Heard learned counsels representing the<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                2<\/span><\/p>\n<p>petitioners in all the four cases and learned Additional<\/p>\n<p>Public Prosecutors for opposite party.<\/p>\n<p id=\"p_1\">              2. All these four cases have been filed<\/p>\n<p>under <a href=\"\/doc\/1679850\/\" id=\"a_1\">Section 482<\/a> of the Code of Criminal Procedure<\/p>\n<p>seeking quashing of order dated 06th February, 2004<\/p>\n<p>passed in Complaint Case no. 322 M of 2004 by the<\/p>\n<p>Chief Judicial Magistrate, Patna, taking cognizance<\/p>\n<p>against the petitioners for the offences under Sections<\/p>\n<p>25(U) and 29 of the Industrial Dispute Act, 1947 for<\/p>\n<p>alleged violation of the provisions under <a href=\"\/doc\/1337575\/\" id=\"a_1\">Section 18(3)<\/a><\/p>\n<p>and Sl. 13 of Schedule 5 B of the said Act, that is,<\/p>\n<p>committing unfair labour practice and breach of<\/p>\n<p>settlement on Award. The case was transferred for trial<\/p>\n<p>to the Court of Sri Sanjay Kumar Singh, Judicial<\/p>\n<p>Magistrate, 1st Class, Patna.\n<\/p>\n<p id=\"p_2\">              3. It is admitted fact that the complaint was<\/p>\n<p>filed by Opposite Party no.2, Labour Commissioner,<\/p>\n<p>Patna, who had earlier issued letter no.4198 dated 27th<\/p>\n<p>August,    2003 against the petitioners        relating to<\/p>\n<p>implementation of the recommendation of the Manisana<\/p>\n<p>Wage Board Award        but in reply to the said letter the<br \/>\n<span class=\"hidden_text\" id=\"span_1\">               3<\/span><\/p>\n<p>Management explained vide its letter dated 01st<\/p>\n<p>September, 2003 that as per recommendation of the<\/p>\n<p>Wage Board the Journalists were being paid wages as<\/p>\n<p>per Class-II whereas non-journalist employees were paid<\/p>\n<p>the wages of Class- VI and as such the same was a<\/p>\n<p>violation of Manisana Wage Board Award and as such<\/p>\n<p>they have not implemented the provisions of Part-III,<\/p>\n<p>Chapter-I, Clause 2(3) of Manisana Wage Board Award<\/p>\n<p>which provides an explanation;\n<\/p>\n<blockquote id=\"blockquote_1\"><p>              \u2015For the purpose of this clause &#8211; if there<br \/>\n     are different Units\/ branches \/ companies of one<br \/>\n     classified newspaper establishment in one town<br \/>\n     or city and adjoining areas          even though<br \/>\n     carrying different names, will be treated as one<br \/>\n     single Unit of that newspaper establishment.\u2016<\/p>\n<\/blockquote>\n<blockquote id=\"blockquote_1\"><p>             4. It is further stated in the complaint<\/p>\n<p>petition that the Management treating the four Units<\/p>\n<p>different   whereas   they   are   branches    of   one<\/p>\n<p>establishment which further appears from Identity Card<\/p>\n<p>issued to the employees working under all the four<\/p>\n<p>Branches whereon the Times of India appears printed.<\/p><\/blockquote>\n<p id=\"p_3\">\n<p id=\"p_4\">             5. The learned counsel for the petitioners<\/p>\n<p>submitted that the petitioner in Cr.Misc. no. 12876 of<\/p>\n<p>2004 is an independent establishment wherein all the<br \/>\n<span class=\"hidden_text\" id=\"span_2\">                4<\/span><\/p>\n<p>employees are being given their wages as per the<\/p>\n<p>Awards.    So far petitioners of other three cases are<\/p>\n<p>concerned, they are altogether different Companies but<\/p>\n<p>supporting the functions of petitioner of first case on the<\/p>\n<p>basis of out sourcing and Manisana Wage Board Award<\/p>\n<p>is not applicable upon them. Further, no offence for<\/p>\n<p>which cognizance has been taken, is made out against<\/p>\n<p>either of the petitioners in all the four cases. On the<\/p>\n<p>other hand, learned Additional Public Prosecutor<\/p>\n<p>supported the Order under challenge and averments<\/p>\n<p>made in the complaint petition.\n<\/p>\n<p id=\"p_5\">             6. Admittedly, Manisana Wage Board was<\/p>\n<p>constituted under the provisions of Working Journalist<\/p>\n<p>&amp; other Newspaper Employees (Condition of Service)<\/p>\n<p>&amp;   <a href=\"\/doc\/269107\/\" id=\"a_2\">Miscellaneous Provisions       Act<\/a>, 1955, which by<\/p>\n<p>submitting Award, of national importance recommended<\/p>\n<p>the prescribed wages for the employees of Newspaper<\/p>\n<p>Establishment and the recommendations have been<\/p>\n<p>accepted by the Central Government who              issued<\/p>\n<p>Notification in this regard. Since the recommendations<\/p>\n<p>were enforceable all over India its status is an Award of<br \/>\n<span class=\"hidden_text\" id=\"span_3\">                5<\/span><\/p>\n<p>National Tribunal.     