Dhule, through its\nBranch Manager Mr.Satish Pitambar Kadam,\nCentral Bank of India,\nMukti Branch, District Dhule.                  ...APPELLANT\n\n\nVERSUS\n\n\nSmt.Sangeeta Ramesh Patil,\nR\/o Village Mukti,\nTq. &amp; Dist.Dhule.                              ...RESPONDENT.\n\n\n           Coram :     Mr.S.M.Shembole, Hon`ble Presiding Judicial\n                       Member.\n                       Mrs.Uma S.Bora, Hon`ble Member.\n                       Mr.K.B.Gawali, Hon`ble Member.\n\n           Present :   Adv.Shri.D.B.Dabholkar for appellant.\n\n                        O R A L JUDGMENT\n                       (Delivered on 30th October 2013)\n\nPer Mr.S.M.Shembole, Hon`ble Presiding Judicial Member.\n\n1.<\/pre>\n<p id=\"p_1\">     This appeal is an exception to the judgment and order dated<br \/>\n29.11.2010 passed by District Consumer Forum Dhule partly allowing<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                       2                          F.A.No. :21\/11<\/span><\/p>\n<p>the consumer complaint No.24\/2010 directing appellant\/opponent bank<br \/>\nto issue no dues certificate to the respondent\/complainant under loan<br \/>\nwaiver scheme and further to pay compensation of Rs.1000\/- for causing<br \/>\nmental torture and Rs.500\/- towards cost of the proceedings.\n<\/p>\n<p id=\"p_1\">(For the sake of brevity appellant bank is hereinafter referred as<br \/>\n&#8216;opponent bank&#8217; and respondent as &#8216;complainant&#8217;.)<\/p>\n<p id=\"p_2\">2.    We heard Shri.Dabholkar proxy advocate appearing for appellant<br \/>\nand with his consent decided to dispose of this appeal at the stage of<br \/>\nadmission.\n<\/p>\n<p id=\"p_3\">3.    Brief facts giving rise to this appeal are that:-\n<\/p>\n<p id=\"p_4\">      Complainant Smt.Janyabai is an agriculturist having agriculture<br \/>\nfield admeasuring 2 hector 49R at village Mukti Tq. &amp; Dist.Dhule. In the<br \/>\nmonth of May 2004 complainant had borrowed loan of Rs.50,000\/- from<br \/>\nopponent bank. In the year 2008 Government of Maharashtra launched<br \/>\nAgriculture Loan Waiver Scheme-2008. Under the same scheme the<br \/>\nagriculturist having holding more than 2 hector is entitled to get benefit<br \/>\nof the same scheme only up to 25% or Rs.20,000\/- whichever is more.<br \/>\nHowever, according to the complainant she is entitled to get 100% benefit<br \/>\nof the same scheme and accordingly she applied to the opponent bank<br \/>\nfor getting benefit. However, opponent bank informed the complainant<br \/>\nthat she is entitled to get benefit of 25% or Rs.20,000\/- and accordingly<br \/>\nopponent bank granted the same facility and given exemption for<br \/>\nrepayment of loan Rs.20,000\/-. Therefore by notice dated 25.6.2009 the<br \/>\ncomplainant claimed 100% exemption. Opponent bank denied the same<br \/>\nnotice giving reply. Therefore complainant has filed consumer complaint<br \/>\nalleging deficiency in service on the part of opponent bank and claimed<br \/>\n100% exemption from repayment of loan and direction to issue no dues<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                          3                              F.A.No. :21\/11<\/span><\/p>\n<p>certificate. She has also claimed compensation Rs.10,000\/- and<br \/>\nRs.5000\/- from towards cost of the proceedings.\n<\/p>\n<p id=\"p_5\">4.    Opponent bank resisted the complaint by its written version<br \/>\ncontending inter alia that complainant is entitled to get exemption only<br \/>\nup to Rs.20,000\/-.        Accordingly that benefit is already given to her.<br \/>\nTherefore there was no any deficiency in service on its part.              It has<br \/>\nsubmitted to dismiss the complaint.