JOSEPH FRANCIS, JJ.\n              - - - - - - - - - - - - - - - - - - - - - - - - - -\n                M.F.A.(W.C.C.)No. 178 of 2008\n              - - - - - - - - - - - - - - - - - - - - - - - - - -\n              Dated this the ...th day of July, 2009\n\n                             JUDGMENT\n<\/pre>\n<p id=\"p_1\">Joseph Francis, J.\n<\/p>\n<p id=\"p_1\">      This appeal under <a href=\"\/doc\/307321\/\" id=\"a_1\">Section 30<\/a> of the Workmen&#8217;s<\/p>\n<p><a href=\"\/doc\/1113485\/\" id=\"a_1\">Compensation Act<\/a> is filed by the second opposite party in<\/p>\n<p>W.C.C. No. 177 of 2001 on the file of the Commissioner for<\/p>\n<p>Workmen&#8217;s Compensation, Kannur. Respondents 1 to 3 herein<\/p>\n<p>are the applicants 1 and 2 and the first opposite party in that case.<\/p>\n<p id=\"p_2\">      2.  The brief facts of the case are as follows.                An<\/p>\n<p>application under <a href=\"\/doc\/380348\/\" id=\"a_2\">Section 22<\/a> of the Workmen&#8217;s <a href=\"\/doc\/1113485\/\" id=\"a_3\">Compensation<\/p>\n<p>Act<\/a> was filed by respondents 1 and 2 herein claiming<\/p>\n<p>compensation of Rs.2,50,000\/- for the death of their son Dinesh<\/p>\n<p>in an accident on 11.6.2000.          The deceased was employed as a<\/p>\n<p>driver of an autorikshaw, No.KL 14\/B 5397, owned by the third<\/p>\n<p>M.F.A.(W.C.C.)No. 178 of 2008<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">                                  2<\/span><\/p>\n<p>respondent. It is   alleged that the accident occurred while he was<\/p>\n<p>driving the autorikshaw.\n<\/p>\n<p id=\"p_3\">      3. While admitting the policy, the appellant contended that the<\/p>\n<p>deceased was not having a valid and effective driving licence to drive<\/p>\n<p>the above said autorikshaw and hence there is no legal employer-<\/p>\n<p>employee relationship.\n<\/p>\n<p id=\"p_4\">      4. The first applicant was examined as AW1 and Exts. A1 to A4<\/p>\n<p>were marked. After considering the evidence, the Commissioner held<\/p>\n<p>that the deceased was employed as a driver of the            above said<\/p>\n<p>autorikshaw    under   the   third respondent    and    calculated   the<\/p>\n<p>compensation at Rs.2,22,710\/-, which is directed to be paid by the<\/p>\n<p>appellant with 12% interest from the date of the accident. Aggrieved<\/p>\n<p>by that order, the appellant\/second opposite party filed this appeal.<\/p>\n<p id=\"p_5\">      5.  Heard the learned counsel for the appellant and the learned<\/p>\n<p>counsel for the respondents.\n<\/p>\n<p id=\"p_6\">      6.  The learned counsel for the appellant submitted that the<\/p>\n<p>Commissioner went wrong in not even considering the contention of<\/p>\n<p>M.F.A.(W.C.C.)No. 178 of 2008<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">                                   3<\/span><\/p>\n<p>the appellant that the deceased was not having a valid driving licence<\/p>\n<p>or badge to drive the aforesaid autorikshaw. The learned counsel<\/p>\n<p>invited our attention to the decision reported in <a href=\"\/doc\/1490362\/\" id=\"a_4\">National Insurance<\/p>\n<p>Co. Ltd. v. Kusum Rai<\/a> (2006 (2) KLT 300 (SC), in which it was<\/p>\n<p>held that the driving the vehicle without having a valid driving licence<\/p>\n<p>is a breach of condition of the contract of insurance and the insurer<\/p>\n<p>can raise the said defence. In the decision reported in <a href=\"\/doc\/899309\/\" id=\"a_5\">National<\/p>\n<p>Insurance Co. Ltd. v. Mastan<\/a> (2006 (1) KLT 853 (SC), it was held<\/p>\n<p>that an insurer, while defending an action initiated under the<\/p>\n<p>Workmen&#8217;s <a href=\"\/doc\/1113485\/\" id=\"a_6\">Compensation Act<\/a>, is not precluded from raising any<\/p>\n<p>defence as envisaged under <a href=\"\/doc\/152999974\/\" id=\"a_7\">Section 149(2)<\/a> of the Motor Vehicles Act.<\/p>\n<p id=\"p_7\">      7. The learned counsel for the respondents invited our attention<\/p>\n<p>to the decision reported in <a href=\"\/doc\/1751025\/\" id=\"a_8\">Premkumari v. Prahlad Dev<\/a> (2008 (2)<\/p>\n<p>KLT SN 21 (C.No. 25) SC), in which it was held that the mere fact<\/p>\n<p>that the driver had a fake licence would not absolve the Insurance<\/p>\n<p>Company from the liability, unless it is proved that inspite of<\/p>\n<p>awareness of     fake licence the owner permitted him to drive the<\/p>\n<p>M.F.A.(W.C.C.)No. 178 of 2008<\/p>\n<p><span class=\"hidden_text\" id=\"span_2\">                                    4<\/span><\/p>\n<p>vehicle. In the decision reported in <a href=\"\/doc\/1795140\/\" id=\"a_9\">Oriental Insurance Co. Ltd. v.<\/p>\n<p>Nirarudeen<\/a> (2008 (2) KLT 291), it was held that apart from proving<\/p>\n<p>that the driving licence had expired, the insurer has to prove that<\/p>\n<p>absence of driving licence was the cause of the accident.        In the<\/p>\n<p>decision reported in <a href=\"\/doc\/1252086\/\" id=\"a_10\">P.T. Moidu v. Oriental Insurance Co. Ltd<\/a>.<\/p>\n<p>(2007 (4) KHC 385 (DB), it was held that absence of badge in driving<\/p>\n<p>commercial vehicle will attract penal consequences. But it cannot be a<\/p>\n<p>ground to deny the statutory liability to third party compensation.<\/p>\n<p id=\"p_8\">      8. In the decision reported in <a href=\"\/doc\/1827019\/\" id=\"a_11\">National Insurance Co. Ltd. v.<\/p>\n<p>Swaran Singh<\/a> (2004 (1) KLT 781 (SC), it was held that the mere<\/p>\n<p>absence of fake or invalid licence or disqualification of the driver for<\/p>\n<p>driving are not themselves defences availabale to the Insurance<\/p>\n<p>Company. The burden to establish the breach on the part of the owner<\/p>\n<p>of the vehicle lies on the Insurance Company.<\/p>\n<p id=\"p_9\">      9.  In the present case, the appellant has not adduced any<\/p>\n<p>evidence to show the breach of condition on the part of the owner of<\/p>\n<p>the vehicle. Therefore, the appellant Insurance Company cannot be<\/p>\n<p>M.F.A.(W.C.C.)No. 178 of 2008<\/p>\n<p><span class=\"hidden_text\" id=\"span_3\">                                    5<\/span><\/p>\n<p>absolved from the liability. The result is that the appeal has to be<\/p>\n<p>dismissed, as it is without any merit.\n<\/p>\n<p id=\"p_10\">     10. This appeal is accordingly dismissed.
