APP (DB) No.41 of 2011\n                                   ARJUN PRASAD\n                                         Versus\n                               THE STATE OF BIHAR\n                                       -----------\n<\/pre>\n<p>2\/   18.1.2011             This appeal will be heard.\n<\/p>\n<p>                           Call for the lower court records of S.T. no. 480 of 2006<\/p>\n<p>                 from the court of Additional Sessions Judge II, Nawada.<\/p>\n<p>                           The appellant has been convicted under sections 302\/34 of<\/p>\n<p>                 the IPC and section 27 of the Arms Act.\n<\/p>\n<p>                           Counsel for the appellant submits that there was no<\/p>\n<p>                 evidence connecting this appellant with the murder of the deceased.<\/p>\n<p>                 The court below has also recorded a finding in paragraph 15 of the<\/p>\n<p>                 judgment that the prosecution has miserably failed to produce any<\/p>\n<p>                 legal material against the accused persons. Despite this fact, the<\/p>\n<p>                 appellant has been convicted by the trial court.<\/p>\n<p>                           Considering this fact, prayer on behalf of the appellant for<\/p>\n<p>                 bail is allowed. During the pendency of the appeal, let appellant<\/p>\n<p>                 Arjun Prasad be released on bail on furnishing bail bond of<\/p>\n<p>                 Rs.10000\/(ten thousand) with two sureties of the like amount each to<\/p>\n<p>                 the satisfaction of Additional Sessions Judge II, Nawada in S.T. No.<\/p>\n<p>                 480 of 2006.
