Justice M.SASIDHARAN NAMBIAR\n\n Dated :09\/12\/2010\n\n O R D E R\n               M.Sasidharan Nambiar, J.\n              --------------------------\n                Crl.M.C.No.4819 of 2010\n              --------------------------\n\n                         ORDER\n<\/pre>\n<p id=\"p_1\">    Petitioners are the accused and first respondent,<\/p>\n<p>the defacto complainant in C.C.No.448\/2010 on the file<\/p>\n<p>of   Judicial   First    Class   Magistrate&#8217;s    Court,<\/p>\n<p>Kunnamangalam, taken cognizance for the offences under<\/p>\n<p>Sections 406 and 420 read with <a href=\"\/doc\/37788\/\" id=\"a_1\">Section 34<\/a> of Indian<\/p>\n<p>Penal Code on Annexure-A4 final report. This petition<\/p>\n<p>is  filed  under  <a href=\"\/doc\/1679850\/\" id=\"a_1\">Section  482<\/a>  of   Code  of  Criminal<\/p>\n<p>Procedure to quash the proceedings contending that<\/p>\n<p>ingredients of the offences are not attracted and it is<\/p>\n<p>only a malicious prosecution manifestly instituted by<\/p>\n<p>the first respondent to pressurise the petitioners.<\/p>\n<p id=\"p_1\">    2. Learned counsel appearing for the petitioners<\/p>\n<p>and learned Public Prosecutor were heard.<\/p>\n<p id=\"p_2\">    3. Learned counsel appearing for the petitioners<\/p>\n<p>submitted that petitioners have already appeared before<\/p>\n<p>the learned Magistrate. On hearing the learned counsel,<\/p>\n<p>I do not find it for this Court to scan the materials<\/p>\n<p>and decide whether ingredients of the offences are<\/p>\n<p>attracted, when petitioners could very well raise the<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">CRMC 4819\/10               2<\/span><\/p>\n<p>contentions before the learned Magistrate and seek an<\/p>\n<p>order  of   discharge under  <a href=\"\/doc\/897083\/\" id=\"a_2\">Section  239<\/a>  of  Code of<\/p>\n<p>Criminal Procedure.\n<\/p>\n<p id=\"p_3\">     Petition   is disposed granting   liberty  to  the<\/p>\n<p>petitioners to raise all the contentions raised herein<\/p>\n<p>and seek an order of discharge under <a href=\"\/doc\/897083\/\" id=\"a_3\">Section 239<\/a> of<\/p>\n<p>Code of Criminal Procedure. If petitioners file a<\/p>\n<p>petition    under <a href=\"\/doc\/897083\/\" id=\"a_4\">Section  239<\/a>  of  Code  of   Criminal<\/p>\n<p>Procedure,    learned  Magistrate   shall    hear  the<\/p>\n<p>petitioners    and decide  whether  they   are  to  be<\/p>\n<p>discharged or charge is to be framed.
