Justice P.S.GOPINATHAN\n\n Dated :30\/09\/2009\n\n O R D E R\n                     P.S.GOPINATHAN, J.\n\n                 == = = = = = = = = = = = = = = = = =\n                     Crl.R.P.No.3045 of 2009.\n                 = = = == = = = = = = = = = = = = = =\n\n             Dated this the 30th day of September, 2009.\n\n                            O R D E R\n<\/pre>\n<p id=\"p_1\">     The    revision     petitioner       is    the     accused in<\/p>\n<p>CC.No.1933\/2004 on the file of the Judicial Magistrate of<\/p>\n<p>the First Class-I, Aluva. The first respondent prosecuted<\/p>\n<p>the revision petitioner alleging offence under <a href=\"\/doc\/1823824\/\" id=\"a_1\">Section 138<\/a> of<\/p>\n<p>the Negotiable Instruments Act. The learned Magistrate,<\/p>\n<p>after due trial, arrived a conclusion of guilt. Consequently,<\/p>\n<p>the revision petitioner was convicted and sentenced to<\/p>\n<p>simple imprisonment for three months.               He was further<\/p>\n<p>directed to pay Rs.25,000\/- as compensation, to the first<\/p>\n<p>respondent under <a href=\"\/doc\/640437\/\" id=\"a_1\">Section 357(3)<\/a> of the Criminal Procedure<\/p>\n<p>Code.    In appeal, the Addl.Sessions Judge, (Adhoc-III),<\/p>\n<p>N.Paravur confirmed the conviction. Assailing the legality,<\/p>\n<p>correctness and propriety of the above conviction and<\/p>\n<p>sentence as confirmed in appeal, this revision petition was<\/p>\n<p>filed.\n<\/p>\n<p id=\"p_1\">Crl.R.P.No.3045 of 2009.\n<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">                                -: 2 :-<\/span><\/p>\n<p id=\"p_2\">\n<p id=\"p_3\">        2.     Having heard the learned counsel for the revision<\/p>\n<p>petitioner and perusing the judgments impugned, I find that<\/p>\n<p>the first respondent, who was examined as Pw1, supported<\/p>\n<p>by Exts.P1 to P9, had succeeded to establish that the<\/p>\n<p>revision petitioner owed a sum of Rs.25,000\/- to the first<\/p>\n<p>respondent and in discharge of that liability Ext.P1 cheque<\/p>\n<p>dated 1.1.2004 was issued and that when Ext.P1 was sent<\/p>\n<p>for collection, it was dishonoured for insufficiency of funds,<\/p>\n<p>as evidenced by Exts.P2 to P5 memos. Though a lawyer<\/p>\n<p>notice, copy of which was marked as Ext.P6, was caused<\/p>\n<p>demanding            discharge of  the  liability and   it  was<\/p>\n<p>acknowledged by the revision petitioner as evidenced by<\/p>\n<p>Ext.P9, the liability was not discharged. The defence of the<\/p>\n<p>revision petitioner is that out of business transaction some<\/p>\n<p>amount was due to the first respondent and at the instance<\/p>\n<p>of one Koya an account was opened in Canara Bank and a<\/p>\n<p>blank cheque was issued as a security. It is the support of<\/p>\n<p>that contention DWs.1 and 2 were examined.            DW2 had<\/p>\n<p>Crl.R.P.No.3045 of 2009.\n<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">                             -: 3 :-<\/span><\/p>\n<p id=\"p_4\">\n<p>even gave to the extent that the liability wad discharged.<\/p>\n<p>The revision petitioner has no any such case of discharge.<\/p>\n<p>There is no reply to the notice demanding discharge.<\/p>\n<p>Silence after the notice looms large.             It is in the<\/p>\n<p>circumstance the courts below disbelieved DWs.1 and 2.<\/p>\n<p>The evidence of DWs.1 and 2 is not sufficient enough to<\/p>\n<p>rebut the legal presumption under Sec.118 and 139 of the<\/p>\n<p><a href=\"\/doc\/1132672\/\" id=\"a_2\">Negotiable Instruments Act<\/a> which supports the case of the<\/p>\n<p>first respondent. Such being the material on record, I find<\/p>\n<p>that the courts below had correctly appreciated the<\/p>\n<p>evidence and arrived a finding of guilt. There is no error,<\/p>\n<p>illegality or impropriety to be rectified in revision.     The<\/p>\n<p>conviction under challenge is unassailable.<\/p>\n<p id=\"p_5\">        3.     Regarding sentence, I find that the revision<\/p>\n<p>petitioner who is a senior citizen is entitled to more leniency<\/p>\n<p>and a sentence of imprisonment till rising of the court with<\/p>\n<p>a fine of Rs.25,000\/- with default sentence for four months<\/p>\n<p>would meet the ends of justice.\n<\/p>\n<p id=\"p_6\">Crl.R.P.No.3045 of 2009.\n<\/p>\n<p><span class=\"hidden_text\" id=\"span_2\">                                -: 4 :-<\/span><\/p>\n<p id=\"p_7\">\n<p id=\"p_8\">        4.     In the result, the revision petition is allowed in<\/p>\n<p>part.      While confirming the conviction, the sentence is<\/p>\n<p>reduced to imprisonment till rising of the court and a fine of<\/p>\n<p>Rs.25,000\/- with default sentence of simple imprisonment<\/p>\n<p>for four months. Fine, if realised, shall be paid to the first<\/p>\n<p>respondent as compensation under Sec.357(1)<a href=\"\/doc\/445276\/\" id=\"a_3\"> of the Code<\/a><\/p>\n<p>of Criminal Procedure.
