Respondent.\n\n                        Petition under <a href=\"\/doc\/1712542\/\" id=\"a_1\">Article  226<\/a>  of  the  Constitution  of\nIndia to issue a Writ of Certiorari as stated therein.\n\nFor petitioner :  Mr.  V.Sankara Subramanian\n\nFor respondent :  Mr.  S.Kandaswamy,\n                Special Government Pleader\n\n:O R D E R\n<\/pre>\n<p id=\"p_1\">                        Aggrieved  by  the  Notification  issued under Section<br \/>\n4(1) of Tamil Nadu Harijan Welfare Scheme Act, 1973 published in the  District<br \/>\nGazette  dated 12.10.1995 relating to acquisition of land in Survey No.57\/3 of<br \/>\nChinnamatarapalli  Vaillage,  Krishnagiri  Taluk,  Dharmapuri  District,   the<br \/>\npetitioner  has  filed  the  above  writ petition to quash the same on various<br \/>\ngrounds.\n<\/p>\n<p id=\"p_1\">                        2.  The case of the petitioner is briefly stated  here<br \/>\nunder:-  According  to him, he is physically handicapped with blindness in one<br \/>\neye and deafness and being the owner of  about  5  acres  of  land  in  Survey<br \/>\nNo.57\/3, Chinnamittarapalli  Village, Krishnagiri Taluk.  He is depending upon<br \/>\nthe agricultural income from the said land.  An extent of  1.48.0  hectare  of<br \/>\nland  was  sought to be acquired by the Government of Tamil Nadu for providing<br \/>\nhouse sites to houseless Adidravidars.  Initiallay, notification under <a href=\"\/doc\/169774\/\" id=\"a_1\">Section<br \/>\n4(1)<\/a> of the Land Acquisition Act (Central Act) was published in the Gazette on<br \/>\n12.01.1994 in Dailies on 13.01.1994 and the substance was  also  published  in<br \/>\nVillage on 10.02.1994.  The petitioner appeared for <a href=\"\/doc\/85678\/\" id=\"a_2\">Section 5-A<\/a> enquiry before<br \/>\nthe  Special  Tahsildar  (ADW),  Krishnagiri  and  objected to the acquisition<br \/>\nproceedings on the  ground  that  he  is  physically  handicapped  and  solely<br \/>\ndepending upon  the  agricultural  income.  He also donated his land in Survey<br \/>\nNo.57\/3 measuring  7,200  sq.ft.    to  the  Government  for  the  purpose  of<br \/>\nconstructing  Government  Health  Sub-Centre  in  the  Village by a registered<br \/>\ndocument dated 16.11.1982 and another piece of land measuring 3 cents  in  the<br \/>\nsame  Survey  number  to  the  Government  for  the  purpose of constructing a<br \/>\nPanchayat Office by a document dated 17.09.1993.  While so, after the judgment<br \/>\nof the Supreme Court upholding the provisions of  Tamil  Nadu  Acquisition  of<br \/>\nLand  for  Harijan  Welfare  Schemes  Act,  1978 <a href=\"\/doc\/195458\/\" id=\"a_3\">(Tamil Nadu Act<\/a> in short) the<br \/>\nGovernment of Tamil Nadu has caused publication of <a href=\"\/doc\/1727018\/\" id=\"a_4\">Section  4(1)<\/a>  notification<br \/>\nin  the  District  Gazette,  Dharmapuri dated 12.10.1995, which is impugned in<br \/>\nthis writ petition.  At this stage, questioning the same, the  petitioner  has<br \/>\nfiled the above writ petition.\n<\/p>\n<p id=\"p_2\">                        3.   Pursuant  to  the notice, the District Collector,<br \/>\nDharmapuri has filed counter affidavit disputing various averments made by the<br \/>\npetitioner.  It is stated that though the acquisition was initially under  the<br \/>\n<a href=\"\/doc\/7832\/\" id=\"a_5\">Land  Acquisition  Act<\/a>,  1894 <a href=\"\/doc\/110162683\/\" id=\"a_6\">(Central Act<\/a>), subsequent to the decision of the<br \/>\nSupreme Court, the said acquisition proceeding was continued by  invoking  the<br \/>\nprovisions of <a href=\"\/doc\/195458\/\" id=\"a_7\">Tamil Nadu Act<\/a>.  The respondent is fully justified in continuing<br \/>\nthe same and prayed for dismissal of the writ petition.\n<\/p>\n<p id=\"p_3\">                        4.   