Justice P.S.GOPINATHAN\n\n Dated :\/  \/\n\n O R D E R\n                      P.S.GOPINATHAN, J.\n                 ----------------------------------------\n                    R.P.(F.C).No.394 of 2009\n                 ----------------------------------------\n           Dated this the 28th day of October, 2009\n\n                               ORDER\n<\/pre>\n<p id=\"p_1\">      The revision petitioner is the respondent in CMP(Ex.)1095<\/p>\n<p>of 2008 in M.C.No.412 of 2006 on the file of the Family Court,<\/p>\n<p>Malappuram.      The respondents herein are the wife and the<\/p>\n<p>minor son of the revision petitioner. By order dated 7\/12\/2006 in<\/p>\n<p>M.C.No.412 of 2006 the respondents obtained an order of<\/p>\n<p>maintenance at the rate of Rs.1,700\/- to the first respondent and<\/p>\n<p>at the rate of Rs.500\/- to the second respondent under <a href=\"\/doc\/1056396\/\" id=\"a_1\">Section<\/p>\n<p>125<\/a> of the Code of Criminal Procedure.               Since the revision<\/p>\n<p>petitioner failed to pay the amount, the respondents 1 and 2 filed<\/p>\n<p>C.M.P.(Ex.)1095 of 2008 under <a href=\"\/doc\/1195638\/\" id=\"a_1\">Section 128<\/a> of Code of Criminal<\/p>\n<p>Procedure seeking an order for enforcement of the order of<\/p>\n<p>maintenance. There was arrears for more than 25 months. The<\/p>\n<p>revision petitioner failed to pay the amount.             In the above<\/p>\n<p>circumstance, by the impugned order dated 17\/9\/2008 the<\/p>\n<p>revision   petitioner    was     sentenced       to    undergo  simple<\/p>\n<p>imprisonment for 20 months. Accordingly now he is undergoing<\/p>\n<p>imprisonment.     While undergoing imprisonment this revision<\/p>\n<p>petition was filed through Superintendent of Central Jail, Kannur<\/p>\n<p>R.P.(F.C).No.394 of 2009<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                  2<\/span><\/p>\n<p>assailing the order sentencing the revision petitioner.<\/p>\n<p id=\"p_1\">      2.   Heard the learned counsel for the revision petitioner<\/p>\n<p>and the respondents.       The learned counsel for the revision<\/p>\n<p>petitioner submitted that since he is undergoing imprisonment<\/p>\n<p>he is not in a position to pay the amount. In the event he is<\/p>\n<p>released on bail he would make every attempt to pay<\/p>\n<p>maintenance as ordered by the trial court.         Hoping that the<\/p>\n<p>revision petitioner would comply with the order of maintenance<\/p>\n<p>and on finding that he had undergone imprisonment for more<\/p>\n<p>than one year I find that the imprisonment already undergone<\/p>\n<p>would meet the ends of Justice.\n<\/p>\n<p id=\"p_2\">      In the result this revision petition is allowed.
