SIRI JAGAN, J.\n                 -----------------------------------\n                   W.P.(C) No.35008 OF 2010\n              ---------------------------------------\n            Dated this the 1st day of December, 2010\n\n                              JUDGMENT\n<\/pre>\n<p id=\"p_1\">      The petitioner is working as a UPSA in an aided School with<\/p>\n<p>effect from 23.7.1999.          There was a dispute regarding her<\/p>\n<p>approval, which was later granted with effect from 23.7.1999<\/p>\n<p>itself by order dated 4.8.2007. In the meanwhile, the petitioner<\/p>\n<p>exercised her option for revision of pay in accordance with 2004<\/p>\n<p>pay revision order and she opted to come over to the revised<\/p>\n<p>scale of pay with effect from 6.6.2005.              The petitioner now<\/p>\n<p>wants to change the date of option as 1.7.2004 instead of<\/p>\n<p>6.6.2005. The petitioner&#8217;s request for the change of option date<\/p>\n<p>has been rejected by Ext.P9 on the ground that the time limit<\/p>\n<p>prescribed for re-option has already expired. The petitioner is<\/p>\n<p>challenging Ext.P9 seeking the following reliefs:<\/p>\n<blockquote id=\"blockquote_1\"><p>          &#8220;i)   Call for the records leading to Ext P9 and<br \/>\n          may be pleased to quash the same.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_1\"><p>          ii)   Issue an appropriate writ, order or direction<br \/>\n          commanding the       respondents    to  accept  the<br \/>\n          reoption of the petitioner with the date 1\/7\/04 and<br \/>\n          consequently to provide all the service benefits<br \/>\n          emerging there from to the petitioner within such<br \/>\n          time as may be fixed by this Hon&#8217;ble court.&#8221;\n<\/p><\/blockquote>\n<p><span class=\"hidden_text\" id=\"span_1\">W.P.(C)No.35008\/10                2<\/span><\/p>\n<p id=\"p_1\">The petitioner&#8217;s contention is that, since the question of the<\/p>\n<p>approval of the petitioner&#8217;s appointment was pending, the<\/p>\n<p>petitioner cannot be faulted for not filing the re-option within<\/p>\n<p>the prescribed time limit. I do not think that the petitioner&#8217;s<\/p>\n<p>contention can be countenanced, in so far as the petitioner had<\/p>\n<p>in fact exercised her option once for which the delay in<\/p>\n<p>approval of appointment was not a bar. She puts forward the<\/p>\n<p>delay in passing orders on approval as an excuse only for the<\/p>\n<p>question of re-option. If the petitioner could file the original<\/p>\n<p>option in time, nothing prevented her from filing the re-option<\/p>\n<p>also within time. As such, the petitioner&#8217;s contention that it is<\/p>\n<p>because of delay in passing orders on her approval cannot be<\/p>\n<p>countenanced now. Admittedly, the petitioner did not exercise<\/p>\n<p>the re-option within the period prescribed for the same by the<\/p>\n<p>Government. As such, the petitioner is not entitled to the re-<\/p>\n<p>option prayed for.\n<\/p>\n<p id=\"p_2\">      Accordingly, the writ petition is dismissed.<\/p>\n<p id=\"p_3\">                                      S.