Thus, the contention of learned<\/p>\n<p>counsel that there is no unfair labour practice even if<\/p>\n<p>Manisana    Wage     Board    Award   is   not   properly<\/p>\n<p>implemented, is not acceptable. In view the of the term<\/p>\n<p>&#8220;unfair labour practice&#8221; as defined under <a href=\"\/doc\/1418464\/\" id=\"a_3\">Section 2(ra)<\/a><\/p>\n<p>of the Industrial Disputes Act means any of the practices<\/p>\n<p>as specified in the Fifth Schedule.\n<\/p>\n<p id=\"p_6\">             7. Similarly, at serial no.13 of 5th Schedule<\/p>\n<p>under Industrial      Dispute Act reads &#8220;failure to<\/p>\n<p>implement Award, Settlement or Agreement&#8221;.          Thus<\/p>\n<p>non-implementation of any term of the Award<\/p>\n<p>constitutes an offence punishable under <a href=\"\/doc\/269107\/\" id=\"a_4\">Section 25-U<\/a><\/p>\n<p>of the Act read with <a href=\"\/doc\/269107\/\" id=\"a_5\">Section 29<\/a>, both respectively reads<\/p>\n<p>as such:\n<\/p>\n<blockquote id=\"blockquote_2\"><p>            \u201525-U. Penalty for committing unfair<br \/>\n     Labour practices&#8211;Any person who commits<br \/>\n     any unfair Labour practice be punishable with<br \/>\n     imprisonment for a term which may extend to<br \/>\n     six months or fine which may extend to one<br \/>\n     thousand rupees or with both.<\/p><\/blockquote>\n<p id=\"p_7\">\n<p id=\"p_8\">             29. Penalty for breach of settlement or<br \/>\n     Award.- Any person who commits a breach of<br \/>\n     any term of any settlement or Award, which is<br \/>\n     binding on him under this Act, shall be<br \/>\n     punishable with imprisonment for a term which<br \/>\n     may extend to six months, or with fine, or with<br \/>\n     both, and where the breach is a continuing one,<br \/>\n     with a further fine which may extend to two<br \/>\n<span class=\"hidden_text\" id=\"span_4\">               6<\/span><\/p>\n<p>     hundred rupees for every day during which the<br \/>\n     breach continues after the conviction for the<br \/>\n     first and the Court trying the offence, if it fines<br \/>\n     the offender, may direct that the whole or any<br \/>\n     part of the fine realized from him shall be paid,<br \/>\n     by way of compensation, to any person who, in<br \/>\n     its opinion, has been injured by such breach.\u2016<\/p>\n<p>             It is also relevant to mention here that<\/p>\n<p>Chapter II Section 3 of the W.J. and Other Newspaper<\/p>\n<p>Employees etc. Act, 1955 reads as such:<\/p>\n<blockquote id=\"blockquote_3\"><p>             \u20153. Act 14 of 1947 to apply to working<br \/>\n     Journalists:- (1) The provisions of the <a href=\"\/doc\/500379\/\" id=\"a_6\">Industrial<br \/>\n     Disputes Act<\/a>, 1947, as in force for the time<br \/>\n     being, shall subject to modification specified in<br \/>\n     Sub-section (2), apply to, or in relation to,<br \/>\n     working Journalists as they apply to, or in<br \/>\n     relation to, workmen within the meaning of that<br \/>\n     Act.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_4\"><p>             (2) <a href=\"\/doc\/1056316\/\" id=\"a_7\">Section 25F<\/a> of the aforesaid Act, in<br \/>\n     its application to working journalists, shall be<br \/>\n     construed as if in Clause (a) thereof, for the<br \/>\n     period of notice referred to therein in relation to<br \/>\n     the retrenchment of a workman, the following<br \/>\n     periods of notice in relation to the retrenchment<br \/>\n     of a working journalist had been substituted<br \/>\n     namely-\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_5\"><p>             (a) six months, in the case of an editor,<br \/>\n             And<\/p>\n<\/blockquote>\n<blockquote id=\"blockquote_6\"><p>            (b) three months, in the case of any<br \/>\n     other working journalist.\u2016<br \/>\n<span class=\"hidden_text\" id=\"span_5\">               7<\/span><\/p>\n<\/blockquote>\n<blockquote id=\"blockquote_7\"><p>             8. Now, the only question left for<\/p>\n<p>consideration whether the Award is binding upon all the<\/p>\n<p>petitioners or not. As per petitioners only petitioners of<\/p>\n<p>first case is liable to comply the Award and make<\/p>\n<p>payment of wages accordingly which they are doing.