Justice T.R.RAMACHANDRAN NAIR\n\n Dated :11\/03\/2009\n\n O R D E R\n                T.R.RAMACHANDRAN NAIR, J\n            --------------------------------------------------\n                W.P.(C) No. 3726 of 2009\n           ---------------------------------------------------\n           Dated this the 11th day of March, 2009\n\n                             JUDGMENT\n<\/pre>\n<p id=\"p_1\">      The petitioner was appointed under Rule 9(a)(i) of the KS<\/p>\n<p>&amp; SSR, as Hospital Attendant Grade II at the Taluk Head<\/p>\n<p>Quarters Hospital, Karunagappally, way back on 11.06.1999.<\/p>\n<p>She was appointed for a period of 180 days and on completion of<\/p>\n<p>179 days she was terminated. The petitioner had another spell<\/p>\n<p>of appointment as Hospital Attendant Grade II which was made<\/p>\n<p>by the Superintendent of Taluk Head Quarters, Karunagappally<\/p>\n<p>on the advice of the Block Panchayat on contract basis which<\/p>\n<p>was made through Employment Exchange.\n<\/p>\n<p id=\"p_1\">      2. The Government by Ext.P6 order dated 16.11.2007,<\/p>\n<p>conferred the benefit of regularisation for provisional employees<\/p>\n<p>in the cadre of Hospital Assistant Grade II, who were engaged<\/p>\n<p>through Employment Exchanges and were continuing on the<\/p>\n<p>basis of various judgments of this Court and the Apex Court. A<\/p>\n<p>list of such employees are appended by the said order. The<\/p>\n<p>petitioner is seeking a similar benefit. Going by Ext.P6, the<\/p>\n<p>benefit is conferred only on a class of employees who are<\/p>\n<p>appointed on provisional basis but have been allowed to<\/p>\n<p>wpc:3726 of 2009<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                               2<\/span><\/p>\n<p>continue on the basis of various judgments. Their total number is<\/p>\n<p id=\"p_2\">908. It is also stated that a Special Leave Application pending<\/p>\n<p>before the Apex Court in the matter will be withdrawn before<\/p>\n<p>regularising them. Obviously, the petitioner will not be eligible<\/p>\n<p>to get regularisation on the basis of Ext.P6, since she was not in<\/p>\n<p>service as on the date of order and there is no other judgment<\/p>\n<p>allowing her to continue. Hence no relief can be granted in this<\/p>\n<p>writ petition.\n<\/p>\n<p id=\"p_3\">      3. The learned counsel appearing for the petitioner<\/p>\n<p>submitted that petitioner has filed Ext.P5 representation before<\/p>\n<p>the first respondent for appropriate orders in the matter.