\n<\/p>\n<p id=\"p_6\">5.    On hearing both sides and considering the evidence on record,<br \/>\nDistrict Consumer Forum held that complainant is entitled to get 100%<br \/>\nbenefit of the same scheme and therefore opponent bank committed<br \/>\ndeficiency in service denying 100% benefit. In keeping with this finding<br \/>\nDistrict Consumer Forum has partly allowed the complaint as noted<br \/>\nabove.\n<\/p>\n<p id=\"p_7\">6.    Feeling aggrieved by that judgment and order opponent bank has<br \/>\nfiled this appeal.\n<\/p>\n<p id=\"p_8\">7.    We heard learned counsel appearing for the appellant, perused the<br \/>\ncopy of impugned judgment and order and copies of complaint, written<br \/>\nversion and copy of State Government circular pertain to the Agriculture<br \/>\nLoan Waiver Scheme-2008. However, we have had no opportunity to hear<br \/>\nthe complainant as she remained absent despite service of notice and<br \/>\ntherefore appeal is proceeded exparte against her. Almost all the facts<br \/>\nexcept the percentage of benefit of the said scheme are not disputed. It is<br \/>\nsubmitted    by      learned   counsel   appearing   for   the   appellant    that<br \/>\ncomplainant is being an agriculturist holding more than 2 Hectors land<br \/>\nis entitled to get benefit of scheme to the extent of 25% or Rs.20,000\/-<br \/>\nwhichever is more. But she is not at all entitled to get 100% benefit.<br \/>\nHowever, the complainant has falsely claimed that she is entitled for<br \/>\n<span class=\"hidden_text\" id=\"span_2\">                                              4                                F.A.No. :21\/11<\/span><\/p>\n<p>100%. In support of his submission, learned counsel for the appellant<br \/>\nhas pointed out from the copy of the said circular that as per circular<br \/>\nagriculturist having agriculture land holding more than 2 hector, is<br \/>\nentitled to get limited benefit as pointed out above. On perusal of circular<br \/>\nand undisputed fact that the complainant is having agriculture land<br \/>\nholding 2 hectors, we find much force in the learned counsel appearing<br \/>\nfor appellant.\n<\/p>\n<p id=\"p_9\">8.        However, on perusal of copy of complaint it reflects that<br \/>\ncomplainant       has   averred   that       she      is   holding   agriculture    land<br \/>\nadmeasuring less than 2 hector. According to her 32R land belonging to<br \/>\nher is acquired by the Government etc. and therefore she has claimed<br \/>\nthat she is having agriculture land holding less than 2 hectors etc. But<br \/>\non perusal of 7\/12 extract it manifests that complainant was holding 2<br \/>\nhector 49R of land and if 32R land is acquired by Government still she is<br \/>\nholding more than 2 hectors land. Therefore contention of complainant<br \/>\nthat she is holding less than 2 hector land cannot be sustained. But it<br \/>\nappears from the copy of impugned judgment and order that the District<br \/>\nConsumer Forum without considering all these undisputed facts jumped<br \/>\nto the wrong conclusion that complainant is entitled to get 100% benefit<br \/>\nof the same Government scheme.                   Such erroneous finding cannot be<br \/>\nsustained.\n<\/p>\n<p id=\"p_10\">9.        In the result, opponent bank succeeds and appeal deserves to be<br \/>\nallowed. Hence the following order.\n<\/p>\n<p id=\"p_11\">                                  O      R        D   E     R<\/p>\n<p id=\"p_12\">     1.     Appeal is allowed and impugned judgment and order is set<br \/>\n            aside.\n<\/p>\n<p><span class=\"hidden_text\" id=\"span_3\">                                       5                         F.A.No. :21\/11<\/span><\/p>\n<p id=\"p_13\">   2.
