It is the case of the appellant<br \/>\n\tthat on 14th December 1999, the appellant along with his<br \/>\n\tPeon visited the shop of respondent no.1-accused, wherein the<br \/>\n\trespondent no.1-accused was present and was doing business of milk.<br \/>\n\tThe appellant had purchased two bags of pasturised toned milk of<br \/>\n\t&#8216;Anupam Taza&#8217; brand after paying consideration. It is also the case<br \/>\n\tof the prosecution that after following due procedure of sealing,<br \/>\n\tthe sample was sent to the Public Health Laboratory of Ahmedabad<br \/>\n\tMunicipal Corporation for analysis. On examination, the Public<br \/>\n\tAnalyst found that the said sample was adulterated and not upto the<br \/>\n\tstandard as prescribed under the Rules. Therefore, after following<br \/>\n\tthe due procedure, complaint was filed against the respondent<br \/>\n\tno.1-accused in the Court of learned Metropolitan Magistrate,<br \/>\n\tAhmedabad.\n<\/p>\n<p id=\"p_2\">Thereafter<br \/>\n\tthe trial was conducted before the learned Magistrate. To prove the<br \/>\n\tcase of the prosecution, prosecution has produced oral as well as<br \/>\n\tdocumentary evidence. After considering the oral as well as<br \/>\n\tdocumentary evidence, the learned Magistrate has acquitted the<br \/>\n\trespondent no.1-accused from the charges alleged against him by the<br \/>\n\tjudgment and order of acquittal dated 29th August 2009.\n<\/p>\n<p id=\"p_3\">Being<br \/>\n\taggrieved and dissatisfied with the said judgment and order of<br \/>\n\tacquittal dated 29th August 2009 passed by the learned<br \/>\n\tMetropolitan Magistrate, Court No.8, Ahmedabad, in Criminal Case<br \/>\n\tNo.29 of 2001, the appellant-Food Inspector, has preferred the above<br \/>\n\tmentioned Criminal Appeal.\n<\/p>\n<p id=\"p_4\">I<br \/>\n\thave heard Ms.Shaili Kapadia, learned counsel appearing on behalf of<br \/>\n\tthe appellant and learned Additional Public Prosecutor. I have also<br \/>\n\tgone through the papers and the judgment and order passed by the<br \/>\n\tlearned Magistrate.\n<\/p>\n<p id=\"p_5\">Ms.Kapadia<br \/>\n\thas contended that the judgment and order of the learned Magistrate<br \/>\n\tis not proper, legal and it is erroneous. She has also argued that<br \/>\n\tthe learned Magistrate has not considered the evidence of the<br \/>\n\twitnesses. She has argued that the learned Magistrate has not<br \/>\n\tconsidered the fact that the Food Inspector has followed the proper<br \/>\n\tprocedure while collecting the sample, etc. are just and proper. The<br \/>\n\tsample was seized and sealed properly. Yet, the learned Magistrate<br \/>\n\thas not considered the evidence of prosecution. She, therefore,<br \/>\n\tcontended that the order of acquittal passed by the learned<br \/>\n\tMagistrate is without appreciating the facts and evidence on record<br \/>\n\tand is required to be quashed and set aside by this Hon&#8217;ble Court.\n<\/p>\n<p id=\"p_6\">It<br \/>\n\tis a settled legal position that in acquittal appeal, the Appellate<br \/>\n\tCourt is not required to re-write the judgment or to give fresh<br \/>\n\treasonings when the Appellate Court is in agreement with the reasons<br \/>\n\tassigned by the trial Court acquitting the accused. In the instant<br \/>\n\tcase, this Court is in full agreement with the reasons given and<br \/>\n\tfindings recorded by the trial Court while acquitting the<br \/>\n\trespondent-accused and adopting the said reasons and for the reasons<br \/>\n\taforesaid, in my view, the impugned judgment is just, legal and<br \/>\n\tproper and requires no interference by this Court. Hence, this<br \/>\n\tappeal requires to be dismissed.\n<\/p>\n<p id=\"p_7\">Even<br \/>\n\tin a recent decision of the Apex Court in the case of State<br \/>\n\tof Goa Vs. Sanjay Thakran &amp; Anr. Reported in (2007)3 SCC 75,<br \/>\n\tthe Court has reiterated the powers of the High Court in such cases.<br \/>\n\tIn para 16 of the said decision the Court has observed as under:\n<\/p>\n<p id=\"p_8\">\t 16.\tFrom<br \/>\n\tthe aforesaid decisions, it is apparent \tthat while exercising the<br \/>\n\tpowers in appeal against the order of acquittal, the Court of<br \/>\n\t\tappeal would not ordinarily interfere with the order of acquittal<br \/>\n\tunless the approach of the lower Court is vitiated by some manifest<br \/>\n\tillegality and the conclusion arrived at would not be arrived at by<br \/>\n\tany reasonable person and, therefore, the decision is to be<br \/>\n\tcharacterized as perverse. Merely because two views are possible,<br \/>\n\tthe Court of appeal would not take the view which would upset the<br \/>\n\tjudgment delivered by the Court below. However, the appellate court<br \/>\n\thas a power to review the evidence if it is of the view that the<br \/>\n\tconclusion arrived at by the Court below is perverse and the Court<br \/>\n\thas committed a manifest error of law and<br \/>\n\tignored the material  on record. A duty is cast upon the appellate<br \/>\n\tcourt, in such circumstances, to re-appreciate the evidence to<br \/>\n\tarrive to a just decision on the basis of material placed on record<br \/>\n\tto find out whether any of the accused is connected with the<br \/>\n\tcommission of the crime he is charged with.