The Deputy Law Of\ufb01cer<\/p>\n<p>A stthtnitted a report dated 16-6\/7-2004 Annexure&#8211;&#8220;C&#8221;<\/p>\n<p>0  stating that on account of non&#8211;fi1ing of the counter<\/p>\n<p>M<\/p>\n<p>statement and production of record or evidence in<\/p>\n<p id=\"p_2\">1.o.No.49\/2000 in the case of c. Pyre Jan, Condtiictosj,<\/p>\n<p>K.C.No.1095 of Kola: Depot, the Corporati.:onl:st1&#8217;ffe1&#8217;e_d <\/p>\n<p>an adverse award. The Disciplinary <\/p>\n<p>the opinion that there were grouiildspto inclttire <\/p>\n<p>allegation of misconduct, is&#8217;sI;1&#8243;ed an &#8216;Articltes &#8220;of charge V<\/p>\n<p>dated 19\/23&#8211;08&#8211;2004t_  tel&#8217;t&#8217;wtt1eh the<br \/>\npetitioner subrnitted  6-09-2004<br \/>\nAnnexure&#8211;&#8221; ,4 l   lthweafecords relating to<br \/>\nmore   traceable by the<br \/>\n  %\u00a2_c1:_j(&#8216;):.&#8217;\/vltivlltiespite repeated requests<br \/>\nand heme, the&#8217;v.iilep&#8217;in_4cplestion was not submitted to the<\/p>\n<p>Cotirt. 0. In aciditioln, the petitioner asserted that the non-<\/p>\n<p>  the records was due to the failure of the<\/p>\n<p>  forwarding the claim statement and that<\/p>\n<p>the awvardfin the particular case was passed on 15~O2&#8211;<\/p>\n<p> &#8216;*2:O.Q3,l&#8221;&#8217;16 months after he ceased to be the Assistant<\/p>\n<p> Officer of Kolar Division. The Disciplinary<\/p>\n<p>2 &#8220;&#8216;&#8221;Authority, having considered the explanation to the<\/p>\n<p>M<\/p>\n<p>show cause notice and the reply to the Articles of<\/p>\n<p>Charge being of the opinion that the failure <\/p>\n<p>and secure the records from the l)efau1t\u00ab.__2Sejet.iond  <\/p>\n<p>respect of I.I).No.49\/2000 and fi,irn&#8221;ish:_ the; itoihe.<\/p>\n<p>Advocate on record, leading to the lawardfysettingvv<\/p>\n<p>the orders of punishment, exhibited Iac_k*of devotion to V<\/p>\n<p>duty, a misconduct  fc\u00a7Vf&#8221;th&#8221;e KSRTC<br \/>\nServants (C &amp;   ,1;\/973{:d._erder dated 28-\n<\/p>\n<p id=\"p_3\">08-2005    punishment of<br \/>\nwithholding&#8217;   cumulative effect.<br \/>\nThe  said order was rejected<br \/>\nby orderudjated  Hence, this writ<\/p>\n<p>petition,<\/p>\n<p>&#8216; VA  the post of Assistant Law Of\ufb01eer<\/p>\n<p>  petitioner enjoins a duty to ensure the<\/p>\n<p> reco1&#8217;d.s_A&#8217;1~relating to legal proceedings before Court are<\/p>\n<p>  available to the learned counsel so as to effectively<\/p>\n<p>  pvpdefend the case of the Corporation. The failure on the<\/p>\n<p>t*&#8217;\\<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">5<\/span><\/p>\n<p>part of the petitioner to secure the records and make<br \/>\nthem available to the learned counsel, though one of the<\/p>\n<p>duties and responsibilities attached to the  of<\/p>\n<p>Assistant Law Officer, admittedly. the passin,g&#8217;on&#8217;_~<\/p>\n<p>blame on the Learned Counsel for the \u00a391\u00bb. <\/p>\n<p>not furnishing a copy of  cl-aii&#8217;nl4&#8243;atstatenient <\/p>\n<p>contended in reply to theshow lcause  <\/p>\n<p>explanation to the Articles ofl&#8221;&#8216;eharge   far fetched<br \/>\nand unacceptable. Vit:7wasL  t&#8217;he Ailptettitioner to have<br \/>\nsecured the claim statement&#8221; fifonf&#8217;the:?1earned counsel<\/p>\n<p>and :vpre_pai*e&#8217;c{ _.__tl1e gcounte&#8217;_r statement or parawise<br \/>\nremarksV.on.the=_t5asis_ offecords, without which the case<\/p>\n<p>of_thet..co1;pcration could not have been effectively<\/p>\n<p>  This very statement is suf\ufb01cient to<\/p>\n<p>  dereliction of duty and the failure to<\/p>\n<p>su.f;&#8217;erVtse&#8221;and secure the records from Default section,<\/p>\n<p> &#8216;ir1t..1fnesVjVoect of I.D.No.49\/ 2000 and furnish the same to<\/p>\n<p> &#8216;thellearned counsel.\n<\/p>\n<p id=\"p_4\">.9 5<br \/>\n#\\,.\n<\/p>\n<p id=\"p_5\">\n<p id=\"p_6\">3.