<\/p>\n<\/blockquote>\n<blockquote id=\"blockquote_8\"><p>To support this my attention was drawn towards the<\/p>\n<p>orders passed in CWJC no. 7240 of 2002 which was<\/p>\n<p>filed by the Times of India Newspaper Employees<\/p>\n<p>Union and another seeking relief against non-\n<\/p><\/blockquote>\n<p id=\"p_9\">implementation of the recommendation of the Award.<\/p>\n<p>Ultimately, in their absence, vide order dated 19th<\/p>\n<p>November, 2009 the writ petition was disposed of on<\/p>\n<p>the submissions of the opposite parties that if they are<\/p>\n<p>not being paid the wages as per recommendations the<\/p>\n<p>amount is recoverable on their applications to the State<\/p>\n<p>Government under <a href=\"\/doc\/180729963\/\" id=\"a_8\">Section 17<\/a> of the Working<\/p>\n<p>Journalists and Other Miscellaneous Provision Act,<\/p>\n<p>1955 which they have not done so giving liberty to avail<\/p>\n<p>out the remedy available the writ applications appears to<\/p>\n<p>have been disposed of.\n<\/p>\n<p id=\"p_10\">             9. The above is not sufficient to establish<br \/>\n<span class=\"hidden_text\" id=\"span_6\">                  8<\/span><\/p>\n<p>that    the     recommendations    are   being    properly<\/p>\n<p>implemented. Moreover, assuming the employees at the<\/p>\n<p>time of filing of the writ application in the year 2002 did<\/p>\n<p>not approach the State Government as required under<\/p>\n<p><a href=\"\/doc\/678364\/\" id=\"a_9\">Section 17<\/a> of the Act but they might have done<\/p>\n<p>subsequently giving rise to issuance of letter no.4198<\/p>\n<p>dated    27th    August,   2003    by    Deputy    Labour<\/p>\n<p>Commissioner, Patna, for implementation of the Award<\/p>\n<p>to the Management.\n<\/p>\n<p id=\"p_11\">                10. The contention of learned counsel for<\/p>\n<p>the petitioners that other three petitioners than M\/s<\/p>\n<p>Bennett Coleman Co. Ltd. and Others have their<\/p>\n<p>separate identity and the employees under them are not<\/p>\n<p>to be benefited by the recommendation of Manisana<\/p>\n<p>Wage Board Award but this statement is also not<\/p>\n<p>acceptable in face of assertion of the complainant in the<\/p>\n<p>complaint petition itself that workmen under all the<\/p>\n<p>three other petitioners which are said to have been just<\/p>\n<p>supporting petitioners of first case as out sourcing<\/p>\n<p>Agent, have printed Identity Cards at the top of the<\/p>\n<p>same the Times of India appears printed and inspite of<br \/>\n<span class=\"hidden_text\" id=\"span_7\">                9<\/span><\/p>\n<p>filing of some of the Identity Cards issued by all the<\/p>\n<p>four petitioners Company having same feature in the<\/p>\n<p>petitions filed before this Court, the petitioners are<\/p>\n<p>conspicuously silent.      Even during the course of<\/p>\n<p>argument nothing contrary was pointed out.<\/p>\n<p id=\"p_12\">             11. The above materials are prima facie<\/p>\n<p>sufficient to establish that all the three establishments<\/p>\n<p>under names and style (1) M\/s Times Publishing House<\/p>\n<p>Ltd.,   M\/s Pearl Printwell          Ltd. and M\/s Excel<\/p>\n<p>Publishing    House     Ltd.   are   the   Units    of   one<\/p>\n<p>establishment M\/s Bennet Coleman &amp; Co. Ltd., having<\/p>\n<p>different names for internal convenience.<\/p>\n<p id=\"p_13\">             12. The submissions of learned counsel for<\/p>\n<p>the petitioners that if at all there is any violation of the<\/p>\n<p>provisions of Working Journalist and other Newspaper<\/p>\n<p>Employees Act, 1955 they may be liable to be penalized<\/p>\n<p>under <a href=\"\/doc\/509428\/\" id=\"a_10\">Section 18<\/a> of the Act, but not for the offences<\/p>\n<p>under which cognizance has been taken.             As stated<\/p>\n<p>above, the provisions of <a href=\"\/doc\/500379\/\" id=\"a_11\">Industrial Disputes Act<\/a>, 1947<\/p>\n<p>is, prima facie, applicable in the instant case and<\/p>\n<p>whether any offence have been constituted under<br \/>\n<span class=\"hidden_text\" id=\"span_8\">               10<\/span><\/p>\n<p><a href=\"\/doc\/509428\/\" id=\"a_12\">Section 18<\/a> of the Act it is left to be decided by the trial<\/p>\n<p>Court at the time of hearing on the point of charge or at<\/p>\n<p>any appropriate stage. The trial court without being<\/p>\n<p>restricted to the order taking cognizance for a particular<\/p>\n<p>offence, if find fit, may proceed with trial for other<\/p>\n<p>offences also if made out after framing proper charge.<\/p>\n<p id=\"p_14\">             13.