Heard  learned  counsel for petitioner as well as<br \/>\nlearned Special Government Pleader for respondent.\n<\/p>\n<p id=\"p_4\">                        5.  There is no dispute that in view of  the  decision<br \/>\nof  the Supreme Court upholding the validity of <a href=\"\/doc\/195458\/\" id=\"a_8\">Tamil Nadu Act<\/a>, 31 of 1978 and<br \/>\nin the light of  the  fact  that  the  respondent  had  initiated  acquisition<br \/>\nproceedings  under the <a href=\"\/doc\/110162683\/\" id=\"a_9\">Central Act<\/a> and award was not passed on the date of the<br \/>\norder of the Supreme Court,  the  respondent  is  well  within  his  power  to<br \/>\ncontinue  the acquisition proceedings by invoking the provisions of <a href=\"\/doc\/195458\/\" id=\"a_10\">Tamil Nadu<br \/>\nAct<\/a>.  However, it is  the  case  of  the  petitioner  that  he  is  physically<br \/>\nhandicapped with blindness in one eye and deafness.  The case of blindness and<br \/>\ndeafness was brought to the notice of the Land Acquisition Officer even at the<br \/>\ntime of  enquiry under <a href=\"\/doc\/195458\/\" id=\"a_11\">Section 5-A<\/a> under <a href=\"\/doc\/110162683\/\" id=\"a_12\">Central Act<\/a>.  Further at the relevant<br \/>\ntime, the petitioner was aged about 70 years.  Now according to  the  counsel,<br \/>\nthe petitioner is aged about 76 years.  In the affidavit, apart from the above<br \/>\naspect,  the  petitioner has also highlighted the donations made by him to the<br \/>\nGovernment for the purpose of construction of Government Health Sub-Centre and<br \/>\nPanchayat office.  All the details such as  extent  of  land,  survey  number,<br \/>\ndocument number,  date  of  registration,  etc.  find a place in page 5 of the<br \/>\naffidavit.  As a matter of fact, in the counter affidavit, the respondent  has<br \/>\nadmitted  the  fact that at the relevant time the petitioner was aged about 70<br \/>\nyears with defective eye and deaf ears (vide para 6 of the counter affidavit).\n<\/p>\n<p id=\"p_5\">                        6.  Apart from  the  above  details,  learned  counsel<br \/>\nappearing  for the petitioner has also brought to my notice the proceedings of<br \/>\nthe District Collector in e\/ f\/ vz;.  56175- 2000- j 3 ehs; 21\/12\/2000 wherein<br \/>\nthe beneficiaries in this writ petition were given  house  site  pattas.    By<br \/>\npointing  out  the proceedings of the District Collector, it is contended that<br \/>\nin view of the order dated 21.12.2000, the beneficiaries for whom the land  in<br \/>\nquestion was sought to be acquired may not be required at this stage.\n<\/p>\n<p id=\"p_6\">                        7.    All  these  materials  have  not  been  properly<br \/>\nconsidered by the respondent.  Accordingly, I  hereby  direct  the  respondent<br \/>\nCollector,  Dharmapuri to consider the objections\/grievances of the petitioner<br \/>\nregarding his age, physical incapacity, being deaf and blindness, donation  of<br \/>\nhis  land  in  two  occasions  for  public  purpose  as well as the subsequent<br \/>\nproceedings of the Collector dated 21.12.2000 in e\/ f\/ vz;.  5 6175- 2000- j 3<br \/>\nassigning some other land to the  beneficiaries  and  pass  fresh  orders  and<br \/>\ncommunicate  the  decision  to the petitioner within a period of 12 weeks from<br \/>\nthe date of receipt of a copy of this order.\n<\/p>\n<p id=\"p_7\">                        8.   In  view of the fact that this Court granted stay<br \/>\nof the impugned proceedings in W.M.P.No.3241 of 1996 even  on  23.02.1996  and<br \/>\nthe  same  is  in  force  all  along, the same order shall continue till final<br \/>\ndecision being taken by the Collector, Dharmapuri as  mentioned  above.    The<br \/>\nwrit petition is allowed to this extent.
