           The   revision   petitioner\/tenant   attempted   an<\/p>\n
appeal   against   an   order   of   eviction   passed   by   the   Rent<\/p>\n
Controller.  But that appeal was filed with a delay of over<\/p>\n
400 days.   I.A.No.2965\/04 was filed before the appellate<\/p>\n
court   seeking   condonation   of   that   delay.     That   was<\/p>\n
dismissed.     Therefore,   this   revision   petition   at   the<\/p>\n
instance of the tenant.\n<\/p>\n

           2.  The revision petition was filed by the party in<\/p>\n
person.   Taking   into   account   the   complexity   of   the<\/p>\n
contentions raised disputing the title of the landlady and<\/p>\n
the   tenancy   arrangement,   we   requested   Advocate<\/p>\n
R.C.R.NO.415 OF 2006<\/p>\n

Sri.K.Ramachandran to appear on behalf of the revision<\/p>\n
petitioner.\n<\/p>\n
\n
                  3.     It   is   submitted   by   the   counsel   for   the<\/p>\n
revision petitioner so appointed, that Ext.A1 photo copy<\/p>\n
of   the   assignment   deed   is   the   title   deed   produced   by<\/p>\n
the  landlady   before   the   Rent   Controller.     That  was   on<\/p>\n
17.8.1998.     The   tenancy   arrangement   alleged   as   per<\/p>\n
Ext.P3 is also of the same date.   Thus, it is stated that<\/p>\n
the contention of the tenant that there was no intention<\/p>\n
to   act   upon   Ext.A1   sale   deed   becomes   probable,   the<\/p>\n
counsel submits, especially when she had continued in<\/p>\n
possession and enjoyment of the property, by reason of<\/p>\n
the reciprocative rent deed, Ext.A3.<\/p>\n
                  4.       It   is   also   submitted   that   the   Rent<\/p>\n
Controller also addressed itself a wrong question as to<\/p>\n

whether   the   landlady   had   proved   her   title   rather   than<\/p>\n
considering   the   dispute   regarding   the   title   of   the<\/p>\n
landlady raised by the revision petitioner\/tenant as bona<\/p>\n
fide.  In such circumstances, we are of the view that the<\/p>\n
merit of the matter requires consideration at the hands<\/p>\n
of the Rent Control appellate authority.   So, taking into<\/p>\n
account   the   circumstances   in   which   the   revision<\/p>\n
petitioner is placed, we are of the view that the delay in<\/p>\n
filing   the   Rent   Control   Appeal   shall   have   to   be<\/p>\n
condoned.\n<\/p>\n

                  5.   Sri.N.P.Samuel, counsel for the respondent<\/p>\n
submits that execution proceedings have been initiated<\/p>\n
and delivery of the building has been effected.<\/p>\n
                  6. At the same time, when the revision petition<\/p>\n
came   up   for   admission,   the   revision   petitioner   herself<\/p>\n
R.C.R.NO.415 OF 2006<\/p>\n

appeared before the Bench and submitted that she was<\/p>\n
continuing   there.     So,   an  interim   order   was   passed   to<\/p>\n
maintain the position available then.<\/p>\n
                  7.   Taking into account the aforesaid aspects,<\/p>\n
we   are   of   the   view   that   the   order   passed   in<\/p>\n
I.A.No.2965\/04   has   to   be   set   aside   and   the   delay   in<\/p>\n
filing   R.C.A.No.116\/04   on   the   file   of   the   Rent   Control<\/p>\n
Appellate Authority, Thrissur,  has to be condoned.<\/p>\n
                  8.   Accordingly,   this   Rent   Control   Revision   is<\/p>\n
allowed,   setting   aside   the   impugned   order.   The   Rent<\/p>\n
Control   Appellate   Authority   is   directed   to   dispose   of<\/p>\n
R.C.A.No.116\/04 on merit. The interim order passed on<\/p>\n
5.12.2006   in   this   petition   shall   continue   until   such<\/p>\n
disposal.\n<\/p>\n

                  9. Taking into account the financial difficulty of<\/p>\n
the   revision   petitioner,   we   are   of   the   view   that   the<\/p>\n
District   Legal   Services   Authority,   Thrissur   shall   make<\/p>\n
necessary arrangement for the effective legal assistance<\/p>\n
to the revision petitioner while the appeal is taken up.<\/p>\n
                  10.   The   gist   of   the   disposal   of   this   revision<\/p>\n
shall be intimated to the revision petitioner forthwith.<\/p>\n
