DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 21\/09\/2011 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p id=\"p_1\">Heard<br \/>\n\tthe learned advocates for the parties.\n<\/p>\n<p id=\"p_1\">Ms.\n<\/p>\n<p id=\"p_2\">\tJirga Jhaveri learned AGP for the respondent no. 2 places on record<br \/>\n\tthe affidavit-in-reply filed by the Under Secretary, Industries &amp;<br \/>\n\tMines Department, Government of Gujarat, on record, which referred<br \/>\n\tto a communication dated 8.10.1996 of Department of Industries &amp;<br \/>\n\tMines, Government of Gujarat to absorb employees of Undertaking of<br \/>\n\tState of Gujarat, namely, Gujarat State Textiles Corporation,<br \/>\n\tpursuant to the order dated 28.9.1996, passed by the High Court of<br \/>\n\tGujarat, and the resolution dated 27.11.1997 of Department of<br \/>\n\tFinance, Government of Gujarat, about the scheme of VRS framed for<br \/>\n\tthe employees\/officers of Government organizations\/semi-government<br \/>\n\torganizations. The above communication also referred to absorb such<br \/>\n\temployees who stood relieved on a closure of Corporation to be<br \/>\n\tabsorbed in various Boards, Corporations and Companies, on<br \/>\n\tsympathetic consideration.\n<\/p>\n<p id=\"p_3\">However,<br \/>\n\tvery affidavit referred to statement-A, B and D at Annexure-R-V and<br \/>\n\tStatement-A is pertaining to protection of pay of 34 employees of<br \/>\n\tGujarat State Textiles Corporation (now in liquidation). The<br \/>\n\tStatement-D again of the employees of the very Corporation (in<br \/>\n\tliquidation) and the pay protection given to 12 employees as per<br \/>\n\tGovernment Resolution dated 27.11.1997, but Statement-B enlist 32<br \/>\n\temployees who are deprived of pay protection, but remained to be<br \/>\n\terstwhile employees of Gujarat State Textiles Corporation (in<br \/>\n\tliquidation).\n<\/p>\n<p id=\"p_4\">Mr.\n<\/p>\n<p id=\"p_5\">\tPresh Upadhyaya learned advocate for the petitioners would submit<br \/>\n\tthat the stand of the officers of the Department of Industries, as<br \/>\n\treflected in the affidavit dated 20.9.2011, is diametrically opposed<br \/>\n\tand against the earlier recommendations of the then Principal<br \/>\n\tSecretary, Department of Industries and other communications annexed<br \/>\n\twith the petition. In view of the above, it is submitted that the<br \/>\n\tgroup of the employees\/petitioners herein are not only discriminated<br \/>\n\tbut treated unreasonably by depriving them of protection of their<br \/>\n\tpay conferred to similarly situated employees who were relieved from<br \/>\n\terstwhile Gujarat State Textiles Corporation (in liquidation). It is<br \/>\n\tfurther submitted that inspite of specific order dated 20.4.2011 and<br \/>\n\topportunity was granted to respondent no. 1 to file<br \/>\n\taffidavit-in-reply on or before 4.5.2011, but no affidavit is filed.\n<\/p>\n<p id=\"p_6\">At<br \/>\n\tthis stage, learned AGP, however, requests to afford one more<br \/>\n\topportunity to concerned respondent no. 1 to explain and answer the<br \/>\n\tsubmissions of learned advocate for the petitioners. Prima-facie,<br \/>\n\tthe group of employees\/petitioners though similarly situated to the<br \/>\n\temployees whose names appeared in Statement-A &amp; B at<br \/>\n\tAnnexure-R-V to the affidavit-in-reply dated 20.9.2011, who are<br \/>\n\tconferred pay protection and the petitioners who are similarly<br \/>\n\tsituated employees have been deprived of the benefit of pay<br \/>\n\tprotection.
