      -----------\n<\/pre>\n<p id=\"p_1\">4.   16.03.2011               Heard learned counsel for the petitioners<\/p>\n<p>                    and the state.\n<\/p>\n<p id=\"p_1\">                             The petitioners seek bail in a case instituted<\/p>\n<p>                    for the offence under Sections 15, 18, 8 (b) of the<\/p>\n<p>                    <a href=\"\/doc\/1727139\/\" id=\"a_1\">N.D.P.S. Act<\/a>.\n<\/p>\n<p id=\"p_2\">                             It has been submitted that there is no direct<\/p>\n<p>                    material that it is the petitioners who have planted the<\/p>\n<p>                    Poppy plant.\n<\/p>\n<p id=\"p_3\">                             Further submission is that the petitioners<\/p>\n<p>                    have no criminal antecedents.\n<\/p>\n<p id=\"p_4\">                             Considering the same, let the petitioners<\/p>\n<p>                    above named, be released on bail on furnishing bail<\/p>\n<p>                    bond of Rs. 5,000\/-(Five thousand) each with two<\/p>\n<p>                    sureties of the like amount each or any other surety to<\/p>\n<p>                    be fixed by the court concerned to the satisfaction of<\/p>\n<p>                    learned 1st Addl. Sessions Judge, Gaya in connection<\/p>\n<p>                    with N.D.P.S. Case No. 13\/2008, subject to the<\/p>\n<p>                    conditions, (i) That one of the bailor will be a close<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                              2<\/span><\/p>\n<p>         relative of the petitioners who will give an affidavit<\/p>\n<p>         giving genealogy as to how he is related with the<\/p>\n<p>         petitioners   and   the   other   bailors   shall   be   the<\/p>\n<p>         son\/brother    of   the   petitioners.   The   bailors   will<\/p>\n<p>         undertake to furnish information to the Court about<\/p>\n<p>         any change in address of the petitioners. (ii) That the<\/p>\n<p>         affidavit shall clearly state that the petitioners are not<\/p>\n<p>         an accused in any other case and, if they are, they<\/p>\n<p>         shall not be released on bail, (iii) That the bailors shall<\/p>\n<p>         also state on affidavit that he will inform the court<\/p>\n<p>         concerned if the petitioners are implicated in any other<\/p>\n<p>         case of similar nature after their release in the present<\/p>\n<p>         case and thereafter the court below will be at liberty to<\/p>\n<p>         initiate the proceeding for cancellation of bail on<\/p>\n<p>         ground of misuse, (iv) That the petitioners will be well<\/p>\n<p>         represented on each date if they fail to do so on two<\/p>\n<p>         consecutive dates, their bail will be liable to be<\/p>\n<p>         cancelled.\n<\/p>\n<p id=\"p_5\">\n<pre id=\"pre_1\">Fahad.
