NANAVATI\n\n\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p id=\"p_1\">\t\t\t O R D E R<br \/>\n     It is  a sad  spectacle that new practice unbecoming of<br \/>\nworthy and  conducive to  the profession  is croppingup. Mr.<br \/>\nMariaputham, Advocate-on-Record\t had filed  vakalatnama\t for<br \/>\nthe petitioner-respondent  when the  special leave  petition<br \/>\nwas  filed.  After  the\t matter\t was  disposed\tof,  Mr.  V.<br \/>\nBalachandran, Advocate had filed a petition for review. That<br \/>\nwas also  dismissed by\tthis Court  on April  24, 1996.\t Yet<br \/>\nanother advocate,  Mr. S.U.K. Sagar, has now been engaged to<br \/>\nfile the  present application  styled  as  &#8220;application\t for<br \/>\nclarification&#8221;, on  the specious  plea that the order is not<br \/>\nclear and unambiguous. When an appeal\/special leave petition<br \/>\nis dismissed,  except in  rare cases  where error  of law or<br \/>\nfact is apparent on the record, no review can be filed; that<br \/>\ntoo by\tthe advocate  on record who neither appeared nor was<br \/>\nparty in  the main  case. It  is salutary  to not that court<br \/>\nspends valuable\t time in deciding a case. Review petition is<br \/>\nnot, and  should not  be, an  attempt for hearing the matter<br \/>\nagain on  merits. Unfortunately,  it has  become, in  recent<br \/>\ntime, a practice to file such review petitions as a routine;<br \/>\nthat too,  with change of counsel, without obtaining consent<br \/>\nof the\tadvocate on  record at\tearlier stage.\tThis is\t not<br \/>\nconducive to  healthy practice\tof the\tBar  which  has\t the<br \/>\nresponsibility\tto   maintain  the   salutary  practice\t  of<br \/>\nprofession. In\tReview Petition No.2670\/96 in CA No.1867\/92,<br \/>\na Bench of three Judges to which one of us, K. Ramaswamy,J.,<br \/>\nwas a member, has held as under:\n<\/p>\n<blockquote id=\"blockquote_1\"><p>     &#8220;The record of the appeal indicates<br \/>\n     that Shri\tSudarsh Menon  was heard<br \/>\n     and decided  on merits.  The Review<br \/>\n     Petition has  been\t filed\tby  Shri<br \/>\n     Prabir Chowdhury who was neither an<br \/>\n     arguing counsel when the appeal was<br \/>\n     heard nor\twas he\tpresent\t at  the<br \/>\n     time of  arguments. It  is\t unknown<br \/>\n     on what  basis he\thas written  the<br \/>\n     grounds in\t the Review  Petition as<br \/>\n     if it  is a  rehearing of an appeal<br \/>\n     against  our   order.  He\tdid  not<br \/>\n     confine to\t the scope of review. It<br \/>\n     would be not in the interest of the<br \/>\n     profession to permit such practice.<br \/>\n     That part, he has not obtained &#8221; No<br \/>\n     Objection\tCertificate&#8221;   from  the<br \/>\n     Advocate-on-Record in  the\t appeal,<br \/>\n     in spite  of the fact that Registry<br \/>\n     had informed him of the requirement<br \/>\n     for doing\tso. Filing  of\tthe  &#8220;No<br \/>\n     Objection Certificate&#8221; would be the<br \/>\n     basis for\thim to\tcome on\t record.<br \/>\n     Otherwise,\t the  Advocate-on-Record<br \/>\n     is answerable  to\tthe  Court.  The<br \/>\n     failure to obtain the &#8220;No Objection<br \/>\n     Certificate&#8221;  from\t  the  erstwhile<br \/>\n     counsel has disentitled him to file<br \/>\n     the    Review     Petition.    Even<br \/>\n     otherwise, the  Review Petition has<br \/>\n     no merits,\t It  is\t an  attempt  to<br \/>\n     reargue the matter on merits.<br \/>\n\t  On these  grounds, we\t dismiss<br \/>\n     the Review Petition&#8221;.<\/p><\/blockquote>\n<p id=\"p_1\">     Once  the\t petition  for\t review\t is   dismissed,  no<br \/>\napplication for\t clarification should  be filed,  much\tless<br \/>\nwith the  change of the advocate-on-record. This practice of<br \/>\nchanging the  advocates and filing repeated petitions should<br \/>\nbe deprecated with heavy had for purity of administration of<br \/>\nlaw and salutary and healthy practice.\n<\/p>\n<p id=\"p_2\">     The application  is dismissed  with exemplary  costs of<br \/>\nRs.20,000\/- as\tit is  an abuse\t of the\t process of court in<br \/>\nderogation of healthy practice. The amount should be paid to<br \/>\nthe Supreme  Court Legal  Aid Services Committee within four<br \/>\nmonths from  today. If\tthe amount is not paid, it should be<br \/>\nrecovered treating  this direction as decree of the Court by<br \/>\nthe Supreme  Court Legal Services Committee.
