RESPONDENT (s)\n\n\nCORAM:- HON'BLE MR.JUSTICE RAM CHAND GUPTA\n\n\nPresent:       Mr. K.S.Rekhi,\n               Advocate for the petitioner.\n\n               Mr. Vaneesh Singla,\n               Advocate for respondent No.1.\n\n                           *****\n<\/pre>\n<p id=\"p_1\">RAM CHAND GUPTA, J.(Oral)<\/p>\n<p>               The present revision petition has been filed under <a href=\"\/doc\/1331149\/\" id=\"a_1\">Article 227<\/a> of<\/p>\n<p>the Constitution of India read with <a href=\"\/doc\/162308135\/\" id=\"a_1\">Section 83(9)<\/a> of the Wakf Act, 1995<\/p>\n<p>(hereinafter called as the &#8216;Act&#8217;) for setting aside impugned judgment and<\/p>\n<p>decree dated 28.11.2008 passed by learned Presiding Officer, Wakf Tribunal,<\/p>\n<p>Amritsar (hereinafter called as the &#8216;Tribunal&#8217;) vide which petitioner has been<\/p>\n<p>ordered to be ejected from the premises in dispute.<br \/>\n<span class=\"hidden_text\" id=\"span_1\"> CR No.345 of 2009                                                        2<\/span><\/p>\n<p id=\"p_1\">            I have heard learned counsel for the parties and have gone<\/p>\n<p>through the whole record including the impugned order passed by learned<\/p>\n<p>Tribunal.\n<\/p>\n<p id=\"p_2\">            The only point argued by learned counsel for the petitioner is<\/p>\n<p>that admittedly the present dispute is between lessor and lessee and that<\/p>\n<p>petitioner has been continuing in possession as tenant over the suit property<\/p>\n<p>under respondent -Punjab Wakf Board. Petition for ejectment was filed by<\/p>\n<p>the respondent before learned Tribunal for ejectment of the petitioner-<\/p>\n<p>defendant in which impugned order was passed for ejectment of the<\/p>\n<p>petitioner-defendant. However, it is contended that this fact cannot be gone<\/p>\n<p>into by the Tribunal constituted under the Act and hence, it is contended that<\/p>\n<p>the impugned judgment which has been passed by learned Tribunal is<\/p>\n<p>without jurisdiction and hence, liable to be set aside. He has also placed<\/p>\n<p>reliance upon the judgments rendered by Hon&#8217;ble Apex Court in <a href=\"\/doc\/568459\/\" id=\"a_2\">Board of<\/p>\n<p>Wakf, West Bengal v. Anis Fatma Begum and another<\/a>, 2011(1) RCR(Civil)<\/p>\n<p>303 and <a href=\"\/doc\/589438\/\" id=\"a_3\">Ramesh Gobindram v. Sugra Humayun Mirza Wakf<\/a>, AIR 2010<\/p>\n<p>Supreme Court 2897.\n<\/p>\n<p id=\"p_3\">            There is force in the argument of learned counsel for the<\/p>\n<p>petitioner. The present case is fully covered by aforesaid judgments passed<\/p>\n<p>by Hon&#8217;ble Apex Court. It has been specifically held by Hon&#8217;ble Supreme<\/p>\n<p>Court in Ramesh Gobindram&#8217;s case that eviction suit against tenant of Wakf<\/p>\n<p>property is not maintainable before the Tribunal and that the Wakf Board<\/p>\n<p>ought to have filed suit before civil court.      The same view has been<\/p>\n<p>retieterated in Anis Fatima Begum&#8217;s case wherein it was observed that<br \/>\n<span class=\"hidden_text\" id=\"span_1\"> CR No.345 of 2009                                                         3<\/span><\/p>\n<p>eviction proceedings regarding Wakf property can only be decided by civil<\/p>\n<p>Court and not by the Tribunal.\n<\/p>\n<p id=\"p_4\">            Hence, in view of aforementioned facts, the present revision<\/p>\n<p>petition is accepted. The impugned judgment and decree passed by learned<\/p>\n<p>Wakf Tribunal, Amritsar is set aside.\n<\/p>\n<p id=\"p_5\">            However, it is made clear that this order shall not prevent the<\/p>\n<p>Wakf Board from instituting, if so advised, appropriate proceedings before<\/p>\n<p>the competent Civil Court for redress of its grievance in accordance with law.<\/p>\n<p id=\"p_6\">                                            ( RAM CHAND GUPTA )<br \/>\nJuly 11, 2011.
