Justice M.SASIDHARAN NAMBIAR\n\n Dated :30\/09\/2009\n\n O R D E R\n              M.SASIDHARAN NAMBIAR,J.\n           ===========================\n            CRL.M.C.No.3051       OF 2009\n           ===========================\n\n    Dated this the 30th day of September,2009\n\n                        ORDER\n<\/pre>\n<p id=\"p_1\">    Petitioners are the accused in Crime 494\/2009 of<\/p>\n<p>Mannuthy Police Station registered for the offences<\/p>\n<p>under sections 143,147,148,452,323,324,506(ii) 294(b)<\/p>\n<p>read with <a href=\"\/doc\/999134\/\" id=\"a_1\">section 149<\/a> of Indian Penal Code registered<\/p>\n<p>under Annexure A F.I.R.  The case was registered after<\/p>\n<p>recording the First Information Statement of second<\/p>\n<p>respondent the de facto complainant who is the injured<\/p>\n<p>in the case.   As per the First Information Statement<\/p>\n<p>the accused    in furtherance of their common object<\/p>\n<p>formed themselves into an unlawful assembly and on<\/p>\n<p>12.9.2009 at about 8 a.m trespassed into the shop room<\/p>\n<p>belonging to the second respondent, the brother of the<\/p>\n<p>first respondent and intimidated, threatened and caused<\/p>\n<p>hurt to the first respondent and also damaged the<\/p>\n<p>articles and glass of the hotel causing a loss of<\/p>\n<p>Rs.3000\/- and thereby committed the offence.      This<\/p>\n<p>petition is filed under <a href=\"\/doc\/1679850\/\" id=\"a_1\">section 482<\/a> of Code of Criminal<\/p>\n<p>Procedure to quash Annexure A F.I.R as well as the<\/p>\n<p>proceedings initiated thereunder contending that the<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">Crl.M.C.3051\/2009              2<\/span><\/p>\n<p>entire disputes with respondents 1 and 2 were amicably<\/p>\n<p>settled.\n<\/p>\n<p id=\"p_1\">      2.     Respondents 1 and 2 appeared through a counsel.<\/p>\n<p>They also filed separate affidavits stating that the entire<\/p>\n<p>disputes with the petitioners were amicably settled and<\/p>\n<p>they have no objection to quash the proceedings.<\/p>\n<p id=\"p_2\">      3.     Learned counsel appearing for the petitioners ,<\/p>\n<p>respondents 1 and 2 and learned Public Prosecutor were<\/p>\n<p>heard.\n<\/p>\n<p id=\"p_3\">      4.      Annexure-A  F.I.R with  the  First Information<\/p>\n<p>Statement establish that the offence alleged against the<\/p>\n<p>petitioners are purely personal in nature        as against<\/p>\n<p>respondents 1 and 2, the person to whom hurt was caused and<\/p>\n<p>the person whose hotel was damaged.     The affidavits filed<\/p>\n<p>by respondents 1 and 2 establish that there was an amicable<\/p>\n<p>settlement of all the disputes between the parties.       In<\/p>\n<p>such circumstances, as held by the Apex Court in <a href=\"\/doc\/1442974\/\" id=\"a_2\">Madan<\/p>\n<p>Mohan Abbot v. State of Punjab<\/a> (2008(3) KLT 19) it is not<\/p>\n<p>in the interest of justice to continue the prosecution.<\/p>\n<p>Interest of justice warrants to quash the proceedings.<\/p>\n<p id=\"p_4\">      Petition is allowed.