\n<\/p>\n<p id=\"p_9\">Similar<br \/>\n\tprinciple has been laid down by the Apex Court in the cases of State<br \/>\n\tof Uttar Pradesh Vs. Ram Veer Singh &amp; Ors, reported in 2007 AIR<br \/>\n\tSCW 5553<br \/>\n\tand in Girja<br \/>\n\tPrasad (Dead) by LRs Vs. state of MP, reported in 2007 AIR SCW 5589.<br \/>\n\tThus, the powers which this Court may exercise against an order of<br \/>\n\tacquittal are well settled.\n<\/p>\n<p id=\"p_10\">It<br \/>\n\tis also a settled legal position that in acquittal appeal, the<br \/>\n\tappellate court is not required to re-write the judgment or to give<br \/>\n\tfresh reasoning, when the reasons assigned by the Court below are<br \/>\n\tfound to be just and proper. Such principle is laid down by the Apex<br \/>\n\tCourt in the case of State<br \/>\n\tof Karnataka Vs. Hemareddy, reported in AIR 1981 SC 1417,<br \/>\n\twherein it is held as under:\n<\/p>\n<p id=\"p_11\">\t   &#8230;\n<\/p>\n<p id=\"p_12\">\tThis court has observed in Girija<br \/>\n\tNandini Devi Vs Bigendra Nandini Chaudhary (1967)1 SCR 93 : (AIR<br \/>\n\t1967 SC 1124)<br \/>\n\tthat it is not the duty of the appellate court when it agrees with<br \/>\n\tthe view of the trial court on the evidence to repeat the narration<br \/>\n\tof the evidence or to reiterate the reasons given by the trial court<br \/>\n\texpression of general<br \/>\n\tagreement with the reasons given by the Court the decision of which<br \/>\n\tis under appeal, will ordinarily suffice.\n<\/p>\n<p id=\"p_13\">Thus,<br \/>\n\tin case the Appellate Court agrees with the reasons and the opinion<br \/>\n\tgiven by the lower court, then the discussion of evidence is not<br \/>\n\tnecessary.\n<\/p>\n<p id=\"p_14\">I<br \/>\n\thave gone through<br \/>\n\tthe order of acquittal passed by the learned Magistrate. I have also<br \/>\n\tperused the oral as well as documentary evidence led before the<br \/>\n\ttrial Court and also considered the submissions made by learned<br \/>\n\tadvocates for the parties.\n<\/p>\n<p id=\"p_15\">The<br \/>\n\ttrial Court has, after appreciating the oral as well as documentary<br \/>\n\tevidence, found that complaint was filed after a period of 18 months<br \/>\n\tfrom the date of collecting the sample. It is also observed that the<br \/>\n\tprosecution has breached the mandatory provision of <a href=\"\/doc\/56546430\/\" id=\"a_2\">Section 13(2)<\/a> of<br \/>\n\tthe Act. Delay is also not sufficiently explained by the<br \/>\n\tprosecution. The trial Court has also observed that the prosecution<br \/>\n\thas not followed the mandatory provisions of <a href=\"\/doc\/169668608\/\" id=\"a_3\">Section 14<\/a> of the Act.<br \/>\n\tThus, when the prosecution has failed to prove the case against the<br \/>\n\trespondent no.1-accused beyond reasonable doubt, benefit of doubt<br \/>\n\tought to have been given to the respondent no.1-accused. The trial<br \/>\n\tCourt has also observed that there are serious lacuna in the oral as<br \/>\n\twell as documentary evidence of prosecution. Nothing is produced on<br \/>\n\trecord of this appeal to rebut the concrete findings of the Trial<br \/>\n\tCourt.\n<\/p>\n<p id=\"p_16\">Thus,<br \/>\n\tthe appellant could not bring home the charges against the<br \/>\n\trespondent no.1-accused in the present appeal. The prosecution has<br \/>\n\tmiserably failed to prove the case against the respondent<br \/>\n\tno.1-accused. Thus, from the evidence itself it is established that<br \/>\n\tthe prosecution has not proved its case beyond reasonable doubt.\n<\/p>\n<p id=\"p_17\">Ms.Kapadia,<br \/>\n\tlearned counsel for the appellant, is not in a position to show any<br \/>\n\tevidence to take a contrary view in the matter or that the approach<br \/>\n\tof the trial Court is vitiated by some manifest illegality or that<br \/>\n\tthe decision is perverse or that the trial Court has ignored the<br \/>\n\tmaterial evidence on record.\n<\/p>\n<p id=\"p_18\">In<br \/>\n\tabove view of the matter, I am of the considered opinion that the<br \/>\n\ttrial Court was completely justified in acquitting the respondent<br \/>\n\tno.1-accused of the charges levelled against him.\n<\/p>\n<p id=\"p_19\">I<br \/>\n\tfind that the findings recorded by the trial Court are absolutely<br \/>\n\tjust and proper and in recording the said findings, no illegality or<br \/>\n\tinfirmity has been committed by it.\n<\/p>\n<p id=\"p_20\">I<br \/>\n\tam, therefore, in complete agreement with the findings, ultimate<br \/>\n\tconclusion and the resultant order of acquittal recorded by the<br \/>\n\ttrial Court and hence find no reasons to interfere with the same.<br \/>\n\tHence the appeal is hereby summarily dismissed.<br \/>\n\tRecord and Proceedings to be sent back to the trial Court,<br \/>\n\tforthwith.  Bail bonds, if any, shall stands cancelled.\n<\/p>\n<p id=\"p_21\">(Z.\n<\/p>\n<p id=\"p_22\">K.
