      Petitioners grievance is that respondents are proposing to<\/p>\n
install a transformer in the tarred road frontage of the petitioners<\/p>\n
property having an extent of 21.399 cents of land. Ext.P1 is the<\/p>\n
sketch of the petitioners property. According to the petitioners,<\/p>\n
coming to know of the above proposal of the respondents, they<\/p>\n
filed Ext.P3 objection to the 1st respondent. Inspite of it, when<\/p>\n
steps were taken for installing the transformer, they filed this writ<\/p>\n
petition to prevent the respondents from proceeding with the<\/p>\n
proposal.\n<\/p>\n
      2.    Statement has been filed on behalf of the respondents.<\/p>\n
In the statement, it has been clearly stated that the proposal of<\/p>\n
the Board is to install two poles and a transformer and that too<\/p>\n
not in the property of the petitioners, but on the public road. It is<\/p>\n
stated that the location of the transformer was selected as it was<\/p>\n
very near to the load centre and that the feeding arrangement is<\/p>\n
practically much suitable. It is also pointed out that there is no<\/p>\n
other technically suitable vacant location for the installation of the<\/p>\n

transformer and that all the vacant plots available in the area are<\/p>\n
unsuitable for their purpose.\n<\/p>\n
     3.    Yet another point highlighted is that the petitioners<\/p>\n
property has a road frontage of 12.45 meters and that the double<\/p>\n
pole structure for transformer will occupy only 3 meters on the<\/p>\n
road side leaving a clear road frontage of 9.45 meters. It is stated<\/p>\n
that even if the proposal is carried out, that will not affect the<\/p>\n
ingress and egress of the petitioners to the property.<\/p>\n
     4.    Counsel for the petitioners would argue that when<\/p>\n
objection has been raised by filing Ext.P2, respondents ought to<\/p>\n
have taken up the matter before the District Magistrate in terms<\/p>\n
of Section 16(1)<\/a> of the Indian Telegraph Act.<\/p>\n
     5.    However, counsel for the Board submits that Section<\/p>\n
16<\/a> of the Indian Telegraph Act is inapplicable to the case in<\/p>\n
question in as much as the transformer is proposed to be installed<\/p>\n
not in the private property of the petitioners, but on the side of a<\/p>\n
public road.\n<\/p>\n
     6.    I have considered the submissions made.\n<\/p>\n
     7.    Section 10<\/a> of the Act provides that the Telegraph<\/p>\n
Authority may, from time to time place and maintain a telegraph<\/p>\n

\n                               :3 :<\/span><\/p>\n
line under, over, along, or across and posts in or upon any<\/p>\n
immovable property. Sub Section (d) provides that in exercising<\/p>\n
the power under Section 10<\/a>, the authority shall do as little<\/p>\n
damage as possible, and, when it has exercised those powers in<\/p>\n
respect of any property, other than those vested in or under the<\/p>\n
control of any local authority, the authority shall pay full<\/p>\n
compensation to all persons interested for any damage sustained<\/p>\n
to them.\n<\/p>\n
     8.    Section 16<\/a> provides that if the exercise of the powers<\/p>\n
mentioned in Section 10(d)<\/a> is resisted or obstructed, the District<\/p>\n
Magistrate may pass order that the Telegraph authority shall be<\/p>\n
permitted to exercise powers under Section 10<\/a>.<\/p>\n
     9.    A combined reading of Section 10(d)<\/a> and 16(1)<\/a> of the<\/p>\n
Telegraph Act would therefore show that the power of the District<\/p>\n
Magistrate to remove obstruction as provided in Section 16(1)<\/a> is<\/p>\n
only in relation to the properties covered by Section 10(d)<\/a>. In<\/p>\n
other words, the removal of obstruction can only be in relation to<\/p>\n
private property.\n<\/p>\n
     10. In this case, the specific case of the Board is that the<\/p>\n
transformer in question is proposed to be installed only in a public<\/p>\n

road and if that be the factual position, there is no question of the<\/p>\n
respondents making application under Section 16(1)<\/a> of the<\/p>\n
Telegraph Act to the Additional District Magistrate, for an order<\/p>\n
under the said section.\n<\/p>\n
      11. Counsel for the petitioners then contended that there<\/p>\n
are several other convenient locations available in the locality<\/p>\n
where the structure in question could be erected. A reading of the<\/p>\n
statement filed on behalf of the respondents would show that<\/p>\n
they have identified the location in question mainly because it is<\/p>\n
very near to the load centre and that the feeding arrangement is<\/p>\n
practically much suitable. It is also their specific case that the<\/p>\n
other vacant plots are not technically suitable.         One should<\/p>\n
concede that the respondents are the most competent persons to<\/p>\n
assess the technical suitability or otherwise of a location for<\/p>\n
installing a transformer. Once that freedom is conceded to the<\/p>\n
respondents, unless a case of malafides or extreme arbitrariness<\/p>\n
is made out, this Court will not be justified in sitting in judgment<\/p>\n
over the choice of a location done by the respondents.<\/p>\n
      12. In this case, I am not satisfied that the petitioner has<\/p>\n
succeeded in making out a case coming within the aforesaid<\/p>\n

parameters and calling for interference of the decision taken by<\/p>\n
the respondents regarding the location of the transformer in<\/p>\n
question.\n<\/p>\n
      13. Irrespective of all this, it is offered by the respondents<\/p>\n
that they are willing to shift the location of the proposed<\/p>\n
transformer to the north western corner of the petitioners<\/p>\n
property so that the inconvenience if any to the petitioners could<\/p>\n
be minimised. However, according to them, such proposal can be<\/p>\n
implemented only if the petitioners agree for installing the stay<\/p>\n
wires in their private property.\n<\/p>\n
      14. In view of the offer now made by the respondents, it is<\/p>\n
clarified that if the petitioners are willing to permit installation of<\/p>\n
the stay wires in their property, it will be open to the petitioners<\/p>\n
to approach the 2nd respondent, within 10 days from today, in<\/p>\n
which event, the 2nd respondent shall do the needful for shifting<\/p>\n
the proposed location of the transformer to the north western<\/p>\n
corner of the petitioners property.\n<\/p>\n
      Writ petition is disposed of as above.\n<\/p>\n
