Heard learned counsel appearing for the petitioner and learned counsel<\/p>\n<p>appearing for the respondents.\n<\/p>\n<p id=\"p_1\">              Learned counsel appearing for the petitioner submits that Professor<\/p>\n<p>Krishna Mohan Jha, Department of Philosophy, Ranchi University got retired on<\/p>\n<p>31.1.1998. He put forth his claim of the retiral benefit at several occasions before the<\/p>\n<p>authority of the University but nothing was done in this respect and ultimately, he<\/p>\n<p>died on 5.8.2008. Since retiral benefit could not be paid to the deceased employee,<\/p>\n<p>the petitioner, being brother of the deceased employee after getting no objection<\/p>\n<p>from his other brothers, has filed this writ application wherein prayer has been made<\/p>\n<p>to direct the authority to pay death-cum-retiral benefit to the petitioner.<\/p>\n<p id=\"p_2\">              Having heard learned counsel appearing for the parties, it does appear<\/p>\n<p>that claim of death-cum-retiral benefit which was admissible to late Professor Krishna<\/p>\n<p>Mohan Jha has still not been decided, this writ application is disposed of with a<\/p>\n<p>direction to the petitioner to file a fresh representation raising all his claims which<\/p>\n<p>have been raised in this writ application along with a copy of this order before the<\/p>\n<p>Registrar, Ranchi University, Ranchi, respondent no.4 within a period of three weeks<\/p>\n<p>from today and on getting such representation, the respondent no.4 shall be taking<\/p>\n<p>decision in the matter of payment of death-cum-retiral benefit within a period of eight<\/p>\n<p>weeks thereafter so that the same be paid to the person who is legally entitled to get<\/p>\n<p>the amount.\n<\/p>\n<p id=\"p_3\">\n<p id=\"p_4\">                                                                                 ( R.R.Prasad, J.)<\/p>\n<p>ND\/\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Jharkhand High Court Prof. Man Mohan Jha vs Vice Chancellor, Ranchi Univer on 15 July, 2011 In the High Court of Jharkhand at Ranchi W.P.(S) No.5355 of 2010 Prof..
