Rathod for the applicant and learned A.P.P.<br \/>\nMr.Devang Vyas for the respondent-State at length and in great<br \/>\ndetail. I have considered the role attributed to the applicant which<br \/>\nis reflected in the F.I.R., police papers and photographs produced by<br \/>\nthe learned A.P.P. for my perusal. Considering the same and<br \/>\nconsidering the provisions of <a href=\"\/doc\/1101188\/\" id=\"a_4\">Sections 379<\/a> and <a href=\"\/doc\/1897847\/\" id=\"a_5\">120B<\/a> of the Indian<br \/>\nPenal Code, <a href=\"\/doc\/480048\/\" id=\"a_6\">Section 15(2)<\/a> of the Petroleum and Mineral Pipeline Act,<br \/>\n1962 and Under Sections 3 and 7 of the Prevention of Damages to<br \/>\nPublic Properties Act, 1984, quantum of punishment and since the<br \/>\nother co-accused are already released on bail, I am of the view that<br \/>\nthe applicant deserves to be enlarged on bail. However, stringent<br \/>\nterms and conditions are required to be imposed on the applicant<br \/>\nwhile releasing him on bail.\n<\/p>\n<p id=\"p_2\">3.\tIn the facts and<br \/>\ncircumstances of the case, the application is allowed and the<br \/>\napplicant is ordered to be enlarged on bail in connection with<br \/>\nC.R.No.I-10 of 2010 registered with Viramgam Rural police station on<br \/>\nexecuting a bond of Rs.20,000\/- [Rupees twenty thousand only] with<br \/>\none surety of the like amount to the satisfaction of the Trial Court<br \/>\nand subject to the conditions that he shall:\n<\/p>\n<p id=\"p_3\">[a]\tnot take undue<br \/>\nadvantage of his liberty or abuse his liberty;\n<\/p>\n<p id=\"p_4\">[b]\tnot act in a manner<br \/>\ninjurious to the interest of the prosecution;\n<\/p>\n<p id=\"p_5\">[c]\tsurrender his<br \/>\npassport, if any, to the lower Court within a week;\n<\/p>\n<p id=\"p_6\">[d]\tnot leave the State<br \/>\nof Gujarat without the prior permission of the Sessions court<br \/>\nconcerned;\n<\/p>\n<p id=\"p_7\">[e]\tmark his presence at<br \/>\nthe concerned Police Station twice i.e. on 1st and 15th<br \/>\nday of every English calendar month between 9.00 AM and 2.00 PM. till<br \/>\nthe trial is over;\n<\/p>\n<p id=\"p_8\">[f]\tfurnish the present<br \/>\naddress of his residence to the I.O. and also to the Court at the<br \/>\ntime of execution of the bond and shall not change his residence<br \/>\nwithout prior permission of this Court;\n<\/p>\n<p id=\"p_9\">[g]\tmaintain law and<br \/>\norder.\n<\/p>\n<p id=\"p_10\">4.\tIf breach of any of<br \/>\nthe above conditions is committed, the Sessions Judge concerned will<br \/>\nbe free to issue warrant or to take appropriate action in the matter.\n<\/p>\n<p id=\"p_11\">5.\tBail bond to be<br \/>\nexecuted before the lower Court having jurisdiction to try the case.\n<\/p>\n<p id=\"p_12\">6.\tAt the trial, the<br \/>\nTrial Court shall not be influenced by the observations of<br \/>\npreliminary nature, qua the evidence at this stage, made by this<br \/>\nCourt while enlarging the applicant on bail.\n<\/p>\n<p id=\"p_13\">7.\tRule is made absolute<br \/>\nto the aforesaid extent.
