SANKARAN, J.\n                     ---------------------------\n                      B.A. No. 6930 of 2009\n                 ------------------------------------\n              Dated this the 14th day of January, 2010\n\n                             O R D E R\n<\/pre>\n<p id=\"p_1\">      This is an application for anticipatory bail under <a href=\"\/doc\/1783708\/\" id=\"a_1\">Section 438<\/a><\/p>\n<p>of the Code of Criminal Procedure. The petitioners are accused<\/p>\n<p>Nos. 1 and 2 Crime No.596\/2009 of Mannuthy Police Station,<\/p>\n<p>Thrissur.\n<\/p>\n<p id=\"p_1\">      2.    The offences alleged against the petitioners are under<\/p>\n<p><a href=\"\/doc\/1289794\/\" id=\"a_1\">Sections 452<\/a> and <a href=\"\/doc\/267625\/\" id=\"a_2\">324<\/a> read with <a href=\"\/doc\/37788\/\" id=\"a_3\">Section 34<\/a> of the Indian Penal<\/p>\n<p>Code and <a href=\"\/doc\/244673\/\" id=\"a_4\">Section 27<\/a> of the Arms Act.\n<\/p>\n<p id=\"p_2\">      3.    The prosecution case is that on 18\/10\/2009, the<\/p>\n<p>accused persons trespassed into the house of the de facto<\/p>\n<p>complainant and attacked his daughter aged 6 = years with an<\/p>\n<p>iron rod and she sustained injuries on her face.<\/p>\n<p id=\"p_3\">      4.    In the F.I. Statement, it is stated that the accused<\/p>\n<p>persons were following Shaju, the brother of the de facto<\/p>\n<p>complainant in order to attack him with an iron rod and sword.<\/p>\n<p>Shaju escaped and came running to the house of the de facto<\/p>\n<p>complainant. He closed the grill and escaped. The accused<\/p>\n<p>persons came to the compound of the de facto complainant. The<\/p>\n<p>B.A. No. 6930\/2009<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                  2<\/span><\/p>\n<p>daughter of the de facto complainant was sitting in the Varanda<\/p>\n<p>and reading. At that time, she was attacked by the accused. The<\/p>\n<p>girl became unconscious. She was taken to the hospital.<\/p>\n<p id=\"p_4\">      5.     The learned counsel for the petitioners submitted that<\/p>\n<p>the first petitioner had sustained serious injuries on his head and<\/p>\n<p>that the police did not register a case against the assailant,<\/p>\n<p>namely, the brother of the de facto complainant. On the other<\/p>\n<p>hand, the police wanted to arrest the petitioners. The case is a<\/p>\n<p>foisted one. There was no intention to cause any injury to the<\/p>\n<p>daughter of the de facto complainant and therefore, if at all the<\/p>\n<p>allegations are found to be true, no offence as alleged would lie<\/p>\n<p>against the petitioners.\n<\/p>\n<p id=\"p_5\">      6.     I have gone through the Case Diary. Prima facie, there<\/p>\n<p>are materials to indicate that the petitioners committed criminal<\/p>\n<p>trespass and caused injuries to the daughter of the de facto<\/p>\n<p>complainant. The rival contentions of the parties are to5 be<\/p>\n<p>considered at the time of trial. At the time of disposal of the Bail<\/p>\n<p>Application, all these contentions need not be considered.<\/p>\n<p id=\"p_6\">      7.     Taking into account the facts and circumstances of the<\/p>\n<p>B.A. No. 6930\/2009<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                  3<\/span><\/p>\n<p>case, the nature and gravity of the offence and the allegations<\/p>\n<p>levelled against the petitioners, I do not think that this is a fit<\/p>\n<p>case where anticipatory bail can be granted to the petitioners. If<\/p>\n<p>anticipatory bail is granted to the petitioners, it would adversely<\/p>\n<p>affect the proper investigation of the case.<\/p>\n<p id=\"p_7\">      The Bail Application is accordingly dismissed.<\/p>\n<p id=\"p_8\">                                   K.T.
