BASANT, J.\n\n              -------------------------------------------------\n\n                     CRL.M.C.NO. 1672 OF 2007\n\n              -------------------------------------------------\n\n               Dated this the 11th  day of June, 2007\n\n\n\n                                  ORDER\n<\/pre>\n<p id=\"p_1\">      The   petitioner   had   filed   two   private   complaints   against<\/p>\n<p>two   different   individuals     both   making     allegations   under<\/p>\n<p>Sec.138 of the Negotiable Instruments Act  in both   cases.   In<\/p>\n<p>one,   the   accused   was   Bhanudas   &#8211;   the   2nd  respondent   herein.<\/p>\n<p>In the other, the accused was one Rajesh.\n<\/p>\n<p id=\"p_1\">\n<p id=\"p_2\">      2.       The   dispute   with   the   Rajesh   was   settled.       The<\/p>\n<p>petitioner filed an application for withdrawal of the case under<\/p>\n<p>Sec.257   of   the   <a href=\"\/doc\/445276\/\" id=\"a_1\">Cr.P.C<\/a>.       Both   cases   were   pending   before   the<\/p>\n<p>learned Chief Judicial Magistrate as M.Ps. as cognizance   had<\/p>\n<p>not   been   taken.       When   the   application   under   Sec.257   of   the<\/p>\n<p><a href=\"\/doc\/445276\/\" id=\"a_1\">Cr.P.C<\/a>.     was   filed,   the   Crl.M.P.   number   was   shown   wrongly.<\/p>\n<p>Crl.M.P.No.4293\/05   is really the number of the case in which<\/p>\n<p>Bhanudas &#8211;   the 2nd  respondent herein is the accused.     But in<\/p>\n<p>the   withdrawal   application   to   withdraw   the   case   against<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\"> CRL.M.C.NO. 1672 OF 2007  -: 2 :-<\/span><\/p>\n<p>Rajesh, the number was shown wrongly as Crl.M.C.No.4293\/05.<\/p>\n<p>The   learned   Chief   Judicial   Magistrate   granted   permission   for<\/p>\n<p>withdrawal   in   Crl.M.P.No.4293\/05.       That   was   the   case   against<\/p>\n<p>the   2nd  respondent   herein.     Thus,   the   2nd  respondent   herein<\/p>\n<p>received an unjustified dismissal of the complaint against him on<\/p>\n<p>account   of   the   wrong   quoting   of   the   Crl.M.P.   Number,     even<\/p>\n<p>though     the   name   of   the   accused   was   correctly   shown   in   such<\/p>\n<p>application.       The   petitioner   now   finds   himself   in   a   very<\/p>\n<p>unsatisfactory situation.    He has settled the dispute with Rajesh<\/p>\n<p>and filed an application for withdrawal.     He had not settled the<\/p>\n<p>dispute   with   Bhanudas.       Bhanudas   has   now   obtained   an<\/p>\n<p>acquittal.   It is submitted that later, the case against Rajesh has<\/p>\n<p>been closed and withdrawn.\n<\/p>\n<p id=\"p_3\">\n<p id=\"p_4\">      3.     So   the   resultant   incongruity   is   that   though   the   case<\/p>\n<p>against the  2nd  respondent has not been withdrawn, on account<\/p>\n<p>of   the   erroneous   number   shown,   the   case   against   the   2nd<\/p>\n<p>respondent   has   been   closed.       The   petitioner   has   come   to   this<\/p>\n<p>Court   with   a   prayer   that   such   anomaly\/incongruity   may   be<\/p>\n<p>redressed.\n<\/p>\n<p id=\"p_5\">\n<p id=\"p_6\">      4.     The 2nd  respondent has not so far appeared before the<\/p>\n<p>learned Chief Judicial Magistrate, it is submitted.  A report of the<\/p>\n<p>learned   Chief   Judicial   Magistrate   was   called   for.       The   report<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\"> CRL.M.C.NO. 1672 OF 2007  -: 3 :-<\/span><\/p>\n<p>confirms  the facts referred above.\n<\/p>\n<p id=\"p_7\">\n<p id=\"p_8\">        5.   The 2nd respondent has thus secured and the petitioner<\/p>\n<p>has   suffered   an   unjustified   termination   of   the   proceedings<\/p>\n<p>initiated against the 2nd  respondent as Crl.M.P.No.4293\/05.  The<\/p>\n<p>same   deserves   to   be   corrected   invoking   the   extraordinary<\/p>\n<p>inherent  jurisdiction  of  this   Court  under   Sec.482   of  the  <a href=\"\/doc\/445276\/\" id=\"a_2\">Cr.P.C<\/a>.<\/p>\n<p>Of course, the petitioner was also, in part, responsible in that he<\/p>\n<p>had   shown   the   incorrect   number   in   the   application   for<\/p>\n<p>withdrawal   under   Sec.257   of   the   <a href=\"\/doc\/445276\/\" id=\"a_3\">Cr.P.C<\/a>.       That   inadequacy<\/p>\n<p>notwithstanding, I am satisfied that the prayer can be allowed.<\/p>\n<p id=\"p_9\">        6.  In the result:\n<\/p>\n<p id=\"p_10\">\n<p id=\"p_11\">        (a) This  Crl.M.C. is allowed.\n<\/p>\n<p id=\"p_12\">\n<p id=\"p_13\">        (b)   The   impugned   order   in   Crl.M.P.No.4293\/05   (a   copy   of<\/p>\n<p>the order is produced as Annexure-D) is hereby set aside.<\/p>\n<p id=\"p_14\">        (c)  The learned Chief Judicial Magistrate shall now dispose<\/p>\n<p>of Crl.M.P.No.4293\/05 afresh in accordance with law.<\/p>\n<p id=\"p_15\">                                                                 Sd\/-\n<\/p>\n<p id=\"p_16\">                                                     (R.
